The applicant seeks the following use variance:
Docket No. 07070018 UV Appendix A - Use Table Secondary School uses in the M3
District
General Info: The petitioner is requesting the
approval of a use variance to operate a secondary
school in an existing office building, located in the
Carmel Science and Technology Park. The site is zoned
M3.
Analysis: The proposed school would occupy the
northeastern section of the building. There would be
no improvements made to the exterior; the use would
be entirely internal. The proposed use would be similar
in intensity to the office uses which surround the site,
with regards to traffic and hours of operation. The
school is anticipated to have 90 students and 9 teachers,
and to occupy 10,787 square feet. The majority of the
building is currently vacant. Technical schools are a
permitted use in the M3 District, however, secondary
school uses are not. However, the proposed use would
be compatible with surrounding uses.
Findings of Fact:
1. The approval of this variance will not be injurious to the public health, safety, morals, and
general welfare of the community because: the proposed use would have a similar impact on
surrounding uses as office or other permitted uses.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because: the proposed use would have a similar
impact on surrounding uses as office or other permitted uses.
3. The strict application of the terms of the Zoning Ordinance to the property will result in
practical difficulties in the use of the property because: the majority of the building is currently
vacant, and the proposed use would occupy a portion of the building, with little impact on
surrounding uses.
Recommendation: The Dept. of Community Services recommends positive consideration of Docket
No. 07070018 UV after all questions/concerns are addressed.
