Petitioner: FINDINGS OF FACT. SPECIAL USE 1 . The premises in question is particularly physically suitable for the proposed Special Use because: Adequate parking is available. Location is already a multi-tenant commercial center. Amount of space is adequate to provide care. Compatible medical facilities are in the area. Th'~ Special Use will not inju~i~usly or~d'versely affect economic factors, such as ~st/benefit to the community and its anticipated effect on surrounding property values because: It will be beneficial to area citizens to have a dialysis center providing life-sustaining healthcare to the area. - We are a national. welI-~stablished company. ~'~C".,'-" ' .. The Special Use will be consistent with social/neighborhood factors, such as compatibility with existing uses and those permitted under current zoning in the vicinity of the premises under consideration and how the proposed Special Use will affect neighborhood integrity because: - There are a number of other medical facilities in the same area. The Special Use will not injuriously or adversely affect the adequacy and availability of water, sewage and storm drainage facilities and police and fire protection because: We are one tenant utilizing four suites, we will therefore anticipate using fewer utilities than four tenants ~ ..-,..-........... -....---..-.-.-... The Special Use will not adversely affect vehicular and pedestrian traffic in and around the premises upon which the Special Use is proposed because: 5. We have a parking plan in place that will accommodate traffic. 6. The Board has reviewed the requirements of Ordinance Z-160, Section 21.03 (1-26) as they relate to this Special Use, and does not find that those criteria prevent the granting of the Special Use: DECISION IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Special Use Docket Number is granted, subject to any conditions stated in the minutes of this Board, which are incorporated herein by reference and made a part hereof. Page 8 of 8 - z:\shared\lorms\BZA applications\ Special Use Application rev. 12/29/2006 u The Carmel/Clay Advisory Board of Zoning Appeals Docket No. 07070021 Statement of Variance Petitioner, Total Renal Care, INC., seeks a special use to allow for a medical dialysis clinic in compliance with Appendix A Use table permitting a medical clinic, in zone B8 in a commercial retail building. u u -- u u u The Carmel/Clay Advisory Board of Zoning Appeals Docket No. 07070021 SU Statement of Support In support of the requested special use, Total Renal Care, Inc., a division of Davita, Inc., notes that approval of the special use will not be injurious to public health, safety, morals or general welfare of the community as no illegal, immoral or activities endangering the community will take place. In fact, Total Renal Care will be a benefit to public health by providing life-sustaining dialysis care to chronic kidney patients, in a safe and accessible environment. Total Renal Care, Inc. and Davita, Inc. are established and responsible corporate citizens, participating in community activities and serving the public with its over 1200 dialysis centers across the country. The clinic location at Hunters Run Shopping Center will be consistent with other healthcare facilities located in the area, as the doctor's and dentist's office along Medical Drive and Medical Court and Rangeline Road are very close. We will use less utilities and other public resources than would be the case if three or four smaller businesses used the space. There will be no negative impact on pedestrian or vehicular traffic, and we will have minimal impact on the parking, as there are plenty of under-utilized parking spaces available at the center We look forward to the Board approving our requested special use and getting underway.
