We represent Martin Marietta Materials, Inc. in connection with a Special Use
Application ("Application") that it has filed to establish a sand and gravel operation on 96.9 acres
of property located at the southwest comer 106th Street and Hazel Dell Parkway. The
Application has been docketed as Case No. 04040024SU.
A hearing before the Carmel/Clay Board of Zoning Appeals has been set for this matter
for Monday, June 28, 2004 at 7:00 p.m. in the City Council Chambers, which is located on the
second floor of Carmel City Hall, One Civic Square, Carmel, Indiana 46032, as described on the
enclosed Notice of Public Hearing.

Notice is hereby given that the Carmel/Clay Board of Zoning Appeals meeting on the 28th day of June,
2004 at 7:00 pm in the City Council Chambers, 2nd floor of City Hall, 1 Civic Square, Carmel, Indiana 46032 will
hold a Public Hearing upon a Specia~ Use application to allow: Martin Marietta Materials. Inc. to establish a sand
and Qravel extraction operation on 9S.921:t acres located at the southwest corner of 10Sth Street and Hazel Dell
Parkway.

Part of the North Half of Section 9, Township 17 North, Range 4 East of the Second Principal
Meridian in Clay Township, Hamilton County, Indiana, described as follows:
Commencing at the Northwest comer of Section 9, Township 17 North, Range 4 East of the
Second Principal Meridian in Clay Township, Hamilton County, Indiana; thence South 89
degrees 55 minutes 56 seconds East (assumed bearing) on the North line of said Section 9, a
distance of 1,336.18 feet to the Northwest comer of the East Half of the Northwest Quarter of
said Section 9, said comer being the PLACE OF BEGINNING of the within described real
