EXPLANATION OF SIGN VARIANCE REQUEST
The Applicant, House Investments ("House"), previously obtained ADLS and
Development Plan approval from the Plan Commission on July 17,2007 for an office
building to be constructed upon a parcel of real estate that is located at 10250 Illinois
Street, which is located south of 106th Street and west of US 31 !Meridian Street. The real
estate is zoned B-1 Business and the parcel is approximately 1.187 acres in size.
House is seeking a variance from the BZA Hearing Officer for permission to
construct an additional tenant wall sign on the building. Pursuant to Carmel's Sign
Ordinance, only one (1) tenant wall sign is permitted on a building with only one (1)
frontage adjacent to a public roadway. However, the building that the Plan Commission
previously approved will contain two (2) tenants. The proposed second tenant wall sign
will comply with the size requirements for such signs and will not be illuminated. Absent
approval of the variance request, the second tenant will not be able to provide notice of
its location to its customers via a sign on the building facade.
The following exhibits are included within this brochure which further explain the
request:
A. Exhibit 2 - Aerial photographs - The first exhibit is an aerial photograph of
the real estate in the context of overall office park. The second aerial
photograph is a closer perspective of the lot in question with the site plan
superimposed onto the aerial photograph.
B. Exhibit 3 - Site Plan - This exhibit is the approved site plan for this project.
C. Exhibit 4 - Rendering of Proposed Tenant Wall Sign - This exhibit is a
rendering of the proposed tenant wall sign. The Plan Commission, on July
1 ih, approved the design of this sign. The variance is required in order to
locate this second tenant wall sign on the building.
D. Exhibit 5- Proposed Findings of Fact- This exhibit is the proposed findings
of fact for this variance request.
We look forward to presenting this matter to the BZA Hearing Officer at the August
27th Hearing Officer meeting.

FINDINGS OF FACT - USE VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because the proposed additional tenant wall sign that is the subject of the
variance request would not be illuminated and would only be one (1) additional wall sign on the
building fayade. As a result, the granting of this variance will not be injurious to the public health,
safety, morals and general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because the variance applies to the placement of only one (1)
additional tenant wall sign on the building fayade and the underlying zoning is B-1 Business, which
permits the proposed use of an office building. The proposed building is part of an overall office
park development, and, as a result, the granting of the variance would not have an adverse impact
on the area adjacent to the property.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property due to the fact that Petitioner will be prevented from utilizing
an additional tenant wall sign on the building fayade, which would be an appropriate location and is
designed to provide notice of the tenant's business location to its customers.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that
Variance Docket No. 07070026V is granted, granted subject to any conditions stated in the
minutes of this Board which are incorporated herein by reference and made a part hereof.
