Dear Ms. Wilson:
The City has received your development plans dated April 20, 2007 for the May 16,2007 TAC meeting as
well as the revised plans dated June 7, 2007. We offer the following comments:
GENERAL INFORMATION
1. These comments represent the Department of Engineering's first review of the development
plans for this project. It is the Departments understanding that more detailed construction
plans will be submitted in the future. The Department will not approve the current plans for
construction or earth disturbing activity.
2. The following comments shall be incorporated into more detailed construction drawings as
they are developed and considered as approval for such plans is pursued Revised plans and
response comments to this letter are not expected
3. We request that all responses to our future comments be provided in writing and be
accompanied by drawings reflecting the requested revisions. Failure to provide written
responses may result in the delay of the review process.
4. It is critical that this office be made aware of all modifications made on the plans being re-
submitted, particularly if any such changes are considered ''new'' or fall outside of our
previous reviews. Please notify us of any changes and specifically state any changes,
including changes resulting from Plan Commission, BZA or other committee meetings.
5. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide a set of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
6. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Board of Public Works and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All off-site easements necessary to install utilities to serve the development are secured.
e. Any required fees are paid in full.
f. Required digital files have been submitted.
7. The Department reserves the right to provide additional comments based upon subsequent
reviews as more detailed information is submitted.
8. An approved Storm Water Management Permit is required prior to commencing any earth
disturbing activity.
9. An approved right-of-way permit is required prior to commencing any work in the public
right-of-way.

10. Ifit will be necessary to relocate existing utilities or other infrastructure, the costs for such
relocations are to be borne solely by the developer. Any utility poles required to be relocated
within the right-of-way shall be relocated to within one foot of the proposed right-of-way.
11. Compliance with the Thoroughfare Plan includes construction of the improvements
prescribed by the Thoroughfare Plan across the frontage controlled by the development
(including sections with no access). Typically, developers provide a commitment equal to the
value to construct these improvements for deposit into the City's non-reverting thoroughfare
fund. These requirements would be applicable to the 131 It Street frontage and the proposed
roundabout at 131 It Street and Pennsylvania Street. Credit is typically given towards this
commitment for any widening, milling and resurfacing of the perimeter streets along the
frontage controlled by the petitioner or any other work requested by the City that is outside of
the frontage controlled by the petitioner.
12. The Department requires that the construction drawings be developed in accordance with the
City of Carmel digital submission standards and that all required submittals for primary plat,
secondary plat, and construction drawings be made. The digital files must be submitted to
the Department of Engineering prior to the approval of the construction plans. Please contact
the City GIS Department for the requirements.
13. Jurisdictions:
a. The project site is located within current City of Carmel Corporate Limits.
b. Streets and Right of Way - City of Carmel (131 st Street, Pennsylvania Street), INOOT
(U.S. 31)
c. Water - City of Carmel Utilities
d. Sanitary Sewers - City of Carmel Utilities
e. Storm SewerslDrainage - City of Carmel.
f. Legal Drains - Hamilton County Surveyor's Office.
14. Drawings submitted for approval:
a. The design engineer must certify all drawings submitted for final approval.
b. This office will require a minimum of 5-sets of drawings for approval after all issues
have been resolved. The drawings will be stamped as approved and signed by the City
Engineer and by Carmel Utilities. The Owner will receive I-set which must be
maintained on the construction site at all times. If additional approved sets are desired,
we will approve a maximum of2-additional sets. However, the additional sets must be
submitted with the required minimum 5-sets.
15. Carmel Utilities will provide separate reviews of this project for water and sanitary sewer
issues. Please assure that copies of all drawings are sent to:

BOARD OF PUBLIC WORKS AND SAFETY
18. I am enclosing a schedule for Board of Public Works and Safety meeting dates and agenda
deadlines for your use. Please use the Engineering Department deadlines for submissions to
the Board.
19. Any submission to the Board requires prior approval by the Carmel Clay Plan
Commission anellor the Board of Zoning Appeals (if applicable) and completion of
review by the Technical Advisory Committee. All written requests to be placed on the
Board's agenda must include the appropriate Docket Number and the date (or dates) of
approval by the Plan Commission anellor the Board of Zoning Appeals (if applicable).
20. Water and Sewer Availability (BDU) approval from the Board is based upon the usage of the
proposed buildings within the development. Reference item #35-38 below for a more
detailed explanation. If an irrigation system is planned for this development, approval for
additional Water Availability (and Sanitary Sewer if applicable) must be obtained from the
Board.
21. Commercial Curb Cut Approval- It appears that there is at least on curb cut on 131 II Street.
Is the curb cut indicated on the east side of the church to be constructed as part of this
development? If so, it will require Board approval. This approval will require a written
request from the developer or the developer's engineer. The request must include 8~ x II
exhIbits of the curb cut or cuts with all pertinent data included such as radii, width, opposing
existing curb cuts, etc.
22. Temporary Construction Entrance approval if the location is at a site other than the location
of the proposed permanent entrance to the development.
23. The installation of any permanent, privately owned and/or maintained improvement (signs,
decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated
easements requires the execution of a Consent to Encroach Agreement between the Owner
and the City of Carmel. Such agreements are executed by the Board of Public Works and
Safety. The City Engineer may approve irrigation system agreements.
24. Secondary Plat approval if applicable. All performance guarantees must be posted prior to
submission of secondary plats for Board of Public Works and Safety approval.
25. Dedication of Right of Way ifnot platted. Appropriate dedication documents are available
upon request.
26. Any open pavement cuts of 131 II Street or Pennsylvania Street. Are open cuts necessary for
the water and sewer main extensions?
BONDING REOUlREMENTS
27. Upon initial review, it appears performance guarantees shall be provided for the following:
a. 131 II Street & Pennsylvania Street Right of Way Improvements. . This could include
acceleration/deceleration lanes, passing blister, pavement widening, thermoplastic
striping, stone shoulders, curbs, etc.
b. Water Mains
c. Sanitary Sewers
d. Exterior Sidewalks (perimeter road right of way sidewalks/asphalt paths).
e. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley,
Engineering Department Stormwater Administrator, for details regarding engineer's
estimates/performance guarantee requirements for these items.
28. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for
100% of the cost of labor and materials to construct the individual improvements, to be
provided by the design engineer. Please provide detailed Engineer's Estimates for each
improvement including quantities, unit costs, pipe sizes and materials, etc.
29. Upon completion and release of individual Performance Guarantees, a three-year
Maintenance Guarantee will be required (see Street Sign comments above). The

Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets
and Curbs and 10% of the Performance amount for all other improvements.
30. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of
Credit.
31. Please reference the enclosures for more detailed explanation of our procedures.
RIGHT OF WAY PERMIT AND BONDING
32. Any work in the dedicated right of way of 131st Street or Pennsylvania Street will require an
approved Right of Way Permit and a License & Permit Bond.
33. The bond amount is determined by the number of instances of work in the right of way at
$2,000.00 per instance. However, if the work is included in the scope of work ofa required
and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the
bond requirements of the Right of Way Permit.
34. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting
and bonding.
AVAILABILITY AND CONNECTION FEES
35. The Availability and Connections Fees are current as of this date but are subject to future
revisions.
36. Availability (acreage) Fees must be paid after all other Engineering Oeparbnent requirements
have been satistied and prior to approval and start of construction activities. Availability Fees
are based upon total platted acreage or legal description acreage for the development at the
current rate of$I,OIO.OO per acre for Water Availability and $1,365.00 per acre for Sanitary
Sewers.
37. Connection Fees are paid with individual buildings after the infrastructure has been
completed, satisfactory test results obtained and the development has been released for
building permits. Connection Fees are based upon the proposed tinal use of the building.
Reference our Utility Equivalent User Contribution Multiplier tables. A listing of proposed
building uses will eventually be required to determine the Water Availability request to the
Board of Public Works and Safety. This request is based upon edus and should not be
confused with Water Availability Fees, which are acreage based.
a. The current Water Connection Fee is $1,310.00 per EOU.
b. The current Sewer Connection Fee is $795.00 per EOU.
38. Ifan irrigation system is planned for this development, additional Water Availability Fees
and Water Connection Fees (and Sanitary Sewer Availability and Connection Fees if
applicable) will be assessed based upon the size and usage of the system and upon the
recommendations of the Oirector of Carmel Utilities.
DEVELOPMENT PLAN REVIEW COMMENTS
39. General Comments
a. Will a mass earthwork and master infrastructure package be developed? Will this set
address master erosion and sediment control and post construction BMP's? Will each lot
be responsible for its own storm water treatment or some aspect of the storm water
treatment system?
b. The plans (and all appropriate sheets) shall indicate the proposed Grand Boulevard
improvements. Please contact Karla Smith at American Structure Point to obtain digital
tiles. This project shall be designed to match these proposed improvements the same as if
already constructed.
c. The existing improvements on the church property shall be indicated on the plans (and all
appropriate sheets), including any existing access points.

d. The City will not maintain the proposed private drive. The right-of-way will need to be
vacated. The Department will confirm this desire with the Deparbnent of Community
Services. Right-of-way vacation is approved by the City Council. The Department will
expect the petitioner to develop all of the necessary plats and descriptions for the right-of-
way vacation. The Department would expect that property reversion as the right-of-way
is vacated will need to be resolved between the property owners
e. Was a traffic study conducted as required by ordinance for a DP?
f. The City bas adopted a new curbing policy. All curbing installed by this project shall
conform to this policy. Please revise any notes, specifications, and details to
accommodate this policy. The language of this policy must be added to a specification
sheet on the final construction plans.
g. Please indicate and label the Pennsylvania Street intersection on all sheets.
h. Please show all existing and proposed 131 It Street entrances and accesses and label them
accordingly, including the new public street into the Alexandria Apartments on all sheets.
i. Please show the complete intersection of U.S. 31 and 131 It Street on all sheets.
j. Please provide the name of the facility shown as "EXISTING CHURCH."
k. The church dedicated right-of-way for Grand Boulevard and is expecting access off of
this future street. It is not likely that Grand Boulevard will be extended north of 131 It
Street per the current Thoroughfare Plan. However, the church will need access to the
proposed private drive and be provided any necessary rights to ingress and egress and
other legal use of the drive. The plan shall indicate how access is provided to the church
and the construction of any aprons.
I. Please provide a Maintenance of traffic plan. Please evaluate if the plan will need to
include signage in the US-31 right-of-way. All proper permits will need to be obtained.
40. Storm Water Management
a. This project is subject to the City's Stonn Water Manangement and Stonn Water Quality
Ordinances.
b. Please confirm if it is intended to intercept the equalized flow for the SO-year rain event
and greater from the church property and discharge this into the Legal Drain.
c. The City is encouraging Low Impact Development (LID) practices to enhance the
proposed water quality treatment system.
d. Please contact Amanda Foley to review storm water quality/treatment requirements.
e. Please ensure that the storm water management facilities and the stonn water treatment
system accommodate detention for the portion of the northwest comer of the church
property that drains to the northwest and into the development.
41. Sheet CIOI
a. Please label all existing right-of-way, including the Grand Boulevard right-of-way.
b. Please indicate all existing church improvements, including access points, detention
ponds, pond outlet, curb turnouts, pond overflow, drive culvert, etc.
42. Sheet C20 I
a. Thank you for indicating the auxiliary lanes at the westernmost entrance. The
acceleration lane is not per City standards. Please verify all dimensions meet City
standards. The Department would expect these auxiliary lanes to be constructed and
remain in place until the roundabout is constructed. There shall be no credit against any
formal commitments for Thoroughfare Plan improvements for the construction of these
auxiliary lanes.
b. The right-of-way for the roundabout shall be a 120-foot radius unless a smaller radius bas
been discussed with the City Engineer.
c. The 20-year Thoroughfare Plan indicates a 60-foot half for the 131 It Street frontage east
of Pennsylvania Street. However, the 20-year Thoroughfare Plan does not specifically
indicate a right-of-way from Pennsylvania Street to US-31. The Department would
expect the right-of-way for this segment to be that of a Primary Arterial (consistent with
other such segments between Pennsylvania and US-31 on the east side and between

Illinois Street and US-31 on the west side) and require dedication ofa 7S-foot halfright-
of-way.
d. The Development Plan does not indicate any bicycle parking spaces.
e. The City requests the extension of the 10-foot multi-use path across the church parcel to
Grand Boulevard. This work would be credited against any formal commitments for
Thoroughfare Plan improvements.
f. Please confirm with the DOCS the need for pedestrian connectivity along the easternmost
access drive.
g. The Department assumes that there have been discussions with the Department of
Community Services related to the extension of Pennsylvania Street north through
proposed Lot 2 and crossing US-31 in some fashion as indicated on the Thoroughfare
Plan.
h. The City will not request auxiliary lanes at the easternmost private drive due to the
limited right-of-way to the east. However, if the existing right-of-way to the east is
adequate for construction of auxiliary lanes to the City standards, the Department will
request construction of these lanes. Please verify the existing right-of-way to the east of
the property.
i. The Department requests widening of the north side of 131 It Street from US-31 to Grand
Boulevard such that there is 24-feet of travel lanes. Please coordinate such work with any
proposed widening being performed by the Alexandria Apartments.
j. The Department requests milling and resurfacing of the full width of the existing
pavement from US-31 to GraIld Boulevard. Please coordinate such work with any similar
work being performed by the Alexandria Apartments.
k. The Department recommends (does not require) that the easternmost private drive be
constructed to City Standards in the event that it is ever desired to dedicate this street to
the City.
1. The Development Plan did not indicate the requisite storm water/drainage information
required by Section 100 of the Storm Water Technical Standards Manual. Please include
such information on the construction plans.
m. Thank you for indicating the potential INDOT right-of-way on the plan. Per an email
from the Department of Community Services dated July 13,2003 to Mr. Browning, the
City is not requesting right-of-way associated with US-31 at this time.
n. The Department suggests the alignment of the interior access drives serving Lots 1,2 and
3.
o. The construction drawings will need to address modifications to (or removal ot) the
existing church access roadway. The City requests the removal of the existing curb
turnouts and facilities installed to accommodate the runoff from the existing and future
access road. The pond overflow shall be accommodated in some fashion also. There is a
limited receiving system to the east.
43. Sheet C401
a. Construction Plans need to include more detailed erosion and sediment control and post
construction water quality plans and information.
44. Sheet CSOI
a. All permits required from the INDOT for the storm sewer bore under US-31 shall be
obtained prior to approval of the construction drawings.
b. Is an easement required for the sanitary main extension south of 131 st Street?
c. The water main connection is located within the future pavement of the roundabout. Is a
valve required at this location?
d. There is a proposed sanitary manhole in the future pavement of the roundabout. This
manhole needs to be located outside of the future pavement of the roundabout.
e. There shall be no castings for storm, sewer, water or other utilities in pavement, curb,
sidewalk or path within the City right-of-way.

It is my belief that your development plan shows the proper set-aside of right-of-way for Main Street improvement,
Pennsylvania Street intersection improvement, and the construction of US 31 improvements per the City's planned
roundabout interchange. I do not believe we are asking for additional right-of-way from you at this time, and will clarify
that with the PC if necessary.

The following letter represents comments for this project specifically addressing the area of alternative
transportation. I have reviewed the drawings submitted for the June 8, 2007 and offer the following comments:
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
I) Please indicate ADA compliant handicap ramps at all crossings.
Please revise the plans to show ADA compliance for all crossings.
2) Please connect all internal sidewalks, provide sidewalks on each side of new street, and make a
connection to the multi-use path on the east side of the entrance street. Please revise the plans to reflect
these changes.
The revised plans have missing sidewalk connections. Please see the enclosed site plan and make
connections where indicated.
We request that all responses to our comments be provided in writing. Failure to provide written responses may

Thank you for your TAC review comments via emails on May 2 and 15,2007, for this
project .
1. Although we do not as yet have a tree survey, we have located the trees, shrubs
and brush on the site from available mapping, site visits and aerial photography.
As you will be able to see in the aerial photo exhibit, some of the flora in question
lies within the INDOT Right of Way. We do plan on preserving the eastern property
line vegetation as shown on the current version of the Landscape Plan. Browning
Investments will be asking to have the Right of Way cleared through INDOT as well
as clearing the buffer yard along US 31 so that this development may also utilize
the economic benefits of having frontage on the highway. This approach will be
similar to the other developments along the US 31 Corridor.
2. The site drainage system is planned, at this time, to be conventional with water
quality basins. Browning Investment and Cripe are supportive of alternate design
solutions and methodologies; however, the financial impacts from the initial
capital investment as well as the maintenance costs and operational
management. As the tenants/owners are identified, alternate solutions will be
considered in relation to the project costs.
3. Thank you for the additional references on "green" design. We will review them
and determine their applicability at the project specific design phase.
The Landscape Plans will be prepared to fulfill the planting requirements established in
the Zoning Ordinance as indicated on the current plan.

Thank you for meeting me on site yesterday morning to discuss this development and tree preservation My initial
comments are:
1. The property is covered under the US Highway 31 Overlay requirements and Section 26.04 Bufferyard
requirements. So development design should be according to those design requirements. A DP also
includes a landscape plan and existing vegetation to be shown at least on the site plan. There are
requirements to preserve existing trees that are located in Greenbelt areas along 31, setbacks, planting
stripes, and perimeter bufferyards. Perhaps a first step would be to inventory the trees in those areas to
form a realistic idea of the size of the resource located on the property.
2. The second step would be to provide the amount of impervious surface planed for the development, and
see what form of alternatives we have for storm water management, such as pervious paving in the

following are the responses to the specific items in question:

3. Noted. At the time of Construction Documents, we will be seeking a Non-
enforcement or vacation to facilitate the on-site development.

5. Based on our preliminary design discussions, we plan on detaining the on-site
water and boring a pipe to the detention basin as previously required by the
County Surveyor's Office in accordance with the drainage report for the CMC
Properties Business Park prepared by Schneider, dated 8/30/02.
6. We will be scheduling a meeting to review the watershed areas and allowable
release rates in conformance with the current drainage standards and the
previous Schneider report as we move into the Construction Document phase.
7. As discussed with the City of Carmel, we are exploring the US 31 design solution
with the City and INDOT, but have not had any response on the solution. We are
proceeding with our design based on the Carmel preferred option recognizing
that there may be issues to address in the future by INDOT.
8. We will be seeking a variance of the setback standard based on the site
constraints and elevations associated with US 31 .

We have reviewed the TAC submittal to the Hamilton County Surveyor's Office on. April 20,
2007 for this project and have the following comm.ents:
L The project in located in the incorporated area and MS4 jurisdiction of the City of
Carmel.
2. The project falls in the J.R. Collins No.1 Regulated Drain Watershed.
3. Arm #2 of the J.R. Collin.s No.1 Regulated Drain extends part way through this
site and has a statutory 75' per half easement from the center line of the tile.
4. The proposed site DOES NOT fall in a Cannel Wellhead Protection Area..
5. The LR. Collins Regulated Drain is a 5" tile installed in 1890 and is inadequate to
convey the Stonn water runoff from a developed site. This regulated drain must
be reconstructed downstream to a point of adequate outlet as approved by the
Hamilton County Surveyor.
6. Based on the acreage that is within the watershed of the J.R. Collins #1 Drain per
our records (15.70 acres), the allowable release rates for this site are 1.57 cfs for
the 1 to 10 year 24 hour stonn event and 4.71 cfs for the 11 to 100 year 24 hour
stonn event.

7. The Hamilton County Surveyors Office has concerns about the location of the
detention faculties in regards to tbe U.S, 31 Right or Way. The proposed
detention ponds appear to be in an area that could be needed for future Right of
Way for the U.S, 31 upgrades. This could cause the site to be without the
required detention or INDOT to have to relocate the detention at signifi.cant cost.
Has any preliminary discussions been. held with INDOT to get their input on this
project?
8. Section 302.05(#4) of the Hamilton County Stormwater Technical Standards
Manual and Section 302.06(#4} of the City of Cannel Stonnwater Technical
Standards Manual require a 50' separation from the top of bank of a detention
pond to the Right of Way of a public road. Other alternative may be used to help
deter a vehicle from accidentally entering the pond area.
9. For future design reference, this site will be required to comply with the Hamilton
County Stormwater Technical Standards Manual and the City of Carmel
Stonnwater Technical Standards Manual.
10. Although the Hamilton County Surveyor's Office has reviewed this development
plan and issued a comment letter, this office will not be limited by the
development plan in regards to the pond sizes or location, drainage easement
widths, stonn sewer locations, lot layout, landscape layout, or any other drainage
related issues. Insufficient infonnation is presented to conduct a complete
drainage review and changes may be required during the construction planning
stage.
11. Please submit construction plans and drainage calculations to our office~ when
they become available.

Thank you for your T AC review comments dated May 14,2007, for this project.
It appears that all of the comments are more related to the Construction Document
review rather than the Development Plan stage of the project. We assume that the route
of the water and sanitary lines will be modified as the individual sites become more
refined.
It seems that the sanitary sewer lateral locations are more based on residential
requirements, but we will schedule a meeting to review the site specific details to
incorporate building plumbing needs and site constraints.
We do appreciate the communication of the design standards and specification
changes. We will be sure to include this information in the Construction Documents when
we are at that point in the process.

*For Water Service and Sewer Lateral Installation: Locate the middle of the Lot and install Water 5' left of that line
and Sewer 5' right. A 6' piece of PVC pipe is to be used to mark the water service stub. All service lines are to
terminate 8' behind the sidewalk
*We will need 2 sets of paper/hard copy as-builts as well as 2 copies of electronic as-builts on a CD. These CD drawings
must include streets, lots, water mains, and the measurements of all valves, laterals, fittings and service lines.
Water will not be turned on or approved until this requirement is fulfilled.
* All valves, hydrants, fittings, etc are REQUIRED to be captured as GPS points and submitted with as-bunts. More
information can be found in the City of Carmel Specs.

Have you contacted INDOT yet to determine the current right-of-way requirements for US-31?
The draft Environmental Impact Statement outlines the right-of-way requirements for two
options at 131st Street; an overpass and an interchange. The interchange is the likely
option but has not been confirmed. The interchange option has a significant impact on the
proposed development.
I have attached three documents. Two of the documents are from the DEIS. The other is the
mark-up of the VERY APPROXIMATE right-of-way of the two options. The area proposed for
development (considering dedication of the 70-foot half on 131st Street and the RAB at
Pennsylvania Street) is highlighted in orange.
I know that we had discussed the pond location as being undesirable from the standpoint of
the future US-31 improvements and that it would be unlikely that INDOT would be able to
provide a firm determination of the required right-of-way. We also discussed that if INDOT
could not provide the future right-of-way needs that addressing any impact to the ponds
would be something that INDOT would need to consider as they move forward with the design.
However, I believe that we did discuss that the DEIS did establish preliminary right-of-
way. I will admit that when we met, I did not consider the right-of-way impact on the
current City parcel in the review of the land plan. Previous developers had not considered
acquiring the City's piece, so I remembered (and believed that I mentioned) only the
preliminary right-of-way established for 131st Street.
The proposed right-of-way identified in the DEIS appears to have a large impact on the
area being reserved for detention and the area of the proposed Building 2. Since the DEIS
is a published document, the City must require that the right-of-way indicated on the DEIS
be reserved for future improvements either as right-of-way or be accounted for in the land
plan as a "no-build" area unless INDOT is able to establish more definitive right-of-way
requirements prior to approval of this project.

following are the responses to the specific items in question:
1. The site plan shows 5' walks along the interior access drives for pedestrian
circulation to the buildings.
2. Bicycle parking has been allotted space in the development, but will be further
defined as the building design becomes more specific. The parking will be shown
in the Construction Documents after Development Plan approval.
3. The site is being rezone to B-6 and the US 31 Overlay District. As per discussions with
DOCS, the Old Meridian Standards will not apply.
4. Since this submittal is only a Development Plan, we are not showing ADA ramps at
this time. We will incorporate those on the Construction Documents when we are
in that stage of development and permitting.
5. As discussed in T AC, there are no new streets. The internal access drive has been
equipped with sidewalks, but only on a single side. The multi-use path connection
along the east drive is not planned at this time due to it crossing another owner's
property and is to be used as a secondary point of vehicular egress only. The
physical limitations of the adjacent property will not permit a walk connection.
The proposed site does connect to the path along 131 sl Street.

The draft Environmental Impact Statement outlines the rig t-of-way requirements for two
options at 131st Street; an overpass and an interchange. The interchange is the likely
option but has not been confirmed. The interchange option has a significant impact on the
proposed development.
I have attached three documents. Two of the documents are from the DEIS. The other is the
mark-up of the VERY APPROXIMATE right-of-way of the two options. The area proposed for
development (considering dedication of the 70-foot half on 131st Street and the RAE at
Pennsylvania Street) is highlighted in orange.
I know that we had discussed the ~as being undesirable from the standpoint of
the future US-31 improvements and a lt wo~ be unlikely that INDOT would be able to
provide a firm determination of the required right-of-way. We also discussed that if INDOT
could not provide the future right-of-way needs that addressing any impact to the ponds
would be something that INDOT would need to consider as they move forward with the design.
However, I believe that we did discuss that the DEIS did establish preliminary right-of-
way. I will admit that when we met, I did not consider the right-of-way impact on the
current City parcel in the review of the land plan. Previous developers had not considered
acquiring the City's piece, so I remembered (and believed that I mentioned) only the
preliminary right-of-way established for 131st Street.
The proposed right-of-way identified in the DEIS appears to have a large impact on the
area being reserved for detention and the area of the proposed Building 2. Since the DEIS
is a published document, the City must require that the right-of-way indicated on the DEIS
be reserved for future improvements either as right-of-way or be accounted for in the land
plan as a "no-build" area unless INDOT is able to establish more definitive right-of-way
requirements prior to approval of this project.

Thank you for meeting me on site yesterday morning to discuss this development and tree preservation My initial
comments are:
1. The property is covered under the US Highway 31 Overlay requirements and Section 26.04 Bufferyard
requirements. So development design should be according to those design requirements. A DP also includes a
landscape plan and existing vegetation to be shown at least on the site plan. There are requirements to preserve
existing trees that are located in Greenbelt areas along 31, setbacks, planting stripes, and perimeter bufferyards.
Perhaps a first step would be to inventory the trees in those areas to form a realistic idea of the size of the
resource located on the property.
2. The second step would be to provide the amount of impervious surface planed for the development, and see what
form of alternatives we have for storm water management, such as pervious paving in the parking lot! bio swales,

We have reviewed the T AC submittal to the Hamilton County Surveyor's Office on April 20,
2007 for this project and have the following comments;
I. The project in Jocated in the incorporated area and MS4 jurisdiction of the City of
Cannel.
2. The project falls in the J.R. Collins No. 1 Regulated Drain Watershed.
3. Arm #2 of the 1.R. Collins No. I Regulated Drain extends part way through this
site and has a statutory 75' per half easement from the center line of the tile.
4. The proposed site DOES NOT fall in a Carmel Wellhead Protection Area.
S. The J.R. CoUins Regulated Drain is a S" tile installed in 1890 and is inadequate to
convey the stonn water nmoff from a developed site. This regulated drain must
be reconstructed downstream to a point of adequate outlet as approved by the
Hamilton County Surveyor.
6. Based on the acreage that is within the watershed oftbe 1.R. Collins #1 Drain per
our records (15.70 aeres), the allowable release rates for this site are 1.57 cfs for
the 1 to 10 year 24 hour $tom) event and 4.71 cfs for the 11 to 100 year 24 hour
storm event.

7. The Hamilton County Surveyors Office has concerns about the location of the
detention faculties in regards to the U.S. 31 Right or Way. The proposed.
detention ponds appear to be in an area that could be needed for future Right of
Way for the U.S. 31 UPiRldes. This could cause the site to be without the
required detention or INDOT to have to relocate the detention at significant cost.
Has any preliminary discussions been held with INDOT to get their input on this
project?
8. Section 302.05(#4) of the Hamilton County Storntwater Technic:aI Standards
Manual and Section 302.06(#4) of the City of Carmel Stonnwater TecbnicaJ
Standards Manual require a 50' separation from the top ofba11k of a detention
pond to the Right of Way of a public road. Other alternative may be used to help
deter a vehicle from accidentally entering the pond area.
9. For future design reference, this site will be required to comply with the Hamilton
County Stonnwater Technical Standards Manual and the City of Carmel
Stormwater Tecbnical Standards Manual.
10. Although the Hamilton County Surveyor's Office has reviewed this development
plan and issued a comment letter, this office will not be limited by the
development plan in regards to the pond sizes or location, drainage easement
widths, stann sewet locations, lot layout. landscape layout, or any other drainage
related issues. Insufficient infonnation is presented to conduct a complete
drainage review and changes may be required during the construction planning
stage.
11. Please submit construction plans and drainage calculations to our office. when
they become available.
12. Please note the additional comments may be warranted at a later date.

The following letter represents comments for this project specifically addressing the area of
alternative transportation. I have reviewed the drawings submitted for the May 16, 2007
Technical Advisory Committee meeting, and offer the following comments:
ALTERNATIVE TRANSPORTATION REVIEW COMMENTS
1) The Carmel Clay Alternative Transportation Plan requires that all internal streets have
5' wide sidewalks. Please revise the plans to show sidewalks on all streets.
2) The City of Carmel Parking Ordinance requires that all commercial developments
include bicycle parking. Bicycle parking spaces are required at a rate of five (5)
bicycle parking spaces per one hundred (100) automobile parking spaces. Please
revise your plans to show the required bicycle parking spaces on your site. Please see
the City of Carmel's Parking Ordinance in order to determine appropriate locations,
specifications and construction details for the above.
3) Chapter 20 G OM Old Meridian district Section 20G.04.02 G states that all streets
and alleys in the District shall be dedicated to the City. Pleas revise the plans to
reflect this.
4) Please indicate ADA compliant handicap ramps at all crossings.
5) Please connect all internal sidewalks, provide sidewalks on each side of new street,
and make a connection to the multi-use path on the east side ofthe entrance street.
Please revise the plans to reflect these changes.
We request that all responses to our comments be provided in writing. Failure to provide written
responses may result in delay of the review process.

Thank you for your TAC review comments dated May 9,2007, for this project. We have
made the following revisions and/or will be.
1. The docket number has been added to the plans as requested.
2. Browning Investments will be supplying the list of adjacent property owners.
3. Browning Investments will be preparing the info packets with the Findings of Fact.
4. Affidavit is being prepared by Browning Investments.
5. Public Hearing Sheet is being prepared by Browning Investments.
6. Public Notice Sign Placement affidavit is being prepared by Browning
Investments.
7. Attached is our TAC correspondence as requested.
8. Easements have been shown and labeled on the utility and landscape plans as
requested.
9. Attached is the aerial photo exhibit as requested.
10. The adjacent buildings to the west, east and south have been added to the
plans. There is not a building to the north as shown in the aerial for a significant
distance.
11. The drainage calculations are the information listed on the utility Plan as discussed
with Gary Duncan of the Engineering Office. We can supply additional info if
needed.
12. Erosion Control Plan has been added to the plan set as requested; however, we
believe this to still be a premature exercise based on the fact that these are not
construction documents and the phasing, if any, has not yet been determined.
13. The US 31 Right of Way in accordance with the INDOT Environmental Study has
been added to the plans for reference.
14. The roundabout has been added to the plans for planning purposes as
requested.
15. Space has been allotted for bicycle parking and will be incorporated into each
site plan for construction at that time based on the building orientation and
configuration.

16. The lot coverage was listed on the original submittal and was 55%. With the latest
plan changes, the plan still conforms and is at 58.46% coverage as shown on the
Site Plan.
17. At this time, the developer is in a position to consider structured parking based on
the financial market and the needs of the site. If it becomes financially feasible or
future tenant/owner required, then it will be a potential solution.
18. Electronic documents are provided for your use as requested. Building elevations
are not available at this time since the specific building design and
tenants/owners have not yet been determined. It is understood by Browning
Investments that the architectural standards of the zoning ordinance will be
required.
