Based on the data submitted and the provisions in Section 1 of 326 lAC 2-1, it has been determined that said crushed stone processing plant, to be located at 4700 East 96th Street in Indianapolis, Indiana 46240, has met the criteria required to obtain a Source Specific Operating Agreement. Pursuant to IC 4-21.5-3-5(a) and (b), approval of this Source Specific Operating Agreement shall not be effective until fifteen (15) days from the date of this letter. The facilities and processes of this source shall be granted the Source Specific Operating Agreement provided that: 1. The following requirements of 326 lAC 2-9 are satisfied: a. That the particulate matter (PM) emissions from this source do not exceed one hundred (100) tons per year, excluding fugitive emissions. b. That the source annual throughput shall be less than three million (3,000,000) tons per year. c. That the crushed stone processing operation shall have no more than nine (9) crushers, seventeen (17) screens, or one (1) conveying operation. d. That the owner or operator shall prepare and maintain records of the source for the past twelve (12) months, based on a monthly rolling average. These records shall be maintained for a minimum period of five (5) years, and made available, upon request, to the Office of Air Management. e. That the crushing, screening, and conveying operations shall be equipped with dust collectors, unless a wet process or continuous wet suppression system is used to comply with conditions g and h of this oP.9rating agreement. f. That all equipment that generate particulate matter (PM) emissions, and any emission control devices, shall be operated and maintained at all times the plant is in operation, in such a manner, as to meet all of the requirements of this Source Specific Operating Agreement. .......... That the visible emissions from the screening and conveying operations shall not exceed an average of ten (10%) opacity in twenty-four (24) consecutive readings in a six (6) minute period. Compliance with this limitation shall be determined by 40 CFR 60, Appendix A, Method 9. h. That the visible emissions from the crushing operation shall not exceed an average of fifteen percent (15%) opacity in twenty-four (24) consecutive readings in a six (6) minute period. That the fugitive particulate matter (PM) emissions shall be controlled by applying water on storage piles and unpaved roadways on an as needed basis, such that the following visible emission conditions are met: i. the visible emissions from any storage pile shall not exceed twenty percent (20%) in twenty-four (24) consecutive readings in a six (6) minute period. This limitation shall not apply during periods when application of control measures are ineffective or unreasonable due to sustained high wind speeds. The opacity shall be determined using 40 CFR 60, Appendix A, Method 9, except that the opacity shall be observed at approximately four (4) feet from the surface at the point of maximum opacity. The observer shall stand approximately fifteen (15) feet from the plume and at approximately right angles to the plume. ii. the visible emissions from unpaved roadways shall not exceed an average instantaneous opacity of twenty percent (20%). Average instantaneous opacity shall be the average of twelve (12) instantaneous opacity readings, taken for four (4) vehicle passes, consisting of three (3) opacity readings for each vehicle pass. The three (3) opacity readings for each vehicle pass shall be taken as follows: aa. The first reading shall be taken at the time of emission generation. bb. The second reading shall be taken five (5) seconds later. cc. The third reading shall be taken five (5) seconds after the second reading, or ten (10) seconds after the first reading. The three (3) readings shall be taken at the point of mi:ucimuni opacity. The observer shall stand approximately fifteen (15) feet from the plume and at approximately right angles to the plume. Each reading shall be taken approximately four (4) feet above the surface of the unpaved roadway. j. That the source shall provide an annual notice to the commissioner, stating that the source is in operation, and certifying that its operations are in compliance with this Source Specific Operating Agreement. This report shall be submitted to: Compliance Data Section Office of Air Management 100 North Senate Avenue P.O. Box 6015 Indianapolis, IN 46206-6015 no later than January 30 of each year, in the format attached. k. That any exceedance of any requirement contained in this operating agreement shall be reported, in writing, within one (1) week of its occurrence. I. That the owner or operator shall pay an annual fee of eight hundred dollars ($800) to the Office of Air Management (OAM). That pursuant to 326 lAC 2~9 the owner or operator of the facilities and processes of this source shall comply with all applicable Indiana Administrative Code 326 state rules. 3. That pursuant to 40 CFR 60.670 - 60.676, Subpart 000, "Standards of Performance for Nonmetallic Mineral Processing Plants", arid 326 lAC 2-9, the owner or operator of the crushed stone processing plant shall: a. meet the particulate matter standards specified in 40 CFR 60.672, b. meet the monitoring requirements of 40 CFR 60.674, c. meet the testing requirements of 40 CFR 60.675, and d. keep records and submit reports pursuant to the requirements of 40 CFR 60.676. The owner or operator is hereby notified that this operating agreement does not relieve the permittee of the responsibility to comply with the provisions of any applicable New Source Performance Standards (NSPS), 40 CFR Part'SO; or National Emission Standards for Hazardous Air Pollutants (NESHAP), 40 CFR Part 61. Any change or modification which will alter operations in such a way that it will no longer comply with the applicable restrictions and conditions of this operating agreement, must obtain the appropriate approval from the Office of Air Management (OAM) under 326 lAC 2-1,326 lAC 2-2,326 lAC 2-3,326 lAC 2-7, and 326 lAC 2-8, before such change may occur. sinc.~7~. Please review them carefully to ensure your facility is in compliance with all applicable regulations. . At this time, a NPDES general permit identification number is being assigned to each facility that has submitted a NOI letter to comply with 327 lAC 15-12. Due to the fact that 327 lAC 15-12 is a permit by rule, you will NOT be receiving an actual permit. The general permit number will be used as an identification number and should be included on all correspondence submitted to IDEM in relation to this NPDES general permit. The NPDES general permit number which has been assigned to this facility is: ING490012 General permit rule.327 IAC 15-12 requires monthly reporting of several effluent parameters. Initially, reporting is to be recorded on the enclosed blank discharge monitoring report (DMR) forms and submitted to the Data Management Section of the Office of Water Management. In order to receive authorization to discharge beyond the date of expiration, the permittee shall submit such information and forms as required by the Indiana Department of Environmental Management no later than ninety (90) days prior to the date of expiration. Please note that any person who is adversely affected or aggrieved by this acceptance for coverage under the cited NPDES general permit rule may, within eighteen (18) days from the mailing date of this notification, appeal this acceptance by filing a written petition for administrative review with the Office of Environmental Adjudication, in accordance with IC 4-21.5-3-7. This petition constitutes a request for an adjudicatory hearing. The procedure for appeal'is outlined in more detail on the attached page. The purpose of this article is to establish NPDES general permit rules.for certain classes or categories of point source discharges by prescribing the policies. procedures, and technical criteria to operate and discharge under the requirements of a NPDES general permit rule. Compliance with all requirements of applicable general permit iules may obviate the need for an individual NPDES permit issued under 327"IAC 5. A facility can operate under an individual NPDES permit and one (I) or more applicable general permit rules. (4) "Notice of intent letter" or "NOl" means a written notification indicating a person's intention to comply with the terms of a specified general permit rule in lieu of applying for an individual NPDES permit and includes ihformation as required under 321 IAC 15-3 and the applicable general permit rule. (5) "Storm water" means water resulting from rain, melting or melted snow, hail. or sleet. (b) Sampling of internal wastestreams under subsection (a) (4) and the provisions of data under subsection (a) (5) .shall not be required by the commissioner unless: (1) such data are reasonably expected to facilitate the identification or quantification of pollutants which may be released to the environment from facilities operated by the person to whom the request is made. and the identification or quantification of such pollutants could not reasonably be made by the commissioner in the absence of the requested information: or (2) such data are necessary to properly control wastewater treatment processes. (a) The commissioner may regulate the following discharges under NPDES general permit rules:. (1) Point source discharges of storm Water associated with industrial activity as defined in 40 CFR 122.26(b)(14) as publlshed in the Federal Register on November 16, 1990. (2) Such other categories of point sources operating within the state that: (A) involve the same or substantially similar types of operations; (B) discharge the same types of wastes; (C) require the same effluent limitations or operating conditions; and (0) require the same or similar monitoring requirements. (b) The commissioner may detennine that an individual permit must be obtained under section 9 of this rule. Any person to whom this article applies may avoid compliance with this article by obtaining an individual NPDES permit. (c) Each general permit rule shall be applicable to persons meeting the criteria of subsection (a) existing within specific boundaries designated by the commissioner in accordance with the following: (1) A general permit rule boundaty shall correspond with existing geographic or political boundaries such as: (A) designated planning areas under the Federal Act; (B) regional sewer.districts or sewer authorities; , (C) city. county. or state political boundaries; (0) state highway systems; (E) standard metropolitan statistical areas; (F) urbanized areas as defined by the Bureau of Census according to the criteria in 39 FR 15202 (May 1, 1974); or (G) any other appropriate divisions or combinations of the boundaries in this subdivision which will encompass the sources sUbject to the general permit rule. (2) Any designation of any general permit' rule boundary is subject to reclassification by the commissioner: (A) upon revision of a general permit rule; (B) if individual NPDES permits have been issued to all persons in a category of point sources; or (C) as necessary to address water qualit;y problems effectively. (a) A general permit rule may regulate all designated categories of point sources for which a general permit rule exists, ~c~t: . (1) as provided under section 6 or 9 of this rule or the applicable gener3I permit rule; and (2) point source discharges meeting the applicability requirements of a general permit rule. who are already subject to individual NPDESpermits prior to the effective date of a general permit rule. (b) Persons excluded from general permit rule regulation solely because they have an existing individual NPDES pennit may request to be regulated under a general permit rule and may request that the individual NPDES permit be revoked or modified to remove the point source from the existing permit. Upon revocation or expiration of the individual NPDES permit, the general permit rule shall apply to such point source discharges regulated under this article. (c) A person that holds an individual NPDES permit may have discharges regulated under an applicable general permit rule if such dischar-ges are not addressed in the individual permit. A general permit rule is a permit-by-rule. Therefore, the statutory requirements for administrative agency rulemaking must be satisfied in the development of a general permit rule. (b) A Nor letter shall be submitted to the commissioner by the time specified under 327 IAC 15-3 or the time indicated in the applicable general permit rule, (c) The person responsible for the operation of the facility from which a point source discharge of pollutants and/or stann water occurs must submit a Nor letter. An individual NPDES permit issued under 327 IAC 5 is required for a discharge to a receiving stream identified as an outstanding state resource water, an ~ceptional use water, or an outstanding national resource water as defined under 327 IAC 2-1-2(3), 327 iAc 2-1-11 (b). or 327 IAC 2-1.5-4 or which would significantly lower the water quality, as defined under 327 IAC 5-2-11. 3(b)(1) of such a water downstream of the point source discharge. (b) A person who filed a NO! letter under this article and who subsequently was requested by the commissioner to file an application for an individual NPDES permit has one hundred twenty (120) days from the time of the request by the commissioner to file the application. (a) If a general permit rule is amended. all persons regulated by the affected general permit rule must be notified by first class mail of the amendment by the commissioner within sixty (60) days after the effective date of the amended rule. Those persons notified by the commissioner under this subsection shall: - (1) apply for an individual NPDES permit under 327 lAC 5-3 within one hundred twenty (120) days after the effective date of the amended rule; or (2) submit a NO! letter containing the information required in 327 lAC 15-3-2 and the amended rule within ninety (90) days after the effective date of the amended rule. (b) The commissioner may require any person either with an existing discharge subject to the requirements of this article or who is proposing a discharge that would otherwise be subject to the requirements of this article to apply for and obtain an individual NPDES permit if one (1) of the six (6) cases listed in this subsection occurs. Interested persons may petition the commissioner to take action under this subsection. Cases where individual NPDES pennits may be required include the following: (1) The applicable requirements contained in this article are not adequate to ensure compliance with: (A) water quality standards under 327 lAC 2-1 or 327 lAC 2-1.5; or (B) the provisions that implement water quality standards contained in 327 IAC 5. (2) The person is not in compliance with the terms and conditions of the general permit rule. (3) A change has occurred in the availability of demonstrated technology or practices for the control or abatement of pollutants from the point source. (4) Effluent limitations guidelines that are more stringent than the requirements in the general permit rule are subsequently promulgated for point sources regulated by the general permit rule. (5) A water quality management plan containing more stringent requirements applicable to such point source is approved. (6) Circumstances have changed since the activity regulated under this article began so that the discharger is no longer appropriately controlled under the general pennit rule, or either a temporary or permanent reduction or elimination of the authorized discharge is necessary. (c) If. under subsection (b). the commissioner requires an individual NPDES permit. pursuantto 327 IAC 5-3. the commissioner shall notify the person in writing that an individual NPDES permit application is required. This notice shall be issued pursuant to IC 4-21.5 and shall also include the following: ~ ;~ . (1) A brief statement of the reasons for this decision. (2) An application fonn. (3) A statement setting a time for the person to file the application. (4) A statement that on the effective date of the individual NPDES permit. the general permit rule. as it applies to the individual person. shall no longer apply. . The commissioner may grant additional time upon request of the applicant for completion of the application. (d) An operator. as defined in 327 IAC 15-5-4(7). of a storm water discharge that meets the applicability requirements of the general permit rule and is not covered by an existing individual NPDES permit. must submit an application under 40 CFR 122.26 as published in the Federal Register on November 16. 1990. and 327 IAC 5-3 if the operator seeks to cover the discharge under an individual permit. (e) On the effective date of an individual NPDES permit that is issued to a person regulated under this article. this article no longer applies to that person. (t) Persons With a discharge meeting all the applicability criteria of more than one (1) general permit rule shall comply with all applicable general permit rules.. (2) A person with a new facility to which this article applies must comply with all applicable requirements of this article including the submittal of the appropriate NOI letter. Standard Conditions for NPDES General Permit Rules 327 lAC 15-4-1 General conditions Authority: IC 13-1-3-4;IC 13-1-3-7; IC 13-7-7; Ie 13-7-10-1 Affected: IC 13-1-3; IC 13-1-6; IC 13-7-13-3 Sec. 1. (a) The conditions in this section apply to all NPDES general permit rules. (b) Any violation of this article constitutes a violation of the Federal Act and the Indiana Environmental Management Act and is grounds for enforcement action and/or requirement to obtain an individual NPDES permit. (c) Under the Indiana Environmental Management Act at IC 13-7-13-3. any person who violates "any rule or standard adopted by one (1) of the boards" is subject to a civil penalty not to exceed twenty-five thousand dollars ($25.000) per day of such violation. Any person who willfully or negligently violates "any rule or standard adopted by one (1) of the boards. is subject to a fine of not less than two thousand five hundred dollars ($2.500) nor more than twenty-five thousand dollars ($25.000) per day of violation. or by imprisonment for not more than one (1). year. or both. If the conviction is for a violation committed after a first conviction of such person under this subsection. punishment shall be a fine of not more than fifty thousand dollars ($50.000) per day of violation. or by imprisonment for not more than two (2) years. or both. Except as provided in applicable general permit rule conditions on bypassing under section 2(c) of this rule. and upsets under section 2(d) of this rule. nothing in this article shall be construed to relieve persons in violation of it from civil or crirnina1 penalties for noncompliance. (d) Persons in violation of this article shall take all reasonable steps to minimize or correct any adverse impact on the environment resulting from their noncompliance. (e) Persons regulated by this article shall.furnish to the commissioner. 'within a reasonable time. any information which the commissioner may request to determine whether cause exists for revoking and reapproving or terminating the approval to discharge under this article or to determine compliance with this article. Those persons shall also furnish to the commissioner. upon request. . copies of records required to be kept by this article. . (f) Notwithstanding the provisions of 327 IAC 15-2-9. if a toxic effluent standard. prohibition. or sediment. wet weather, or biological criteria (including any schedule of compliance specified in such effluent standard or prohibition) is established under the Federal Act for a toxic pollutant which is present in the discharge and such standard or prohibition is more stringent than any limitation for such pollutant in an applicable general permit rule. the rule shall be modified to conform to the toxic effluent standard or prohibi!i9n. The person shall comply with effluent standards or prohibitions established under the Federal Act for toxic pollutants injurious to human health within the time provided in the regulations that establish those staDdards or prohibitions. even if the rule has not yet been modified to incorporate the requirement. (g) When cyanide or cyanogen compounds are used in any of the processes at a facility regulated under this article. the person responsible for that facility shall provide approved facilities for the containment of any losses of these compounds in accordance with the requirements under 327 IAC 2-2-1. (h) Persons regulated by this article shall have all wastewater treatment facilities. if any, under the direct supervision of an operator certified by the commissioner as required under IC 13-1-6 and 327 IAC 8-12. (i) Nothing in this article shall be construed to relieve anyone from any responsibility. liability. or penaltY to which they are or may be subject to under the Federal Act. G> The applicability of this article does not convey any property rights of any sort or any exclusive privileges. (k) The provisions of this article are severable and. if any provision of this article or the application of any provision of this article to any circumstance is held invalid. the application of such provision to other circumstances and the remainder of this article shall not be affected thereby. (1) Persons regulated by this article shall allow the commissioner. or an authorized representative, (including an authorized contractor or representative of another governmental agency acting as a representative on behalf of the commissioner), at reasonable times. and in a manner to minimize disruption of the business. upon the presentation of credentials and such other documents as may be required by law. to: (1) enter upon the premises where a regulated facility or activity is located or conducted. or where records must be kept under the conditions of this article; (2) have access to and copy. at reasonable times. any records that must be kept under the conditions of this article; (3) inspect, at reasonable times. any facilities. equipment (including monitoring and control equipment) . practices. or operations regulated or required under this article; and (4) sample or monitor, at reasonable times, for the purposes of assuring compliance with the applicable general permit rule conditions or as otherwise authorized by the Federal Act, any substances or parameters at any location. (m) Persons regulated by this article shall not construct. install. or modify any water pollution control facility without a valid construction permit issued by the Indiana department of environmental management under 327 IAC 3-2. (a) Persons regulated by this article shall, at all times, maintainin good working order and efficiently operate all facilities and systems (and related appurtenances) for collection and treatment which are installed or used by the person and which are necessary for achieving compliance with the terms and conditions of this article. (b) The following definitions, with regard to bypaSs of treatment facilities, apply throughout this. rule: ' (1) nBypass" means the intentional diversion of a wastestream from any portion of a treatment facility normally utilized for treatment of the wastestream. (2) "Severe property damage" means substantial physical damage to property, damage to the treatment facilities which would cause them to become inoperable, or substantial and permanent loss of natural resources which can reasonably be expected to occur in the absence of a bypass. Severe property damage does not mean economic loss caused by delays in production at the facility. (c) Bypass which causes. or is likely to cause, applicable effluent limitations to be exceeded is prohibited unless the following conditions iiii met: . (1) Bypass is unavoidable to prevent loss of life, perSonal injury, or severe property damage. (2) There are no feasible alternatives to bypass. such as the use of auxiliary treatment facilities, retention of untreated wastes, or maintenance during nonnal period of equipment downtime. (3) The person submits notice of an unanticipated bypass to the commissioner within twenty-four (24) hours of becoming aware of the bypass. (If this infonnation is provided orally. a written submission must be provided within five (5) days.) Where the person knows. or should have known. in advance of the need for a bypass. this prior notification shall be submitted for approval to the commissioner. if possible, at least ten (10) days before the date of the bypass. An anticipated bypass which meets the criteria under this subsection may be allowed under conditions determined to be necessary by the commissioner to minimize any adverse effects. (d) With regard to upset conditions. as used in this rule. nupsetn means an exceptional incident in which there is unintentional and temporary noncompliance with the requirements of the applicable general permit rule because of factors beyond the reasonable control of the responsible person. An upset does not include noncompliance to the extent caused by any of the following: (1) Operational error. (2) Improperly designed treatment facilities. (3) Inadequate treatment facilities. (4) Lack of preventive maintenance. (5) Careless or improper operation. (e) An upset shall constitute an affirmative defense to an action brought for noncompliance with such effluent limitations if the requirements under subsection (d) are met. (f) A person regulated under this article who wishes to establish the affinnative defense of upset shall demonstrate. through properly signed. contemporaneous operating logs or other relevant evidence, the following: (1) An upset occurred and the regulated person has identified the specific cause of the upset. if possible. (2) The facility was. at the time being operated. in compliance with proper operation and maintenance procedures. (3) The regulated person complied with any remedial measures required under section 1 (d) of this rule. (g) Solids. sludges. filter backwash, or other pollutants removed from or resulting from treatment or control of waters shall be disposed of in a manner such as to prevent any pollutant from such materials from entering navigable waters and to be in compliance with all Indiana statutes and rules relative to liquid and/or solid waste disposal. Sec. 3. (a) Any change in the information submitted in the NO! letter should be reported as soon as practicable to the commissioner. Changes which are reasonably expected to alter the characteristics "of the discharge regulated "under a general permit {ule must be reported prior to the change. Following such notice. the commissioner may request the person to submit an application for an individual NPDES permit. (b) Monitoting results shall be reported at the intervals and in the form specified in the appropriate general permit rule. (c) The following are requirements for twenty-four (24) hour reporting: (1) Persons regulated by this article shall orally report information to the office of enforcement at (317). 232-8603 on the following types of noncompliance within one (1) business day from the time the person becomes aware of such noncompliance: (A) Any unanticipated bypass which exceeds any effluent limitation in the applicable general"pennit rule. (B) Violation of a maximum daily discharge limitation for any of the pollutants listed by the commissioner in the rule to be reported within one (1) business day. (C) Any noncompliance which may pose a significant danger to human health or the environment. (2) A written submission shall also be provided to the office of enforcement within five (5) business days of the time the person becomes-aware of the circumstances. The written submission shall contain the following: (A) A description of the noncompliance and its cause. (B) The period of noncompliance. including exact dates and times, and. if"the noncompliance has not been corrected, the anticipated time it is expected to continue. (C) Steps taken or planned to reduce and eliminate the noncompliance and prevent its recurrence. The commissioner may waive the written report on a case-by-case basis if the oral report has been received within one (1) business day. (d) Persons regulated under this article shall report any instance of noncompliance not reported under subsection (c) at the time the pertinent discharge monitoring report is submitted. The report shall contain the information specified under subsection (c) (2). (e) Where the person becomes aware that he failed to submit any relevant facts, or submitted incorrect information in a NO! letter, or in any report to the commissioner. the person shall promptly submit such facts or corrected information. (t) Persons regulated under this article shall notify the commissioner as soon as they know. or have reason to believe. the following: (1) That any activity has occurred. or will occur. which would result in the discharge of any pollutant identified as toxic. under the Federal Act which is not limited in the applicable general permit rule. if that discharge will exceed the highest of the following notification levels: (A) One hundred (100) micrograms per liter. (B) Two hundred (200) micrograms per liter for acrolein and acrylonitrile: five hundred (500) micrograms per liter for 2.4- dinitrophenol and 2-methyl-4.6-dinitrophenol: and one (1) milligram per liter for antimony. (C) A level established elsewhere in the rule by the commissioner. (2) That it has begun. or expects to begin. to use or manufacture as an intermediate or final product or byproduct any toxic pollutant which was not reported in the NO! letter. (g) Signatory requirements shall be as follows~ (1) All reports required by this article and other Information requested by the commissioner shall be signed by a person described as follows. or by a duly authorized representative of that person: (A) For a corporation. by a responsible corporate officer. As used in this section, "responsible corporate officer" means: (i) a president, secretary, treasurer. any vice president of the corpOration in charge of a principal business function. or any other person who performs similar policy or decision making functions" for the corporation: or (ll) the manager of one (1) or more manufacturing. production, or operating facilities employing more than two hundred fifty (250) persons or having gross annual sales or expenditures exceeding twenty-five million dollars ($25,000.000) (in second quarter 1980 dollars). if authority to sign documents has been assigned or delegated to the manager in accordance with corporate procedures. (B) For a partnership or sole proprietorship. by a general partner or the proprietor. respectively. (C) For a municipality. state, federal, or other public agency or political subdivision thereof. by either a principal executive ,"-..; , , officer or ranking elected officiaL (2) A person is a duly authorized representative only if: (A) tllEi authorization is made in writing by a person described under subdivision .(1); (B) the authorization specifies either an individual or a position having responsibility for the overall operation of the regulated facility or activity. such as the position of plant manager, operator of a well or a well field. superintendent. or position of equivalent responsibility (a duly authorized representative may thus b~ either a named individual or any individual occupying a named position); and (C) the written authorization is submitted to the commissioner. (3) Any person signing a document under this section shall make the following certification: "I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted.. BaSed on my inquiry of the person or persons who manage the system, or those persons directly responsible for gathering the information. the information submitted is, to the best of my knowledge and belief. true. accurate. and complete. I am aware that there are significant penalties for submitting false information. including the possibility of fine and imprisonment for knowing violations. " . (h) Except for data determined to be confidential under 321 IAC 12. all reports prepared in accordance with the tel1llS of the applicable general permit rule shall be available for public inspection at the offices of the Indiana department of environmental management and the U.S. Environmental Protection Agency Regional Administrator. As required by the Federal Act. information contained in the NO! letter and effluent data shall not be considered confidential. (i) The Indiana Environmental Management Act at IC 13-7 -13-3(b) provides that any person who knowingly makes any false statement, representation, or certification in any record or other document submitted or required to be maintained under the applicable general permit rule. including monitoring reports or reports of compliance or noncompliance. shall.. upon conviction. be punished by a fine of not more than ten thousand dollars ($10.000) per violation. or by imprisonment for not more than six (6) months per violation. or by both. This mont.hly publication shall be issued by IDEM on the 1ifteenrh day of every month and shall identitY all facilities which met both the NOt and newspaper publication requiremc:nts in the preceding month. (2) For each mcasun::maIt or sample taken pursuant 10 the requirements of this rule. the facility shall record the following inbmation: (A) The exact place. date. and time of sampling. (8) The pcrson(s) who performed the sampling or measurements. (C) The dates the analyses were performed. (0) The person(s) who performed the analyses. (E) The analytical techniques or mctbods used. (F) The results of all required analyses and measurements. (3) Monitoring of any pollutant at the loca1ion(s) identified in the NOI letter more frcquendy than required under this rule. using approved analytical methods. the results of such monitoring shall be included in the calculation and reporting of the values requin:d in the monthly discharge monitoring report Such increased frequency shall also be indicated in this report. (4) All records and information resulting from the monitoring activities required under this rule. including all records of analyses pcrtOrmcd and calibration and maintenance of instrumenration and recording from continuous monitoring insl:rumenta!ion. sbaU be terained for a minimum ofthrce (3) years. When the original records are kept at another location. a copy of all such records sball be kept at the facility. The proposed channel reconstruction will start about 210 feet upstream of Hazel Dell Parkway and will be located along the west and north boundaries of the project, which is north of the existing creek..A 24-inch diameter reinforced concrete pipe approximately 150 feet long will be installed with a headwall and tlapgate to serve as an outfall structure for interior drainage from the abandQned portion of Blue Woods Creek after channel relocation. The new channel bottom width will be approximately 55 feet wide, with 3:1 side slopes. The existing tree line will remain on the south and west sides of the relocated stream and will be augmented with trees in less dense areas. A wooded riparian buffer ranging from 30-feet Wide to 10-feet wide will be planted on 10-foot centers within roughly 1.4 acres. The Hamilton County Drainage Board agrees to reduce its easement right-of-way to 30 feet, which includes a twelve-foot wide horizontal access berm. Martin Marietta agrees to maintain the ditch and restore to plan grade any erosion that may occur. Your project information may be forwarded to the IDEM Office of Land Quality, Industrial Waste Section for review. Sampling may be required to determine if the dredged sediment is contaminated. Failure to properly dispose of contaminated sediment may result in enforcement action against you. 2. Install erosion control methods prior to any soil disturbance to prevent. soil from leaving the construction site. Appropriate erosion control methods include, but are not limited to, straw bale barriers, silt fencing, erosion control blankets, phased construction sequencing, and earthen berms. Monitor and maintain erosion control structures and devices regularly, especially after rain events, until all soils disturbed by construction activities have been permanently stabilized. 3. Clearly mark the construction limits shown in the attached plans at the project site during construction. 4. Allow the commissioner or an authorized representative of the commissioner (including an authorized contractor), upon the presentation of credentials: A) to enter upon the recipient of the certification's property; B) to have access to and copy at reasonable times any records that must be kept under the conditions of this certification; C) to inspect, at reasonable times, any monitoring or operational equipment or method; collection, treatment, pollution management or discharge facility or device; practices required by this certification; and D) to sample or monitor any discharge of pollutants or any mitigation site. PROJECT SPECIFIC CONDITIONS: The recipient of the certification shall: 1. Sequence construction so that the new channel is excavated and stabilized with fabric and herbaceous cover prior to releasing the stream flow. 2 of 6 062101a .' , .' , , . 2. Re-Iocate the channel according to the Blue Woods Creek Relocation Plans. Project No. WOO-0285, received in this office on July 29, 2002, by constructing a 2,650 linear feet channel approximately five (5) feet deep by 55-feet wide (bottom depth), containing banks with a 3:1 slope. Install a ten (10) feetwide low profile channel that is six (6) inches deep within the stream bottom. 3. Install a sediment trap at the tie-in location that is between twelve (12) to fifteen (15) feet wide by 30-feet long by two (2) feet deep, that will serve to catch first flush erosion after the creek is connected, and which will not be dredged or maintained. 4. Implement the re-vegetation plan as described in the Blue Woods Creek Relocation Riparian Planting Scheme. Job No. 011015. dated July 2002, and received in this office on July 29, 2002, within one year of the effective date of this certification, unless IDEM grants a written extension upon request. 5. Upon completion of construction activities, submit a post construction plan to this office showing final grade, riprap quantities and locations, planting locations, and tree/seed description. 6. Provide this office with a copy of the Hamilton County Drainage Board maintenance agreement with Martin Marietta, which indicates that the riparian buffer will not be cut or sprayed. 7. Monitor the relocated creek annually to determine whether it is achieving the success criteria contained in Project Specific Condition 10 of this certification and complete corrective actions as are necessary to ensure the relocated creek will achieve the success within the required period. These corrective actions may include additional grading, plantings, or relocation of stream segments, along with extended monitoring. Describe in the monitoring reports any corrective actions taken to ensure success of the relocated creek. 8, Submit annual monitoring reports of the relocated creek to this office by December 31 of each year until released from monitoring by this office. These reports shall contain information concerning what steps the recipient of the certification has taken to create the relocated creek and whether it is achieving each of the success criteria outlined in Project Specific Condition 10. The reports shall include the following: a. The IDEM identification number. b. As-built plans (in the first year's report). c. Discussion of stream hydrology in the relocated creek. d. Discussion of riparian plant community development. e. Discussion of methods. or means used to determine compliance with the success criteria. f. Photographs of the relocated creek and riparian revegetation and sampling points. g. Identification of any problems with meeting the success criteria. 3 of 6 062101a h. Recommendations for correcting any problems identified. 9. Monitor the relocated creek for a minimum period of three (3) years. In order to be released from monitoring, the recipient of the certification must demonstrate to IDEM, through its monitoring reports, that the success criteria specified in Project Specific Condition 10 have been met for two consecutive years within a five year period. Once the recipient of the certification believes it has met this requirement, it may submit its proposed final monitoring report to IDEM and suspend monitoring unless notified otherwise by IDEM. If IDEM determines that the success criteria have not been met, then the recipient of the certification shall resume monitoring. If IDEM confirms that the success criteria have been met, then the recipient of the certification may permanently discontinue monitoring after it receives written notification of this determination from IDEM. 10. Ensure that the relocated creek meets all of the following success criteria for two consecutive years within five (5) years of the -creation of the wetland: a. No length of restored channel will show signs of bank instability. b. No area above the ordinary high water mark shall be devoid of vegetation, except rock stabilized areas. c. After three years, planted trees will achieve a minimum survival rate of 75%. d. The channel and riparian buffer are free of the following exotic species: Lythrum sa/icaria (purple loosestrife), Phragmites austra/is (common reed), and Myriophyllum spicatum (water milfoil). 11. A modification of this Section 40 1 Water Quality Certification is required from this office if substantive changes are needed for project construction. This granting of Section 40 1 Water Quality Certification does not relieve the recipient of the certification from the responsibility of obtaining any other permits or authorizations that may be required for this project or related activities from IDEM or any other agency or person. You may wish to contact the Indiana Department of Natural Resources at 317-232-4161 concerning the possible requirement of natural freshwater lake or floodway permits, or the IDEM stormwater permits section at 317-232-8648 concerning the possible need for 327 lAC 15-5 (Rule 5) permits if you plan to disturb greater than 5 acres of soil during construction. This certification does not: (1) authorize impacts or activities outside the scope of this certification; (2) authorize any injury to persons or private property or invasion of other private rights, or any infringement of federal, state or local laws or regulations; (3) convey any property rights of any sort, or any exclusive privileges; (4) preempt any duty to obtain federal, state or local permits or authorizations required by law for the execution of the project or related activities; or (5) authorize changes in the plan design detailed in the application. 40f 6 062101a '- , " '''- , . I Failure to comply with the terms and conditions of this Section 401 Water Quality Certification may result in enforcement action against the recipient of the certification. If an enforcement action is pursued, the recipient of the certification could be assessed up to $25,000 per day in civil penalties. The recipient of the certification may also be subject to criminal liability if it is determined that the Section 401 Water Quality Certification was violated willfully or negligently. This certification is effective 18 days from the mailing of this notice unless a petition for review and a petition for stay of effectiveness are filed within this 18-day period. If a petition for review and a petition for stay of effectiveness are filed within this period, any part of the certification within the scope of the petition for stay is stayed for 15 days, unless or until an Environmental Law Judge further stays the certification in whole or in part. This decision may be appealed in accordance with IC 4-21.5, the Administrative Orders and Procedures Act. The steps that must be followed to qualify for review are: I. The proposed channel would be located north of the existing creek. The existing channel will be blocked off with 25 cubic yards (cys) of fill material on the west and 40 cys on the east. The proposal would also include the installation of 150 feet of 24-inch RCP w/headwall & flapgate that would serve as an outfall structure for any interior overland drainage from the abandoned portion of the creek after channel relocation is complete. The proposed project is south of 106th Street, west of Hazel Dell Parkway and east of Gray Road in Carmel, Hamilton County, Indiana. Under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act (CWA), the Louisville and Detroit Districts issued Regional General Permit (RGP) No. 1 on December 15, 2004, for certain activities having minimal impact in Indiana. We have verified that your proposed work shown on the enclosed plans and described below is authorized under the RGP. Therefore, you may proceed with the work subject to the enclosed general conditions, the Indiana Department of Environmental Management (IDEM) Section 401 Water Quality Certification (WQC) dated August 27, 2002, and any noted special conditions. It was noted that this WQC has been extended for twelve (12) months from the date of their letter of January 21, 2005 (see enclosed). The following work is authorized: placement of fill mat~rial and installation of an outfall structure in connection with the relocation of Blue Woods Creek. Special Condition: a. Submit a copy of annual monitoring reports of the relocated creek to this office by December 31 of each year. Discharges of dredged or fill material into waters of the United States must be minimized or avoided to the maximum extent practicable at the project site (i.e. on-site). The permittee shall provide a mitigation/monitoring plan for any activity where the adverse impact on special aquatic sites exceeds 0.10 acre (4,356 sq. ft.) or is determined to be more than minimal impact. In determining the minimal impact threshold, the Districts will consider the direct and secondary impacts ofthe fill or work and any mitigation measures. A wetland delineation report is also required. NOTE: An important element of any mitigation plan for projects in or near streams, other open waters and wetlands is the requirement for vegetated buffers. Therefore, all mitigation plans should include a minimum 50- foot wide buffer between the edge of the project site and the waters and/or ~etlands to be affected unless a lesser distance has been specifically approved under the RGP. 2. The permittee shall, if mitigation is required, develop the mitigation site concurrently with site construction. This will assure that aquatic functions are not lost for long periods oftime which could adversely affect water quality and wildlife. 3. The permittee shall ensure that sedimentation and soil erosion control measures are in place prior to any construction activity. This shall include the installation of straw bale barriers, silt fencing and/or other approved methods to control sedimentation and erosion. 4. The permittee shall ensure that areas disturbed by any construction activity, including channel banks, are immediately stabilized and revegetated with a combination of grasses, legumes and shrubs compatible to the affected area. 5. The permittee shall ensure that all in-stream construction activity is not performed during periods of high stream flow or during the fish spawning season between April 1 through June 30 without first contacting the IDNR, Division ofFish and Wildlife for their expertise on impacts to the fishery resource. Additionally, the discharge of dredged and/or fill material in known waterfowl breeding areas must be avoided to the maximum extent practicable. 6. The permittee will ensure that the activity authorized will not disrupt movement of those aquatic species indigenous to the waterbody, including those species which normally migrate through the area unless the activity's specific purpose is to impound water. 7. The permittee shall ensure that all construction equipment is refueled and maintained on an upland site away from existing streams, drainageways and wetland areas. Heavy equipment working in wetlands must be placed on mats, or other measures taken to minimize soil disturbance. 8. The permittee must provide a copy of the site specific State Section 401 WQC before the Corps will authorize a project under the RGP. 9. The permittee must comply with any case specific special conditions added by the Corps or by the State Section 401 WQC. The conditions imposed in the State Section 401 WQC are also conditions of this RGP. 10. The permittee shall assure that no activity authorized by the RGP may cause more than a minimal adverse effect on navigation. 11. The permittee shall ensure proper maintenance of any structure or fill authorized by this RGP, including maintenance to ensure public safety. 12. The permittee shall not perform any work within any Wild and Scenic Rivers or in any river officially designated as a "study river" for possible inclusion in the system, unless the appropriate Federal agency, with direct management responsibility for such river, has determined in writing that the proposed activity authorized by the RGP will not adversely affect the Wild and Scenic River designation or study status. Information on Wild and Scenic Rivers may be obtained from the appropriate Federal Land Management agency in the area (e.g. U.S. Forest Service, Bureau of Land Management or the U.S. Fish and Wildlife Service). 13. The permittee shall not perform any work under the RGP which is likely to jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species Act, or which is likely to destroy or adversely modify the critical habitat of such species. The permittee shall notify the District Engineer if any listed species or critical habitat might be affected or is in the vicinity of the project, and shall not begin work under the RGP until notified by the District Engineer that the requirements of the Endangered Species Act have been satisfied and that the activity is authorized. Authorization of an activity under the RGP does not authorize the "take" of a threatened or endangered species as defined under the """=-- O::::;::-~ Federal Endangered Species Act. In the absence of separate authorization (e.g., an ESA Section 10 Permit, a Biological Opinion with "incidental take" provisions, etc.) from the U.S. Fish and Wildlife Service or the National Marine Fisheries Service, both lethal and non-lethal "takes" of protected species are in violation of the Endangered Species Act. 14. The permittee shaH not perform any activity under the RGP which may affect historic properties listed, or eligible for listing, in the National Register of Historic Places until the District Engineer has complied with the provisions of33 CFR Part 325, Appendix C. The permittee must notiry the District Engineer if the activity authorized by theRGP may affect any historic properties listed, determined to be eligible or which the permittee has reason to believe may be eligible for listing on the National Register of Historic Places, and shaH not begin construction until notified by the District Engineer that the requirements of the National Historic Preservation Act have been satisfied and that the activity is authorized. Information on the location and existence of historic resources can be obtained from the Indiana Department of Natural Resources, Division of Historic Preservation and Archaeology. If the permittee discovers any previously unknown historic or archaeological remains while accomplishing the activity authorized by the RGP, work must be immediately stopped and this office immediately notified of what you have found. The District will initiate the Federal, tribal and State coordination required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register of Historic Places. 15. The permittee shall not perform any work under the RGP where the discharge of dredged and/or fill material would occur in the proximity of a public water supply intake except where the activity is for the repair of the public water supply structure or adjacent bank stabilization. 16. No activity, including structures and work in navigable waters of the United States or discharges of dredged or filII material may consist of unsuitable materials (e.g. trash, debris, car bodies, asphalt, etc.) and that materials used for construction or discharge must be free from toxic pollutants in toxic amounts. 17. The permittee shall, to the maximum extent practicable, design the project to maintain pre-construction downstream flow conditions. Furthermore, the work must not permanently restrict or impede the passage of normal or expected high flows (unless the primary purpose is to impound water) and that the structure or discharge offiH must withstand expected high flows. The project must provide, to the maximum extent practicable, for retaining excess flows from the site and for establishing flow rates from the site similar to pre-construction conditions. 18. The permittee shall ensure that if the activity approved by the RGP includes impoundment of water, measures will be taken to minimize adverse effects on the aquatic ecosystem caused by the accelerated passage of water and/or the restriction of flow. 19. The permittee shall ensure that all temporary fills, authorized under the RGP, be removed in their entirety and the affected areas returned to pre-construction elevation. 20. Representatives from the Corps of Engineers and/or IDEM may inspect any authorized activity or mitigation site at any time deemed necessary to ensure compliance with the terms and conditions of the RGP, Section 401 WQC; and applicable laws. 21. All work authorized by this RGP must be completed by the expiration date of this RGP or 1 year after the date of the Corps authorization letter, whichever occurs later. If you find you need more time to complete the authorized activity, submit your request for a time extension to this office for consideration at least 3 months before the expiration date. 22. A 24-inch diameter reinforced' concrete pipe approximately' 150 feet long will be installed with a headwall and flapgate to serve as an outfallstmcture for interior drainage from the' abandoned portion of Blue Woods Creek after channel relocation. The new channel bottom width.will be approximately 55 feet wide, with 3; 1 side slopes. The existing tree line will remain on the south and west sides of the relocated stream and will be augmented with trees in less dense areas. A wooded riparian 'buffer ranging from 30-feet Wide to 10-feet wide will be planted on IO..foot centers within roughly 1.4 acres. The Hamilton County Drainage Board agrees to reduce its easement right-of-way to 30 feet, which includes a twelve-foot wide horizontal access berm. Martin Marietta a,grees to maintain the ditch and restore to plan grade any erosion that may occur. The project site is located in Fishers' Quadrangle, "Section 9, Township 17 North, Range 4 East, in Hamilton County, Indiana. You must comply with all of the requirements of327 lAC 15-5 (Rule 5).
