Dear Mr. Furlong,
At the meeting held Tuesday, May 28, 2002, the CarmeVClay Board of Zoning Appeals
took the following action regarding the Special Use and Developmental Standards Variance
petitions filed by Max Williams of Martin Marietta Materials, Inc., for property located on the
northwest comer of East 106th Street and Hazel Dell Parkway:
DENIED: Docket No. SU-24-02, a Special Use per Section 5.2: Special Uses in order to establish
a sand and gravel extraction operation on 105.981:1: acres. The Board voted two (2) in favor, three
(3) opposed, thereby denying the petition.
DENIED: Docket No. SU-25-02, a Special Use per Section 5.2: Special Uses in order to establish
an artificial lake on 105.981:1: acres. The Board voted two (2) in favor, three (3) opposed, thereby
denying the petition.

DENIED: Docket No. V-26-02, a Developmental Standards Variance of Section 5.2.2: Other
Requirements in order to reduce the minimum perimeter natural open space buffer from three
hundred (300) feet to one hundred fifty (150) feet along the north and west property lines
adjacent to the Kingswood Subdivision. The Board voted two (2) in favor, three (3) opposed,
thereby denying the petition.
DENIED: Docket No. V-27-02, a Developmental Standards Variance of Section 5.2.2: Other
Requirements in order to reduce the minimum perimeter natural open space buffer from three
hundred (300) feet to one hundred (100) feet along the west property line adjacent to Carmelot
Park; the south property line adjacent to the East 106th Street right-of-way; and the east property
line adjacent to the Hazel Dell Park\yayrfght-of-way. The Board voted two (2) in favor, three (3)
opposed, thereby denying the petiti'ort:' ...
