Page 8 of 8 - z:lsharedllorms\BZA applications\ Development Stendards Variance Application rev. 1212912006 __ ______ __ 1- __ STATEMENT OF VARIANCE Docket No.: 07060025 DSV Petitioner: Beniamin Garrett It is my intention to build a deck, approximately 50' long, along the north side of my house at 14582 Danbury Dr. My proposed design necessitates a variance of development standards due to Carmel Zoning Ordinance, Chapter 10: 10.04.03 sub-section B.1., which states that the minimum side yard be maintained at ten (10) feet from a single-family dwelling. My design would have the deck extending beyond the side of my house out to the western edge of my property. The deck, if approved, will be constructed within one foot of the property line in two (2) places. The first being the corner of a partially octagonal step defining the western boundary of the deck, and the second being the corner of a slightly elevated octagon defining the northwestern boundary of the deck. However, a majority of the desirable portion of this project will be extending into the ten (10) foot barrier defined by the aforementioned zoning ordinance. STATEMENT OF SUPPORT Docket No.: 07060025 DSV Petitioner: Beniamin Garrett Due to the irregular size and shape of my lot, I have been left with a very small back yard. With the neighborhood landscape easement being so close to my house, my options have been extremely limited with respect to the usefulness and enjoyment of my land. I also feel that in the future, the lack of back yard will present problems when and if I decide to sell my house. If this variance is approved, the most undesirable part of my house will become a large selling point, and add a great deal of value to my house. More importantly, I'll be able to enjoy my back yard, the way a homeowner should. With the layout of my back yard, if I were to scale down my plans to not encroach on my property line, the deck would not be large enough to comfortably accommodate a normal sized patio set (table and chairs), and a grill. Adjacent to the property line of interest, is a large field with a retention pond. This area, as I understand, has the sole purpose of retaining run-off water from the Lowes parking lot. Also, I do not have neighbors on either side of my property. Therefore, I find it hard to believe that the encroachment of a deck on my western property line will be a nuisance to anybody. However, it certainly would allow me to make a much desired improvement to my home.
