Good morning. Recently a replat application was submitted (by Miller Surveying) for lots 5 & 6 within this subdivision.
However, the Department needs two copies of the original recorded plat of all 6 lots from your firm. It is not in our files.
Also, I am not even sure if the Planning Director signed the plat before it was recorded.
Please provide the requested items as soon as possible, since technically it should have been provided about 3 years
ago!

RE: Chateaux de Moulin Regulated Drain
Unauthorized Installation of Drainage Facilities

Pursuant to a. Stop Work Order issued by this Office, we have recently inspected the
Chateaux de Moulin site and observed that the work of installing drainage facilities has
continued in defiance of the Stop Work Order.
This is in direct violation of Indiana Drainage Code and Hamilton County Ordinance.
Upon receipt of this letter you have ten (10) days in which to correct the Violation
according to the standards set forth by this Office and The Hamilton County Drainage
Board. The corrections will be achieved by:
1. Removing the storm facilities and restoring the site to pre-construction conditions.
2. Plans that meet the standards of this office must be stamped and approved by this
Office.
At the time of correcting the violation a representative from this office is required to
inspect the work.

If this work is not performed within the ten- (10) day period, a work order will be sent to
the Hamilton County Drainage Board COl1tractor to complete the work. The bill for the
work will be sent to the Pronertv Owner. It is mandatory to contact the Hamilton County
Surveyors Permit Inspector, Michael Kole, at 776-8495 upon receiving this violation.

Dear Mr. Miller:
We have reviewed the revised construction plans submitted to the Hamilton County
Surveyor's Office on June 1,2004 for this project and have the following comments:
1. Please submit the following procedural items to this office: all associated bonds
for 100% of construction cost.
2. In accordance with Ordinance No. 4-26-99-C, #5, the developer needs to contact
owners downstream of the outlet until the point where it reaches Williams Creek
(crosses 4 different parcels with 3 property owners). This is to determine if the
downstream owners wants the existing open ditch from the pond to become
regulated. and to notify them of their rights to appeal any approval of the design.
3. Provide written documentation of the notification and the outcome to this office.
Downstream improvements to this natural watercourse may be required unless
documentation is provided from the property owners that they do not want to
become part of the regulated drain.
4. After completing above item #3t please schedule an on-site meeting with the
engineering finn, developer. contractor (if selected) and this office to determine
the scope of work for the downstream improvements.

S. If the downstreant property owner (Hilbert) does not want to become part of the
regulated drain system, a 30' wide private easement will need to be attained to
ensure we can maintain the drainage into the existing pond. This recorded
easement must be presented to this omee before the plans eaD be approved,
as this is key to the project outlet.
6. The downstream property owner (Hilbert) has expressed concerns about the
discharge into the existing pond. If they choose not to become part of the
regulated drain system, please provide a letter they are acceptable with the
discharge and effects on their pond.
7. All SSD in swales must be HDPE (double wall smooth wail) pipe and contain
riser at the end per HCSO detail 88D-3. Please note the required risers on the
gradinl aDd drainace plaD.
8. The Hamilton County Swveyor's Office does not allow blind taps into the
regulated drain, as proposed in the south-west corner oflot 2. If this connection
can not be avoided, at riser must be set just behind the cW'b per HCSO detail
SSD-3. Please note the required riser on the gradiDg and drainage plan.
9. The Hamilton County Surveyor's Office requires 20' perimeter drainage
easements and swales. Any easement containing SSD must be 30' easements for
the regulated drain. The perimeter easement OD the east property line Deeds to
be 20', not the shown 15'.
10. The swale across the entrance of the subdivision will discharge onto the
neighboring property owner. A site visit revealed that no apparent outlet exists
and this water will just pond on this site. A recommendation would be to
continue the swaie down the eastem property line to the pond, there by capturing
all the site water. The swale most likely would require SSD and the easement
would need to be increase to 30'. This issue wUl need to be resolved or agreed
to be the neighboring property owner.
1 J. On the plat. please label the drainage easements with storm pipes at "R.D.E."
(Regulated Drainage Easement). Also~ label the ingress/egress easement
(Common Area C) as a "R.D.E.", since this area will contain regulated SSD under
the curb line.
12. All casting should be labeled "Dump No Waste- Drains to Waterway," which are
readily available now from local casting distributors. Please add a note to the
plans that will make the contractor aware of this requirement.
13. It appears a conflict may exist with the SSD and pipe run 108 to 109.
14. Please provide a copy of the landscape plan with the next submittal.

WHEN A COPY OF THE PLAT IS SUBMITTED FOR RNAL REVIEW
1. The following statement must be inclUded on the plat: The private street statement
on the plat needs to read. Campbell Development 2, LLC and any and all successors
and assigns hereby waive all rights to petition the Hamilton County Highway
Department, the HamUton County Board of Commissioners, or Hamilton County, or
the successor unit of government to be responsible for the maintenance of the
Ingress-egress easement, or to have the easement considered a public road
necessitating maintenance by any unit of govemment.
2. Additionally, all references to right of way on the Interior street need to be removed
and replaced with notes that the ground where the street lies Is an Ingress-egress
easement.
3. I have included a copy of the access easement agreement for maintenance of the
street. The agreement must be completed prior to plat approval.
4. Please.note that decorative signs, sprinkler Systems, trees, landsceplng mounds,
fences, light poles or other such amenities are not permitted in the right of way.
5. Before any approvals are granted for the secondary plat, performance bonds must
be submitted for 100% of the construction cost of the following Items: Stone Base,
HAC Binder, HAC surface, Concrete Curbs and Street Name and Regulatory signs.
6. A 9lgnature block for the Hamllton County Board of Commissioners Is needed on the
plat.
7. All of the horizontal curve Information Is needed In tabular form on the plat.
8. A variance for the cul~de-.sac length must be obtained prior to approval of the
construction plans or secondary plat. The variance must be obtained from the
Hamilton COunty Board of Commissioners. The variance must be obtained from
the Hamilton County Board of Commissioners.
9. The drainage and utility easements must extend across the front of the Common
Areas unless the Common Areas are noted as drainage and utility easements.

Dear Greg:
We have received and reviewed your letter dated May 17,2004 and would like to follow up from
the TAC meeting comments as well.
1. We submitted the non-enforcement request to you at the T AC meeting on 5-19-04.
2-6. We will continue our correspondence with the attorneys and engineers for the
downstream property owners seeking their permission to discharge stormwater onto their
property. We presented them with an option of forming a legal drain. hritial reaction did
not favor this approach, so we are seeking signed documentation from Mr. Hilbert
allowing the site to discharge onto his property.
7. We have put adjacent landowners on the construction plans.
8. We have labeled the drainage easements on the drawings.
9. We have added your suggested details.
10. There is approximately 20' between the 100- Y ear pond elevation and the easement line.
This should be sufficient for maintenance access to the pond.
11. We have eliminated the need for SSD in swales.
12. We have added a riser to the plans at that point.
13 . We have revised the drainage easement for the pipe run. It is now 30'.
14. We have revised all easements that contain a SSD.
15. We will get a letter from Mr. Hilbert acknowledging and accepting water runoff.
16. We have eliminated the need for SSD in swales.
17. We have added pond top of bank and bottom elevations.
18. We have added minimum finished floor elevations to lots 1 and 2.

1. We have added the existing waterline along Spring Mill Road.
2. The developer's attorney is working on acquiring the proper easements along 116th Street.

4. At this time we are working out the details on this project with both the City of Carmel,
and the Hamilton County Highway Department.

We have received and reviewed your letter dated May 20,2004 and would like to follow up from
the TAC meeting comments as well. We have addressed your comments below.
1. We have added the statement regarding the private street to the plat.
2. We have changed the references to right of way in the plat.
3. We have passed on the access easement to the developer's attorney for proper action.
4. Noted.
5 . We have taken note of the bonding requirements, and have passed this on to the
developer.
6. We have modified the signature block to reflect the Hamilton County Board of
Commissioners.
7. We have added the horizontal curve information in tabular format..
8. Joseph Calderon, the developer's attorney, confirmed that a cul-de-sac variance has been
obtained.
9. We have added a note stating that common areas also are drainage and utility easements.
10. We have added a 4' sidewalk to the inside of the cul-de-sac island. This will allow
emergency vehicles easier passage around the cul-de-sac.
11. We have modified the back of curb numbers.
12. We have added right of way and easements widths to all plans.
13. A copy of the landscape plan enclosed.

Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the
Performance amount for Streets and 10% ofthe Performance amount for all other improvements.
Performance Guarantees may be Performance or Subdivision Bonds, Irrevocable Letters of Credit or
Cashier's/CertifiedJOfficial Checks. Please reference the enclosures for more detailed explanation of our
procedures.
SECONDARY PLAT COMMENTS
I. Who will approve and sign the plat, the Board of County Commissioners or the City of Carmel Board of
Public Works and Safety? If our Board has jurisdiction, all required Performance Guarantees required by the
City of Carmel and by Hamilton County jurisdiction agencies must be posted with the appropriate agency.
2. The City recommends extending the 20' D.E. on Lots 2 and 6 to the 15' D.D.E. along Chateux Drive.

We have reviewed the construction plans submitted to the Hamilton County Surveyor's
Office on May 3,2004 for this project and have the following comments:
1. Please submit the following procedural items to this office, non-enforcement
request for subdivision and all associated bonds for 100% of construction cost.
The application is available on our website at bttp://www.co_hamilton.in.us. go to
Departments, Surveyor. and Drainage Permits.
2. In accordance with Ordinance No. 4-26-99-C, #5, the developer needs to contact
owners downstream of the outlet until the point where it reaches Williams Creek
(crosses 4 different parcels with 3 property owners). This is to determine if the
downstream owners wants the existing open ditch from the pond to become
reg\.tlated, and to notify them of their rights to appeal any approval ofthe design.
3. Provide written docwnentation of the notification and the outcome to this office.
Downstream improvements to this natural watercourse may be required unless
documentation is provided from the property owners that they do not want to
become part of the regulated drain.
4. After completing above item #3. please schedule an on~site meeting with the
engineering firm, developer, contractor (if selected) and this office to determine
the scope of work for the downstream improvements.

5. Ifthe downstream property owner (Hilbert) does not want to become part of the
regulated drain system, a 30' wide private easement will need to be attained to
ensure we can maintain the drainage into the existing pond.
6. The downstream property owner (Hilbert) has expressed concerns about the
discharge into the existing pond. If they choose not to become part of the
regulated drain system, please provide a letter they are acceptable with the
discharge and effects on their pond.
7. Please show the adjacent property owners when submitting full construction
plans.
8. Please label the drainage easements on the construction plans.
9. Please add the following Hamilton County Surveyor's Office Standards in the
construction plans: 0-5, D-IO, and D-12.
10. The approved HCSO standard pond details require a 15' drainage easement from
top of bank. The current easement does not appear to meet this requirement on
the north side of the pond. Also, some clearing will be required to have a clear
easement around the other 3 sides of the pond.
11. All SSD in swales must be HDPE (double wall smooth wall) pipe and contain
riser at the end per HCSO detail SSD-3.
12. The Hamilton County Surveyor's Office does not allow blind taps into the
regulated drain, as proposed in the south-west corner of lot 2. If this connection
can not be avoided, at riser must be set just behind the curb per HCSO detail
SSD~3.
13. The plat shows 20' drainage easements for pipe run 101 thru 107, which does not
meet the 30' width required for a regulated drain.
14. The Hamilton County Surveyor's Office requires 20' perimeter drainage
easements and swales. Any ea.sement containing SSD must be 30' easements for
the regulated drain.
15. The swale across the entrance of the subdivision will discharge onto the
neighboring property OWner. A site visit revealed that no apparent outlet exists
and this water will just pond on this site. A recommendation would be to
continue the swale down the eastern property line to the pond, there by capturing
all the site water. The swale most likely would require SSD and the easement
would need to be increase to 30'.
16. The swale on the west side of lot 6 will require the SSD to outlet into the pond
with a 20' length ofeMP and an animal guard, at the normal pool elevation. This
could be avoided in the swale was installed at 1 % slope (deepen the south end 1
toot).

The construction component of the Storm water Pollution Prevention Plan includes stormwater quality
measures to address erosion, sedimentation, and other pollutants associated with land disturbance and

The post construction component of the Stormwater Pollution Prevention Plan includes the
implementation of stormwater quality measures to address pollutants that will be associated with the
mallanduse. Post construction stormwater quality measures should be functional upon completion of
the project. Long term functionality of the measures are critical to their performance and should be

LETTER OF APPROVAL
The undersigned has reviewed the proposed plans for
Chateaux De Moulin
and has approved the plans subject to the following:
1. Will this development be a gated community? If so, we are requiring that a 5.0.5 type access
device be installed on the gate for emergency access. This type of device is also required to
have a battery back up installed in the event of a power outage the gate will still operate.
2. Will the proposed project have an amenity building? If so we are requesting the purchase of a
Knox box for emergency fire department access.
3. I am providing you with the turning radii of our apparatus. Please use these figures in
determining if the cul-de-sac turning radii will accommodate our largest piece of equipment.
4. Our office, in conjunction with the Department of Community Development, are requesting in
newly platted subdivisions, fire hydrant makers be installed in the street pavement perpendicular
to the fire hydrant. This will allow the fire department to more easily spot fire hydrants during an
emergency.
