a. To mine sand and gravel from the Mueller Property,
dredge;
b. To relocate the existing processing plant from the Martin Marietta
property east of Kingswood to Martin Marietta property east of Hazel Dell Road,
provided it has obtained approval to mine sand and gravel on the Mueller
Property in time to allow the relocation; and
c. To reclaim the Mueller Property as a lake, which will create permanent
open space.
Mining sand and gravel with a dredge is completely different than mining limestone in a quarry.
The sand and gravel mining will not in any sense "pave the way" for future quarry operations on
the Mueller Property.
2. Mining and reclamation will be done pursuant to a Mining and Reclamation Plan,
including a Surface Mine Plan Map and a Proposed Reclamation Map attached to the Mining and
Reclamation Plan. The Mining and Reclamation Plan has been reviewed by Spectra
Environmental Group, Inc., and Martin Marietta has responded to Spectra's comments.
3. The proposed sand and gravel extraction is a permitted special use in the S-1 district
under the Carmel Clay Zoning Ordinance. As such, the Board's review is subject to a different
standard than other types of applications.
4. Martin Marietta expects to have a signed agreement ending the litigation brought by the
Kingswood Homeowners Association against Martin Marietta, the City of Carmel, the Board of
Zoning Appeals and Hughey, Inc. by May 28, 2002.
5. The timing of approval to mine sand and gravel on the Mueller Property is essential to the
movement of the processing. plant. The Indiana Department of Natural Resources has approved
the relocation of the processing plant to an area within the floodway of the White River. The
permitted location of the processing plant is governed by the topographical cross-section of the
floodway. The proposed site of the processing plant cannot, therefore, be moved. If Martin
Marietta is not permitted to mine the Mueller Property, it will have to obtain sand and gravel
from the proposed site of the relocated processing plant. Martin Marietta originally believed that
it needed permission to mine the Mueller Property before May 1, 2002 in order to relocate the
processing plant. It has extended the time to obtain those approvals by reducing production by
the dredge. This necessitated reducing the current inventory to meet sales demands. It has also
extended the time to obtain those approvals by reducing the size of the proposed processing piles
that will surround the relo~ated processing plant. If Martin Marietta is not permitted to begin
mining sand and gravel from the Mueller Property within the next several weeks, however, the
site of the processing plant and material piles will need to be removed in order to obtain the sand
and gravel underlying the site.
6. Representatives of Martin Marietta have met numerous times with Kingswood residents,
both individually and in groups. Most recently, in March 2002, approximately 60 people (from

225 households) attended a meeting hosted by Martin Marietta at the Oak Hill Mansion. Martin
Marietta has made numerous agreements, contained in the settlement of the litigation, the Mining
and Reclamation Plan and the proposed zoning commitments, that address concerns raised about
the proposed sand and gravel extraction on the Mueller Property. Among the issues discussed
with neighboring property owners is the ultimate ownership of the lake created through the sand
and gravel extraction. Some residents of Kingswood would like public access to the lake
through the south end of Kingswood. Others, primarily owners of property adjoining the
Mueller Property, oppose public access near their homes. Martin Marietta has agreed to work
with the conservators of Helen Mueller to obtain and transfer a plot of land, generally the width
of their lot in Kingswood and 150 feet deep, to each of the adjoining owners in Kingswood.
Martin Marietta has expressed its willingness to work with the City of Carmel, Carmel Utilities
and the Parks and Recreation Board to make the remaining reclaimed land a public asset, as
Martin Marietta has done with other properties in Carmel that are now part of the community's
park system.
7. Carmel Utilities is aware of Martin Marietta's proposal, and has not expressed any
concern that sand and gravel extraction might adversely affect well-field production. Sand and
gravel extraction simply exposes groundwater that underlays much of the area near the White
River. Sand and gravel extraction on the Mueller Property will not pull water from other lakes or
wells. In any event, Martin Marietta has also agreed to utilize a closed-loop system whereby
water used to transport aggregate to the processing plant will be returned to the excavation area.
