COMMITMENT FOR USE OF REAL ESTATE
INCIDENT TO SPECIAL USE AND VARIANCE
The undersigned, Martin Marietta Materials, Inc. ("Martin Marietta") hereby makes the
following commitment to the Carmel Clay Board of Zoning Appeals ("Commitment") incident to
the grant of a Special Use and Variance from Development Standards for the Undersigned's
proposed operations (the "Operations") to be located on real estate located in Hamilton County,
Indiana and described on the attached Exhibit A which is incorporated herein, which real estate is
referred to as the "Mueller Property."
1. General Operations Restrictions. All surface mining on the Mueller Property shall
be subject to the following restrictions:
(a) All overburden removal on the Mueller Property north of 106th Street shall
be completed during daylight hours (between one half hour after sunrise and one halfhour
before sunset), during the months of November through March, and only on days other than
Saturday or Sunday. Martin Marietta shall also cause any operations under its control to be
undertaken and conducted in a manner so as to minimize noise, dust, light or smoke impact
on surrounding properties.
(b) From the overburden removed during sand and gravel extraction, Martin
Marietta shall construct an earthen landscape berm six (6) feet in height on the north side of
106th Street on the Mueller Property (except the wooded portion of the Mueller Property
located directly south of the existing park at the northwest comer of Gray Road and 106th
Street).
(c) No surface operations will be undertaken on the wooded portion of the
Mueller Property north of 106th Street located directly south of the existing park at the
northwest comer of Gray Road and 1 06th Street.

(d) All trucks entering public streets from operations conducted by Martin
Marietta in Clay Township north of 96th Street shall have covered beds.
(e) Martin Marietta shall be responsible for all environmental matters arising
from its operations and shall indemnify and hold harmless the adjacent landowners in the
Kingswood Subdivision with respect to any losses, claims or costs arising therefrom.
(f) Sand and gravel shall be extracted only through the use of a floating dredge.
Such extraction will be done in the sequence depicted in the Mining and Reclamation Plan
submitted by Martin Marietta in connection with its Special Use application.
2. Processing Plant. If Martin Marietta is permitted to commence sand and gravel
extraction on the Mueller property by May 1, 2002 and is not precluded from continuing such
extraction, Martin Marietta shall, subject to approval by the Carmel Clay Board of Zoning Appeals
and the Indiana Department of Natural Resources, move the processing plant located north of 106th
Street west of Hazel Dell Parkway and adjacent to the Kingswood Subdivision to a new location just
east of Hazel Dell Parkway and north of 106th Street. Such new location will be further from any
home in the Kingswood Subdivision than at present. Subject to obtaining the required governmental
approvals, Martin Marietta will start the plant relocation no later than January 31, 2004 with
completion of such move to occur no later than March 31, 2004. Martin Marietta shall terminate all
processing operations at the current site ofthe processing plant as soon as the relocation of the plant
is completed. Martin Marietta shall install and maintain noise abatement features at the relocated
plant which are no less effective than those now utilized, including the use of on-site berms and
aggregate piles as buffers, and the use of strobe light signals at night instead of audible signals, for
all equipment as permitted by applicable legal requirements. The existing tree buffer on Hazel Dell
Parkway shall be maintained and shall not be disturbed. Subject to obtaining any required permits
and approvals from applicable governmental authorities, Martin Marietta shall recycle waste water
from the relocated processing plant from the east side of Hazel Dell Parkway to the lake(s) on the
Mueller Property and Martin Marietta property west of Hazel Dell Parkway and north of 1 06th Street.
3. Reclamation.
(a) Martin Marietta shall reclaim the Mueller Property north of 106th Street
(except the wooded portion of the Mueller Property north of 106th Street located directly
south of the existing park at the northwest comer of Gray Road and 106th Street) and the
Martin Marietta property between 106th and 116th Streets abutting the Kingswood
Subdivision and west of Hazel Dell Parkway as a lake with (i) slopes no steeper than 3 to 1,
(ii) a waterline not less than 150 feet from the nearest property line in the Kingswood
Subdivision and (iii) domestic grass coverage of not less than eighty percent per square yard.
Martin Marietta will submit a reclamation plan to the City's consultant for approval.
Reclamation will begin on the northern portion of the Mueller property and move in a
southerly direction.

(b) All reclamation shall comply generally with the reclamation guidelines
adopted by the Indiana Mineral Aggregates Association, a current copy of which shall be
provided to the Director annually.
(c) Upon completion of the sand and gravel extraction, Martin Marietta will
undertake no actions to drain the lake created, nor to reduce the water level below natural
fluctuating levels.
4. Disposition of Property.
(a) Subject to approval of the court overseeing the Helen M. Mueller
Conservatorship and the co-conservators thereof (the "Mueller Owners"), Martin Marietta
shall cause the Mueller Owners to sell, at fair market value, to such adjacent landowners as
elect to purchase it, good and marketable title to the 150 foot wide portion of the Mueller
Property located adjacent to and lying between the adjacent owner's lot in Kingswood
Subdivision and the lake to be created. In the event any adjacent owner elects not to
purchase such land, the next adjacent landowners on either side shall be offered such land.
Ifboth elect to acquire it, it shall be split between them. If neither elects to acquire it, it shall
be maintained by Martin Marietta and/or the Mueller Owners or their successors or assigns.
The conveyance to adjacent landowners shall be made no later than the time all sand and
gravel dredge operations on the Mueller Property North of 106th Street are completed. The
conveyance shall be free of any liens, easements, encumbrances or other restrictions created
by Martin Marietta. The property so conveyed shall be subject to all applicable use and
developmental restrictions and all covenants contained on the plat of the Kingswood
Subdivision and Martin Marietta shall use reasonable efforts to encourage the amendment
ofthe Kingswood Subdivision plat to include the conveyed property.
(b) Subject to approval of the court overseeing the Helen M. Mueller
Conservatorship and Mueller Owners, Martin Marietta shall cause to be conveyed to
Hamilton County or the City of Carmel, as the case may be, a forty-five foot half right of
way along the northern edge of 106th Street measured from the existing center line of 106th
Street.
A copy of the Commitment shall be delivered by Martin Marietta to the Department of
Community Services ofthe City of Carmel after it is recorded by the Recorder of Hamilton County.
This Commitment may not be partially or completely terminated or modified at any time
except by the Carmel Clay Board of Zoning Appeals after notice and hearing. However, until
modified or terminated, thi~ Commitment shall be enforceable by the City of Carmel or its Board
of Zoning Appeals by injunctive relief, denial of building permits or approval or other appropriate
administrative or judicial remedy. In such proceedings to modify or terminate the Commitment,
notice of hearing shall be given to the owners of property as required by the Zoning Ordinance of
the City of Carmel and Clay Township, Hamilton County, Indiana.

EXHIBIT B
Application for S-pecial Use'
Martin MariettaMaterials, Inc. requests a Special Use for surface sand and gravel extraction
and creation of an artificial lake on the portion of the "Mueller Property" located north of 1 06tl1 Street
and described on the attached Exhibit A. (See also the accompanying application for a Variance
from the Development Standards.)
A. The Mueller Property is currently in an S-l residential district. Section 5.2 of the
Carmel/Clay Zoning Ordinance ("Ordinance") establishes that "N1ineral extraction, borrow pit, top
soil removal and their storage" is a permitted Special Use in this district; also an "Artificial lake or
pond" is a permitted Special Use in this-clistrict.
B. This portion of the Mueller Property is partially located in a Floodway Fringe (FF) District.
Section 22.3.2 of the Ordinance establishes that uses permitted under special use requirement"in the
district which is overlapped by the FF District shall be permitted in the FF District.
C. In cOIIDection with this application, Petitioner offers the following commitments to
accompany the requested Special Use approval:
Proposed Commitments:
1. General Operations Restrictions. All operations on the Mueller Property shan,be
subject to the following restrictions:
(a) All overburden removal on the Mueller Property north of l06th Street shall
be completed during daylight hours (between one halfhour after sunrise and one halfhour
before sunset), during the months ofNovemberthrough:March, and only on days other than
Saturday or Sunday. Martin Marietta shall also cause any operations under its control to be
undertaken and conducted in a manner so as to m;n;mi7.e noise, dust, light or smoke impact
on surrounding properties.
(b) From the overburden removed during sand and gravel extraction, Martin
Marietta shall construct an earthen landscape berm six (6) feet in height on the north side of
l06tl1 Street on the Mueller Property (except the wooded portion of the Mueller Property
located directly south of the existing park at the northwest corner of Gray Road and I06tl1
Street).
(c) No surface operations will be undertaken on the wooded portion of the
Mueller Property North of I06tl1 Street located directly south of the existing park at the
northwest corner of Gray Road and 106tl1 Street.

(d) All trucks entering public streets from operations conducted by Martin
Marietta north of 96th Street shall have covered beds.
( e) Martin Marietta shall be responsible for all environmental matters arising
from its operations and shall indemnify- and hold harmless the adjacent landowners in the
Kingswood Subdivision with respect to any losses, claims or costs arising therefrom.
2. Processing Plant. If Martin Marietta is permitted to commence sand and gravel
extraction on the Mueller property by May 1, 2002 and is not precluded from continuing such'
extraction, Martin Marietta shall, subj ect to approval by the Cannel Clay Board of Zoning Appeals
and the Indiana Department of Natural Resources, move the existing processing plant located north
of 106th Street on the west side of Hazel Dell Parkway and adjacent to. the Kingswood Subdivision
to a new location just east of Hazel Dell Parkway and north of 106th Street. Such new location will
be further-from any home in the Kings~od Subdivision than at present. Subject to obtaining the'
required governmental approvals, Martin}(1arietta will start the plant relocation no later than January
2004 with'completion of such move to occur no later than March 31, 2004. Martin Marietta will
terminate all processing operations at the current site of the processing plant as soon as the relocation
of the plant is completed. Martin Marietta will install and maintain noise abatement features at the
relocated plant which are no less effective than those now utilized, including the use of on-site berms
and aggregate piles as buffers and the use of strobe light signals at night instead of audible signals,
for. all equipment as permitted by applicable legal requirements. The existing tree buffer on Hazel
Dell Parkway will be maintained and shall not be disturbed.
3. Reclamation.
. .
(a) Martin Marietta shall reclaim the Mueller Property north of 106th Street
(except the wooded portion of the Mueller Property north of 106th Street located directly
south of the existing park at the northwest corner of Gray Road and 106th Street) and the
Martin Marietta property between l06th and 116th Streets abutting the Kingswood
Subdivision and west of Hazel Dell Parkway as a lake with (i) slopes no steeper than 3 to 1,
(ii) a waterline not less than 150 feet from the nearest property line in the K.ingswood
Subdivision and (iii) domestic grass coverage of not less than eighty percent per square yard.
Martin Marietta will submit a reclamation plan to the City's consultant for approval.
Reclamation will begin on the northern portion of the Mueller property and move in a
southerly direction.
(b) All reclamation shall comply generally with the reclamation guidelines
adopted by the Indiana Mineral Aggregates Association, a current copy of which shall be
provided to the Dire~tor annually.
(c) Upon completion of the sand and gravel extraction, Martin Marietta will
undertake no actions to drain the lake created, nor to' reduce the water level below natural
fluctuating levels.

3. DiS9osition ofPropertv.
(a) Subject to approval of the court. overseeing the Helen M. Mueller
Conservatorship and the co-conservators. thereof (the "Mueller Owners"), Mart:i.D. Marietta
shall cause the Mueller Owners to sell, at fair market value, to such adjacent landowners as
elect to purchase it, good and marketable title to the 150 foot wide portion of the Mueller
Property located adjacent to and lying between the adjacent owner's lot in Kingswood
Subdivision and the lake to be created. In the event any adjacent owner elects not to
purchase such land; the next adjacent landowners on either side shall be offered such land..
Ifboth elect to acquire it, it shall be split between them. If neither elects to acquire it, it shall
be maintained by Martin Marietta and/or the Mueller Owners or their successors or assigns.
The conveyance to adjacent landowners shall be made no later than the time all sand and
gravel dredge operations on the Mueller Property North of 106th Street are completed. The
conveyance shall be free of any Ji'ens, easements, encumbrances or other restrictions created
by Martin Marietta. The property so conveyed shall be subject to all applicable use and
developmental restrictions and all covenants contained on the plat of the Kingswood
Subdivision and Martin Marietta shall use reasonable efforts to encourage the amendment
of the Kingswood Subdivision plat to include the conveyed property.
(b) Subject to approval of the court overseeing the Helen M. Mueller Conservatorship
and the eo-conservators thereof, Martin Marietta shall cause to be conveyed to Hamilton
County or the City of Carmel, as the case may be, a forty-five foot half right of way along
the northern edge of 106th Street measured from the existing center line of 106th Street.

Findin~s of Fact - S{>ecial Use
1. The Special Use in Flood Plain District, Ordinance 2-160, Section 21.6 as amended does
apply and all prerequisites have been met by Petitioner as verified by: .
No portion of the subject property lies within the FW or FP Districts: the Department of
N amral Resources (DNR) does not exercise jurisdiction pursuant to the Flood Control Act in the FE
District; see attached Floodplain Analvsis GN-16056-0 from the DNR.
2. The Special Use will be consistent with the Character and Permitted Land Use of the zoning
district and Carmel/Clay Comprehensive Plan because:
The Carmel/Clay Comprehensive Plan indicates that an Edge between a Residential
. Community area and a Regional and Community Employment area passes directlv through the
subiect property. The. General Polices. regarding Residential Community areas provide that
"transitions. in scale and density. should occur between residential communities and
community/regional employment areas" and that "in areas where zoning changes are requested. such
transition shall be encouraged and considered as part of the approval process." Mineral extraction
and the resulting artificial lake is a low intensity use and will be an effective transition.
In addition. the Land Use Plan indicates a High Intensity residential community designation
directly to the southwest of the sublect propertv. along the same Edge. The proposed mineral
extraction and artificial lake use will be a less obtrusive and lower intensity transitional use.
The property directly south and across 106th Street from the sublect property is designated
as a Low Intensity Regional and Community Employment area on the Land Use Plan. The General
Policies regarding Regional and Community Employment areas provide for "industrial uses" which
. includes mineral extraction. The Low Iritensity Regional and Community Employment area Policies
provide "low intensitv commercial developments should be buffered from residential communities
through the existence of . . . open space." The artificial lake will result in an open space buffer
between the existing residential community to the north and the Regional and Community
Employment area to the south.
3. The Special Use is physically suitable for the land in question because:
There are currently existing mineral extraction operations on the adiacent property to the
north. on the adjacent property to the east. and on the property to the south: portions ofthe property
are in a flood way fringe. making normal development of the property more difficult.
4. The Special Use will not injuriously or adversely affect the adjacent land or property values
because:

The artificial lake resulting from the reclamation of the property. as provided in the
Commitments indicated in Exhibit B. will increase the property values of the adioining residential
properties in that those properties will become lakefront properties: other properties in the vicinity
will increase in value to the extent that the artificial lake is open to the public: the Commitments
require relocation of the existing adjacent sand and gravel processing facility further fromthe existing
residential areas.
5. The Special Use will not adversely affect vehicular or pedestrian traffic flow, nor the
adequate availability of water, sewage, or storm drainage facilities, or police or fire protection
because:
There will be no trucking of minerals or aggregate by means ofthe adjacent roads because
the extraction operations will be accomplished by dredging and will be conveyed underground to
a processing facility on adiacent property: the operation will not require domestic water or sewer
facilities and storm drainage will be accommodated on site or via the existing regulated drains: there
will be no impact on police and fire protection because there will be no additional roads. buildings.
or residents on the property.
6. The Board has reviewed the requirements of Ordinance Z-160, Section 21.3 (1-25) as they
relate to this Special Use, and does not find that those criteria prevent the granting of the Special
Use:
(1) Topography: The topography ofthe property issuch that portions lie in the floodway
. fringe: there will be no improvements constructed on the property which will be threatened
by flood waters.

The particular physical suitability ofthe premises in question for the proposed Special Use.
There are currently existing mineral extraction operations on the adjacent property to the
north. on the adjacent property to the east. and on the property to the south: portions ofthe property
are in a flood way fringe. making normal development ofthe property more difficult: there exist sand
and gravel deposits on the premises that do not exist in most other portions of Clay Township.

lY community and its anticipated effect on surrounding property.
The artificial lake resulting from the reclamation of the property. as provided in the attached
Commitments. will increase the property values ofthe adjoining residential properties in that those
properties will become lakefront properties: other properties in the vicinity will increase in value to
the extent that the artificial lake is open to the public: the attached Commitments require relocation
ofthe existing adjacent sand and gravel processing facility further from the existing residential areas.

The Carmel/Clay Comprehensive Plan indicates that an Edge between a Residential
Community area and a Regional and Community Employment area passes directly through the
subject property. The General Polices regarding Residential Community areas provide that
"transitions. in scale and density. should occur between residential communities and
community/regional employment areas" and that "in areas where zoning changes are requested. such
transition shall be encouraged and considered as part of the approval process." Mineral extraction
and the resulting artificial lake is a low intensity use and will be an effective transition.
In addition. the Land Use Plan indicates a High Intensity residential community designation
directly to the southwest of the subject property. along the same Edge. The proposed mineral
extraction and artificial lake use will be a less obtrusive and lower intensity transitional use.
The property directlv south and across 106th Street from the subject property is designated
as a Low Intensity Regional and Community Employment area on the Land Use Plan. The General
Policies regarding Regional and Community Emplovment areas provide for "industrial uses" which
includes mineral extraction. The Low Intensity Regional and Community Employment area Policies
provide "low intensity commercial developments should be buffered from residential communities
through the existence of. . . open space." The artificial lake will result in an open space buffer

between the existing residential community to the north and the Regional and Community
Employment area to the south.

Martin Marietta Materials, Inc. requests a Special Use for surface sand and gravel extraction
and creation of an artificiallak:e on the portion ofthe "Mueller Property" located north of 106th Street
and described on the attached Exhibit A. (See also the accompanying application for a Variance
from the Development Standards.)
A. The Mueller Property is currently in an S-1 residential district. Section 5.2 of the
Carmel/Clay Zoning Ordinance ("Ordinance") establishes that "Mineral extraction, borrow pit, top
soil removal and their storage" is a permitted Special Use in this district; also an "Artificiallak:e or
pond" is a permitted Special Use in this district.
B. This portion of the Mueller Property is partially located in a Floodway Fringe. Section 21.6
ofthe Ordinance establishes that written approval from the Indiana Natural Resources Commission
must be obtained prior to the grant of a Special Use. The Indiana Department of Natural Resources
("DNR") has determined that the project area does not lie within the 1 OO-year floodplain of the Blue
Woods Creek or the White River and that approval of the DNR is not required, per the attached
Floodplain Analysis.
