EXPLANATION OF
REQUEST
The Applicant, Irwin Union Realty Corporation ("Irwin Union"), previously
obtained ADLS and Development Plan approval from the Plan Commission on July 17,
2007 for a bank building to be constructed upon a parcel of real estate that is located at
the southeast intersection of Carmel Drive and City Center Drive. The lot is located
within the Carmel Science and Technology Park and the underlying zoning is M-
3/Manufacturing.
Irwin Union is seeking a variance from the BZA Hearing Officer for permission
to construct a ground sign within the right-of-way of City Center Drive. Based on the
existing roadway width for City Center Drive and the additional, unused right-of-way
area for City Center Drive, absent the variance to construct the ground sign within the
right-of-way, the ground sign would be set back a considerable distance from the adjacent
roadway and would be difficult for passing cars to see. By locating the ground sign
within the right-of-way, it will provide passing cars with ample notice and enough time to
locate the ground sign and the entrance to the bank, which in turn, should assist in
promoting traffic safety.
The following exhibits are included within this brochure which further explain the
request:
A. Exhibit 2 - Aerial photographs - The first exhibit is an aerial photograph of
the real estate in the context of the Carmel Science and Technology Park. The
second aerial photograph is a closer perspective of the lot in question with the
site plan superimposed onto the aerial photograph. The purpose of these two
(2) aerial photographs is to demonstrate the significant amount of pavement
width and unused right-of-way for City Center Drive that exists adjacent to
the parcel in question.
B. Exhibit 3 - Site Plan - This exhibit is the approved site plan for this project
whereby the location of the proposed ground sign has been higWighted in
yellow.
C. Exhibit 4 - Rendering of Proposed Ground Sign - This exhibit is a rendering
of the proposed ground sign. The Plan Commission, on July 1 ih, approved the
design of this sign. The variance is required in order to locate this ground sign
in right-of-way.
D. Exhibit 5- Proposed Findings of Fact- This exhibit is the proposed fmdings
of fact for this variance request.
We look forward to presenting this matter to the BZA Hearing Officer at the August
27th Hearing Officer meeting.

FINDINGS OF FACT - USE VARIANCE
4. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because the proposed ground sign that is the subject of the variance
request would still be set back an appropriate distance from the adjacent roadways and would not
obstruct the vision of drivers driving along the adjacent roadway. As a result, the granting of this
variance will not be injurious to the public health, safety, morals and general welfare of the
community.
5. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because the variance applies to location of a ground sign and the
surrounding properties are zoned manufacturing and business and, as a result, would not be
adversely impacted by the granting of this variance.
6. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property due to the fact that Petitioner will be prevented from utilizing
ground sign that is an appropriate location and is designed to provide notice of the business
location to its customers.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that
Variance Docket No. 07070027V is granted, granted subject to any conditions stated in the
minutes of this Board which are incorporated herein by reference and made a part hereof.
