, The Public Hearing opened at 8.40 with Mr. Passo making the presentation
for an identifying sign for the steak house. Mr. Passo said it would be a
hardship without the sign as people do not know they are there. The 10 ft.
by 3 ft. sign will then go on the building.
The Public Hearing closed at 8.46.
Mr. Regan questioned what the second 3 ft by 10 ft. sign will look like.
Mr. Passo explained stating it will be a new sign on the existing pole.
Mr. Regan said that the Board should look at both signs at the same time.
Mr. Carl Smith questioned what the signs will look like and said the
Board can't make a determination until it is familiar with both signs.
Mr. Passo said the sign will be interior lighted.
Mr. Carl Smith moved that this item be tabled until the petitioner
brings in the necessary sign information at the August meeting. .Seconded
by Frank Regan.
The vote was 4 For, 2 Against (Jim Smith and Dr. Durrer voting No).
Motion to table carried.
6a. 8.45 P.M., Public Hearing on Docket No. 25-78, Special Exception
Application for Eden Village Apts., 158 units on 15.35 acres,
located S.E. corner of l26th and Keystone Ave.

Board to consider Docket No. BA 8-78. Variance Application to allow
Central Ind. Lutheran Retirement Home Inc. to build a nursing home
and homes for the aged in S-2 residential zoning located on thenN.W.
corner of 99th and Keystone Ave. Board is waiting for recommendation
from the Plan Commission.

The secretary read the July Plan Commission minutes pertaining to this
item. The Commission made an unfavorable recommendation to the Board of
Zoning Appeals.
Mr. Floyd asked that the Committee report be made a part of the record.
Mr. Glen Jensen asked that he be excused from voting on this item since
he is new to the Board and did not hear the Public Hearing.
Mr. Carl Smith questioned whether no homes can be guilt in a flood way
and homes can be built in a flood plane and asked whether the area surround-
ing the creek is flood plane or flood way.
Mr. Floyd said he didn't know.
Mr.. Carl Smith said you Can build in a flood plane with the permission
of the Building Commissio~er.
Mr.C"Bara of Weihe Engineering was present.
Mr. Carl Smith questioned water in the area stating that there has been
no flooding there. Mr. Smith disagrees with the flood plane theory.
Mr. Floyd said that Mr. O'Bara did not establish where the flood plane
of Carmel Creek was but the natural circumstances.

6b. Board to consider Variance renewal, Docket No. BA 2-68, for mobil
home located 10851 N. River Rd.

Mr. Regan read a letter from Mr. Karnes requesting renewal. There
were no complaints in the file.
Mr. York moved that BA 2-68 be renewed for. 1 year. Seconded by Carl
