Proposed Findings of Fact for various sign variance requests u u U D U D U D U D U U D U D U U U U EXPLANATION OF SIGN VARIANCE REQUESTS The applicant, Thomson, is a long time corporate partner and business within the City of Carmel. Thomson is undergoing a transition whereby they are relocating their existing offices from the main corporate building to another building within the same office park. This office park is located west of US 31/Meridian Street and south of and adjacent to 103rd Street. The common address of the office building is 10330 North Meridian Street. The underlying zoning for the property is B-lIBusiness and the parcel is approximately 10.93 acres in size. As part of this relocation, Thomson desires to construct upon the various building facades new wall signage to replace the existing wall signage. The five (5) wall signs that are the subject of the variance requests will include the "Thomson" name and new corporate logo. Because the logo is vertical, it has an impact of the manner in which the square footage for these signs is calculated. Stated differently, a significant portion of the overall square footage for these signs is actually unused space that does not contain any text or logos. However, because the manner in which the square footage of a wall sign is measured pursuant to Carmel's Sign Ordinance (by drawing a "box" around the highest and lowest point of the overall sign), the proposed wall signs are not as big or large as the calculated square footage would suggest. Furthermore, because the building is surrounded by a loop road that is relatively close to the building itself, the calculations for the "permitted" sizes of the various wall signs is also impacted. Included behind Tab 2 of this brochure is an aerial photograph of the site that depicts the location of this loop road in the context of the building. Based on the factors that are considered in calculating the size of a permitted wall sign, if Thomson were not seeking variances for the size of its proposed wall signs, the resulting signs would not provide adequate and proper notice of its business location. Furthermore, such "compliant" signs would not be proportionate to the building facades upon which they would be constructed. Consequently, in order to provide wall signs that will provide adequate and proper notice of Thomson's new offices they are seeking these variances and, the proposed wall signs have been designed to be proportionate to the building facades upon which they will be constructed. Included behind Tab 3 of this brochure are renderings of the building facades that show, to scale, the proposed signs to be constructed and include the overall square footage for each individual sign. We look forward to presenting this matter to the Board of Zoning Appeals at its August 27th meeting. The approval of this variance will not be injurious to the public health, safety, morals and general welfare of the community because the proposed wall sign that is the subject of the variance request would be proportionate to the building fal;ade upon which it will be constructed and has been designed to provide proper and adequate notice of the Applicant's business location. 2. The use and value of the area adjacent to the property included in the variance will not be affected in a substantially adverse manner because the proposed wall sign that is the subject of the variance request is proportionate to the building fal;ade upon which it will be constructed and has been designed to provide proper and adequate notice of the Applicant's business location. Further, the building itself is within an overall office park that contains many other buildings and offices and is not immediately adjacent to any residential homes. Consequently, the granting of the variance would not have an adverse impact on the area adjacent to the property. 3. The strict application of the terms ofthe Zoning Ordinance to the property will result in practical difficulties in the use of the property due to the fact that Applicant will be prevented from utilizing a wall sign on the building fal;ade which is proportionate to the building fal;ade upon which it will be constructed and has been designed to provide notice of the Applicant's business location to its customers. DECISION IT IS THEREFORE the decision of the Cannel/Clay Board of Zoning Appeals that Variance Docket No. 07070061V is granted, granted subject to any conditions stated in the minutes of this Board which are incorporated herein by reference and made a part hereof.
