Purpose of the structure is for a Private Indoor Basketball for use by the Simon Family. The Variance being requested is for an Accessory Structure in excess of the permitted 18' -0" height for such structures. The general construction format for the building is to use a pre-engineered Steel Structure which is to be placed upon a raised concrete floor system. Raised concrete floor system will be constructed 4' -0" above the existing grade. Floor system is designed to allow the water from a flooding situation to flow thru and around the support structure. The exterior ofthe building is to be clad in wood with Doors, Windows and Trim details per the attached plans. Exterior to be painted in a grey / moss green color range. Roof to be a painted standing seam metal panel. The primary function of the building is for a Basketball Court. The interior will consist of the court area and a single story addition for a Bathroom, Changing Area, Viewing Area and Entry. Interior finishes consisting of Drywall walls, Tile & Wood floors and Basketball accessories. Upper walls and ceiling of court area to be exposed vinyl clad insulation batts, steel structure, duct work and lighting. Construction of the building will require the relocation of the existing Tennis Court. See attached Site Plan. Placement of new Accessory Building and Tennis Court will not require the removal of any additional tress. Upon completion of construction, both the Building and Tennis Court to be landscaped. Building will receive new plantings to screen structure on all sides. Access to Building and Court to be by a paver block path. No additional parking area to be created adjoining the accessory Building. No exterior lighting or Tennis Court lighting to be installed. o o o o D D D o D o D D D D D D D D D The location of the proposed Accessory Building will be in a low area of the Simon property. The existing grade at the base of the building is 808.5'. The grade at both the Simon's primary residence and that of the adjoining neighbor is 834' to 840'. Upon completion to the total height of the proposed building will be 842' +/-. From Hussey Lane the building should not be visible. The proposed building is separated from Spring Mill by a heavily wooded area and Williams Creek. Visability and access are restricted. Attachments: 1. Filed by Larry Jones. 106TH ST General Info: The petitioner seeks variance approval to construct an accessory building that exceeds the 18-ft height limit. The structure will be close to 30-ft in height, so that it can be used for an indoor basketball court. It will be clad in wood, with a standing seam metal roof, and will be built 4 feet above grade in case of flooding events. The existing tennis court will be moved to accommodate the new building, and both will be landscaped. Neither the building nor the tennis court will have exterior illumination. Analysis: The property is 15 acres in size, and an indoor basketball court could easily be placed on this site and far away from the house and the street. The height of the structure is necessary to appropriately be able to play basketball indoors, without any interferences of a low ceiling. The building is also proposed to be placed towards the back of the property, which is heavily wooded and has a grade change of approximately 30 feet from front to back. The existing woods, grade change, and proposed landscaping will all help screen the proposed building from surrounding properties. Findings of Fact: 1.) The approval of this variance will not be injurious to the public health, safety, morals, and general welfare of the community because: the large size of the property and the building placement will allow the accessory building to not create a negative impact. 2.) The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because: the large size of the property and the building placement will allow the accessory building to not create a negative impact. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The property owner will not be able to adequately construct an indoor basketball court on this large parcel, possibly having a negative effect of the property owner's quality of life and property value. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 07030029 after all questions/concerns are addressed. o o D D D o o o D o D o D D o D o D o PittmanPartners. City of Carmel Carmel Board of Zoning Appeals Dear Sirs, We have reviewed the Site Plan, Elevations and Landscape Plan for the proposed Accessory Building and have found that this structure will not affect our project. The amount of existing mature trees and the distance between our location and the proposed structure is substantial. The Reserve is located on the East side of Spring mill Street and the proposed structure should not be visible from our developments site. Please include this letter in support of the project with any documentation provided for the Simon Accessory Building Variance. Exterior lighting shall be limited to general illumination of the basketball court entry, stair and parking areas, all as depicted on the attached site and building plan. Exterior mounted "flood" lights shall be permitted provided they do not operate after 10:00 pm on weekdays and 12:00 pm on weekends. Exterior mounted flood lights shall be installed with motion sensors for security purposes allowing illumination after the above stated hours. However, such sensors shall be placed not higher than 10 feet above grade. 2) Landscaping. Petitioner shall install landscaping consistent with the "Simon Residence" landscaping plan prepared by Remenschneider Associates, Inc. dated May _,2007. Such landscaping shall be installed within 3 months after initial use of the basketball court, weather permitting.
