In regard to Item # 4, the PUD will be revised to include language regarding bicycle parking. However, we (

In regard to Item # 9, there is nothing in the PUD that supersedes any of the Department of Engineering's
standards and requirements. Stated differently, any applicable standards and requirements of the Department of
Engineering shall control and govern the development of this site.
Based on Rich's responses below and my responses above, my understanding is that we have addressed all
issues with Gary Duncan and the Department of Engineering. If this is not the case, please advise

differences on our proposed landscape plan. Attached is an edited version of the
document Scott produced on the day of our PC hearing with the changes that are
agreeable to us. David K. will make the remaining changes to the site plan and
have this revised site plan delivered to Rich Kelly's office in the morning.
Rich knows by VM to print a couple full size site plans and at least 15 of the 11 X
17 size for distribution at the PC committee meeting. Rich you can also distribute
electronically to the team.

Section 7. Landscaping Requirements.
The landscaping in the PUD District shall be designed to compliment the architecture
of the residential and commercial buildings. Street trees, streetscape plantings, and buffer
areas shall be used to bring natural elements to the design pattern, in consultation with the
Carmel Urban Forester.
Section 7.1. General Landscaoina Standards. Landscaping shall be integrated
with other functional and ornamental site design elements, where appropriate,
such as hardscape materials, paths, sidewalks, fencing, or any water features.
Plantings along buildings and streets should be designed with repetition,
structured patterns, and complementary textures and colors, and should reinforce
the overall character of the area. Alternative or pervious paving material may be
considered, or alternative planting media shall be considered, for the urban areas
where planting space is limited by restrictions such as buildings, asphalt or
concrete paving, parking lots, etc.
All trees, shrubs and ground covers shall be planted according to American
Standard for Nursery Stock (ANSI 260.1), and following the standards and best
management practices(BMPs) published by the City's Department of Community
Services Urban Forestry Section. Landscaping materials shall be appropriate to
local growing and climatic conditions. Plant suitability, maintenance and
compatibility with site construction features are critical factors that should be
considered.
Shade trees shall be at least 2.5" in caliper diameter when planted. Ornamental
trees shall be at least 1.5" caliper diameter when planted. Evergreen trees shall be
6' in height when planted. Shrubs shall be at least 18" in height when planted.
Ornamental grasses shall obtain a mature height of at least 3'.
The Developer shall conserve existing established trees identified on the
Tree Preservation Plan (Exhibit _); however, said trees may be removed
under any of the following circumstances:
. As is necessary to clear dead trees;
. As is necessary for the installation of access easements, rights-of-way,
streets, paths, sidewalks, utilities and drainage improvements,
infrastructure; and
. As necessary for public health and safety as determined in cooperation
with the Urban Forester.
Existing vegetation may be used to achieve project landscaping requirements if
(a) the vegetation located on subject parcel is of suitable quality and health, and
(b) the vegetation is proposed to be preserved using accepted best management
practices for tree protection during construction.
Section 7.2. Maintenance
It shall be the responsibility of the owners and their agents to insure proper
maintenance of project landscaping in accordance with the Park Place Ordinance and
best management practice standards. This is to include, but is not limited to,
watering, mowing, tree trimming, planting, maintenance contracting, irrigation and
mulching of planting areas, replacing dead, diseased, or overgrown plantings with
identical varieties or a suitable substitute, and keeping the area free of refuse,
debris, rank vegetation and weeds.

Section 7.3. Buildinq Base LandscaDinq Standards
Building base landscaping shall be provided at the base of all building elevations
that do not directly abut planted hardscapes to soften the architectural lines of
buildings, frame the primary views to buildings and pUblic spaces, and blend
architectural designs with the landscape. Building landscaping shall be designed
to appropriately complement a building's use, setback, height, and architectural
features. Window boxes for flowers and planters on front stoops and sidewalks
are encouraged in areas where landscaping cannot be installed at the base of a
building due to the building's proximity to a sidewalk, path, street, right-of-way
or easement. Building base landscaping may help fulfill bufferyard requirements
where applicable!
Primary area building base landscaping shall contain a minimum of 2 shade trees, 1
ornamental tree, and 9 shrubs per 100 linear feet of building perimeter. Shrubs,
ornamental grasses, or other alternate landscaping techniques may be used to fulfill the
building base landscaping requirements if approved by the Department. If building base
landscaping cannot be installed due to a building's proximity to a sidewalk, path, street,
right-of-way, or easement then landscaping may be installed elsewhere on the site to
fulfill the building base landscaping requirements. Appropriate alternate locations include,
\but are not limited to: interior courtyards, sidewalks (as additional street trees), parking
lots, alleys, etc. In addition, where facades abut the public right-of-way and/or sidewalks
span the entire frontage, planting islands may be created within the right-of-way and
street trees can help fulfill this requirement.
Deciduous trees should be planted in locations to the south and west of building to allow
for shade in summer months and greater sun exposure in the winter months. Evergreen
trees should be used as windbreaks to buffer northwest winds.

Section 7.5. Perimeter Plantina and Buffervard Reauirements
Perimeter landscaping along the property lines shall be provided in the form of either (a)
landscaping per the requirements of the conceptual landscape plan for Park Place CCRC
or (b) street trees for portions of the perimeter which abut other existing public right-of-
way or where a public right-of-way is created via a proposed road, or (c) existing
landscaping which meets the health and quality requirements found in Carmel Clay land
Use Regulations Section 26.04. Any street trees used to meet perimeter landscape
requirements shall meet all other standards provided in this Section 7.4.
Bufferyards shall be planted at the time of construction of the buildings. Trees shall be
planted at intervals no less than twenty (20) feet, nor more than thirty (30) feet.
Shrubbery may be planted informally or in rows and shall screen parking areas, outside
storage areas, loading berths, trash and refuse containers, and so forth from view.
Section 7.6 Parkinq lot landscaoina.
Where parking lots are visible, the following requirements shall apply:
7.6 (a) lot interior. Minimum of one (1) shade tree per nine (9) parking
spaces, with a minimum of four hundred square feet (400 SF) of useable soil
volume being provided for each two (2) trees. Planting areas shall be evenly dispersed
throughout the parking area;
7.6 (b). lot Perimeter. A minimum five foot (5') wide perimeter planting strip
shall be provided on all sides of lot (except where parking spaces abut curb-to- building
sidewalk) including four (4) shade trees and twenty-five (25) shrubs
and/or ornamental grasses per one hundred lineal feet (1 OOlF) of strip. Perimeter
planting may occupy the same space as a required bufferyard and may contribute
towards Perimeter Bufferyard Requirements.
7.6 (c) Pedestrian Corridors For any pedestrian corridors, where adequate space exists,
trees, shrubs and groundcover shall be planted.

Since no one showed up today, I am assuming the meeting changed, or you didn't want to meet. As I said in the
beginning of my comments to the PUD, I did not think my comments would need to change the landscape plan
much.
The idea of a PUD is NOT to give the City less than the ordinance requires, but to give the developer more
flexibility while giving the City things that are equal to or more than the ordinance requires. For some reason,
great confusion arises when people begin to talk about landscaping requirements and ordinances. The trick in
writing a PUD seems to be listing enough detail for the City to feel secure that the public get what they used to
seeing by requiring verbal commitments, while at the same time giving the developer enough flexibility to end up
building what they need to make things work.
I can not support clauses that negate plantings or numbers of plantings that are normally required in the
ordinance, like reducing the number of foundation plantings by one third (by extending the same number of plants
in 100' to 150') or stating that street trees are questionable and not recommended. The ordinances are what they
are, and normally developers would ask for a waiver from planting the ordinance requirement.
When we talked on the phone previous to my comments on the PUD, you had agreed to make some changes
and submit a revised landscape plan that included some street trees and some additional shade trees to the
South bufferyard, among others.
Have those revisions been made yet? I might be able to agree to let the parking lot buffer strip plantings and the
perimeter bufferyard plantings count for each requirement where they do share the same space (proposed
Section 7.6 (b)), but not where they are 50' to 180' apart.
The sentence that you quoted as being from Carmel ("*to soften the architectural lines of
the building(s), frame primary views to buildings & public spaces
and blend architectural designs with the landscape'j was actually from the PUD that was
submitted, I think by Mr. Shinaver.

These quantities will provide an appropriate landscape setting for the
buildings as stated above* without being overbearing. The
introduction of double the recommended amount of shrubs is
intended to provide significant pedestrian eye level interest along
the base of buildings.
* As stated by Carmel in the first paragraph of Section 7.3.
Section 7.4 Street Trees
Trees planted within the right-of-way are not recommended and
are questionable for these reasons:
1. The trees would typically conflict with the
locations of underground utilities and structures.
2. Twenty five trees planted 30' to 50' apart within the
right-of-way will compromise the views
to the buildings which have been designed
into the front bufferyard planting.
Section 7.5 Perimeter Planting and Bufferyard Requirements

7.6(a) Lot Interior

I enjoyed meeting with you and Wayne Beverage on October 5th when you both so nicely
reviewed the information concerning the Retirement Community planned for Guilford Road in
Carmel.
I have lived on Guilford Road in Carmel for almost twenty years and am very pleased and
excited about the changes that been happening in our city. This is especially true in
downtown Carmel, along City Centre Drive, and along Guilford Road. It is becoming more
and more a wonderful town to live in with beautiful architecture, bike trails, parks, and
great malls like Clay Terrace. I am looking forward to the Gramercy complex as well.
The wetlands on Guilford Road, as they currently exist, are a terrible eye sore. People
have been dumping Christmas trees and trash in that area for years. The plans you have
for the Retirement Community where the wetlands are now would be, I believe, a great
improvement and nice addition to the neighborhood. Wayne has thought things through very
carefully and wisely.

I want to encourage you to recommend to the state and to the developers that they work
to conserve the wetlands area and its appearance as much as possible. There is a video
called Building with Nature. It was produced by the Cannel organization Citizens for
Greenspace. It addresses this issue and explains how it is profitable for the developer to
work with nature and not disregard nature. I could loan you my copy if you want to view
the video.
If it is decided not to save the wetlands, I would strongly urge you to do all in your power
to make sure that as much wildlife as possible is relocated. Bulldozers should not be
allowed into the area in the spring of the year because it is the nesting season. Birds
simply won't reproduce if their nesting area is disturbed. Also, the fall should also be off
limits to heavy equipment because that is when birds and wildlife find their winter food
sources and sanctuaries.
Thank you for taking the time to read and consider my concerns. I do hope that you will
do all you can to preserve this valuable resource in our community.

We have reviewed the Concept plan submitted to the Hamilton COW1ty Surveyor's Office on
September 1, 2006 fOf thi, project and have the following coIIlIl1cuts:
I. This proposed project falls within the incorporated area and MS4 jurisdiction of
the City of Cannel.
2. The W.R. Fertig Regulated Drain passes through the proposed site.
3. The proposed site DOES NOT fall in a Cannel Wellhead Protection Zone.
4. The proposed site falJs in the W.R. Fertig watershed, which has an allowable
release rate set at 0.24 cfs per acre by the Hamilton County Drain.age Board.
S. Please note this site will be required to comply with the n~ Hamilton County
Stonnwater Management Tec:hnical Standards Manual. and any additional
requirements of the City of Cannel Manual. The allowable release rates will be
based off of the total site acreage, less the property east of the open ditch and any
undetained floodplain area, using the 0.1 and 0.24 efs per acre rate.
6. The portion of the W.R. Fertig Drain that passes through. the site is cUlTently an
unstudied area. Hamilton County Ordinance: 4-26-99-C(6)(a) requires a study be
performed on this area to determine a 100 year flood elevation and any flood-
plain. This office will require a HEC-2 or BEe-RAS study,be performed and
submitted to HCSO and IONR, since the upstream watershed is over I square
mile in size. before any approval will be granted by this office.

7. Hamilton County Ordinance 4-26-99-C(6) also prohibits the filling of flood plain
(Floodway and Floodway Fringe) of any regulated drain. Once the above
mentioned study is conducted and approved, any floodplain that is determine will
not be allowed to be tilled or buildings/detention ponds constructed within.
8. Hamilton County Ordinance 4-26-99-C(4) requires improvements to the open
regulated drain that traverses the parcel. The requirements will include tree
removal from bank to bank and 30' on each side of the ditch from top of bank, as
outlined in the ordinance. This will also include, but not limited to, flow line
obstruction removal. and channel stabilization.
9. Please schedule an on-site meeting with the engineering firm, developer~ and this
office to determine the scope of work for the improvements listed above, prior to
construction plans being submitted for this project.
10. The width of the W.R. Fertig Legal Drain Easement is 75' from the Top of Bank
on both sides of the open ditch, as outlines in I.e. 36-9-27-33. Please show the
easement correctly, once topographic work is done to locate the TOB.
11. This site has existing drainage from Lenno,c Trace and Townhomes at Guildforo
that will need to be addressed properly BEFORE any construction is done that
would cut off their drainage access to the W.R. Fertig Regulated Drain.
12. Please submit construction plans and drainage calculations for review by this
office when they become available.
13. Please note that further comments may be necessary at a later date.
