It is apparent that the site plan has changed.from what was previously reviewed. j The comments from the City review have been satisfactorily addressed with the following exceptions: CONSTRUCTION DRAWING REVIEW COMMENTS, 38. General Comments b. Thank you for making the changes. The language of this policy must be added to a specification sheet on the final construction plans. c. Please provide the requisite storm water/drainage information required by Section 102.02 (xi)(m)of Storm Water Technical Standards Manual on the plan sheets. 39. Sheet C1.0 b. General Note.5'-To clarify this previous,comment,any traffic control devices that are necessary but impacted:by construction must be relocated such that they are still effective. This note seems more to address salvage and reuse of the sign elsewhere on the site. 40. Sheet C1.1 c. Section 501.03 requires manhole`s,for portions of the proposed roof drain system since the pipe size and direction change. The Department suggests installing;a,12”pipe(plastic or reinforced concrete pipe)to,a structure at the cleanout 4 location and then run each of the two 6 inch roof drains into this structure without.combining. A cleanout may be utilized to turn the 6"from the south. 41. Sheet C1.2 b. The piping downstream of storm manhole#3 must be verified for adequate capacity. Thank you for your response. The Department will confirm with Crossroad Engineers. c. Please verify that the proposed impervious area of the site does not exceed the amount of - impervious area anticipated at master planning. Regarding the dumpster enclosure in the front yard of the Clay Terrace Red Robin: Our first reaction on seeing the new dumpster location was that it would require a variance, since locating anything other than the primary structure in a front yard typically does. However, we've combed through our Ordinances and the Clay Terrance PUD, and have found nothing that prohibits it. In fact, our Chapter 25 specifically states that accessory uses (which would include the dumpster enclosure) can be placed in front yards in business districts. So, no variance will be needed. We offer the following comments: GENERAL INFORMATION I. These comments represent the Deparbnent of Engineering's first review of the construction plans for this project. 2. We request that all responses to our comments be provided in writing and be accompanied by a drawing reflecting the requested revisions. Failure to provide written responses may result in the delay of the review process. 3. It is critical that this office be made aware of all modifications made on the plans being re- submitted, particularly if any such changes are considered ''new'' or fiill outside of our previous reviews. Please provide revised plans including all revisions. Please notify us of any changes and specifically state any changes, including changes resulting from Plan Commission, BZA or other committee meetings. 4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage calculations submitted to this office for review. If you have not already done so, please provide a set of drainage plans and calculations to their office for review. We will share Crossroad's comments as they are received. S. Final drawings will not be approved for construction until: a. All Engineering Department and Utility Department and Hamilton County Surveyor issues have been resolved. b. All bonds and performance guarantees are posted. c. All Board of Public Wmks and Safety approvals and any other governing agency approvals (ifrequired) are obtained. d. All off-site easements necessary to install utilities to serve the development are secured. e. Digital files have been submitted. f. All fees have been paid. 6. The Department reserves the right to provide additional comments based upon subsequent reviews. 7. An approved Stmm Water Management Permit is required prior to commencing any earth disturbing activity. 8. An approved right-of-way permit is required prior to commencing any worlc in the public right-of-way. 9. If it will be necessary to relocate existing utility poles, they must be relocated to within one foot of the proposed right-of-way. Costs for such relocations are to be bome by the developer. 10. Compliance with the Thoroughfare Plan includes construction of the improvements prescribed by the Thoroughfare Plan across the frontage controlled by the development (including sections with no access). Credit is typically given towards this commitment for any widening, milling and resurfacing of the perimeter streets. Such requirement shall apply for the Clay Terrace Boulevard frontage only. II. The Department requires that the constnlction drawings be developed in accordance with the City of Cannel digital submission standards and that all required submittals for primary plat, secondary plat, and constnlction drawings be made. The digital files must be submitted to the Department of Engineering prior to the approval of the construction plans. Please contact the City GIS Department for the requirements. 12. Jurisdictions: a. The project site is located within current City of Cannel Corporate Limits. b. Streets and Right of Way - City of Cannel (Clay Terrace Boulevard)JHamilton County Highway Department (14Gb Street). c. Water - City of Cannel Utilities d. Sanitary Sewers - City of Cannel Utilities e. Storm SewerslDrainage - City of Cannel. f. Legal Drains - Hamilton County S\D'Veyor's Office. 13. Drawings submitted for approval: a. The design engineer must certify all drawings submitted for final approval. b. This office will require a minimum of 5-sets of drawings for approval after all issues have been resolved. The drawings will be stamped as approved and signed by the City Engineer and by Carmel Utilities. The Owner will receive l-set which must be maintained on the construction site at all times. If additional approved sets are desired, we will approve a maximum of2-additional sets. However, the additional sets must be submitted with the required minimum 5-sets. 14. Cannel Utilities will provide separate reviews of this project for water and sanitary sewer issues. Board of Public Works and Safety meeting dates and agenda deadlines BOARD OF PUBLIC WORKS AND SAFETY 17. Please use the Engineering Deparbnent deadlines for submissions to the Board. 18. Any submission to the Board requires prior approval by the Carmel Clay Plan Commission and/or the Board of Zoning Appeals (if appDable) and completion of review by the Technlal Advisory Committee. AU written requests to be plaeed on the Board's agenda must inelude the appropriate Boeket Number and the date (or dates) of approval by the Plan Commission anel/or the Board of Zoning Appeals (if appDable). 19. Water and Sanitary Sewer Availability (EDU) approval from the Board will be required and is based upon the total number of seats, including both inside and outside seating. Reference item #34-37 below for a more detailed explanation. If an inigation system is planned for this development, approval for additional Water Availability must be obtained from the Board. 20. Commercial Curb Cut Approval- It does not appear that this will be applicable to this project and will not require BPWS curb cut approval. Temporary Construction Entrance approval is required if the location is at a site other than the location of the proposed permanent entrance to the development. However, it appears that this approval is not applicable to this project since the access for the temporary construction entrance is from a private street. 22. The installation of any permanent, privately owned and/or maintained improvement (signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or dedicated easements requires the execution of a Consent to Encroach Agreement between the Owner and the City of Carmel. Such agreements are executed by the Board of Public Works and Safety. The City Engineer may approve ilTigation system agreements. 23. Secondary Plat approval if applicable. All performance guarantees must be posted prior to submission of secondary plats for Board of Public Works and Safety approval. 24. Dedication of Right of Way if not platted. 25. Any open pavement cuts of Clay Terrace Boulevard. BONDING REOUIREMENTS 26. Upon initial review, it appears performance guarantees shall be provided for the following: a. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda Foley, Engineering Department Stormwater Administrator, for details regarding engineer's estimates/performance guarantee requirements for these items. 27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate for l000At of the cost of labor and materials to construct the individual improvements, to be provided by the design engineer. Please provide detailed Engineer's Estimates for each improvement including quantities, unit costs, pipe sizes and materials, etc. 28. Upon completion and release of individual Performance Guarantees, a three-year Maintenance Guarantee will be required. The Maintenance Guarantee amount is based upon 15% of the Performance amount for Streets and Curbs and 10% of the Performance amount for all other improvements. 29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable Letters of Credit. 30. Please reference the enclosures for more detailed explanation of our procedures. RIGHT OF WAY PERMIT AND BONDING 31. Any work in the dedicated right of way of Clay Terrace Boulevard will require an approved Right of Way Permit and a License &, Permit Bond. 32. The bond amount is determined by the number of instances of work in the right of way at $2,000.00 per instance. However, if the work is included in the scope of work ofa required and posted Performance Guarantee, the Performance Guarantee may be used to satisfy the bond requirements of the Right of Way Permit. 33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way permitting and bonding. AVAILABILITY AND CONNECTION FEES 34. The Connections Fees are current as of this date but are subject to fUture revisions. 35. Availability (acreage) Fees were paid with the initial approval and development of Clay Terrace and are not applicable to this project. 36. Water and Sanitary Sewer Connection (BOU) Fees have never been paid for this site. Also, Water and Sanitary Sewer Availability (BOU) approval from the Board of Public Works and Safety has not been granted. Connection Fees are paid prior to the pre-submitta1 meeting with our Building Code Services Department. Please provide this office with a listing of the total number of seats, both inside and outside, planned for this restaurant (and lounge if applicable) facility. EOUs are calculated at the rate of 0.10 EOU per seat. a. The current Water Connection Fee is $1,310.00 per EOU. b. The current Sewer Connection Fee is $795.00 per EOU. If an inigation system is planned for this development, additional Water Connection Fees will be assessed based upon the size and usage of the system and upon the recommendations of the Director of Carmel Utilities. Additional Water Availability approval from the Board of Public Works and Safety will also be required. CONSTRUCI'ION DRAWING REVIEW COMMENTS 38. General Comments a. This project is subject to the City's Storm Water Manangement and Storm Water Quality Ordinances. The Department acknowledges that the storm water management system was previously master planned. b. The City has adopted a new curbing policy. Please revise any notes, specifications, and details to accommodate this policy. The language of this policy must be added to a specification sheet on the final construction plans. c. Please provide the requisite storm water/drainage information required by Section 100 of the Storm Water Technical Standards Manual on the plan sheets. d. Are any walk closures required? Such closures require Board of Public Works and Safety approval. e. Is any work proposed in the right-of-way? Such work requires a proper permit prior to the start of any work. 39. Sheet Cl.O a. Item #3, Utility Information Under Sewer Service, revise from Clay Township Regional Waste District to Carmel Utilities. Under Electric Service, revise from Indianapolis Power &. Light to Duke Energy. b. General Note S - Any traffic control devices necessary for proper traffic control shall be relocated. These cannot be taken down and re-erected at a future date. c. Add General Note 10 as follows: All paving within the existing and proposed City right- of-way shall conform to the requirements of the Department of Engineering. Please add a note to the drawings that the Contractor shall contact the Department of Engineering to schedule a pre-construction meeting to review the Department's construction requirements, staff notification requirements, required inspections for certain stages of the work and to review the authority of the Department as it relates to work within the existing and proposed City right-of-way. d. Add General Note II as follows: No earth disturbing activity may commence until a storm water management permit is obtained. 40. Sheet CI.l a. Please identitY/labe1 the right of way lines for both 146* Street and for Clay Terrace Boulevard. b. The word "path" as in "bike path" is misspelled in two places on this sheet. c. The storm system cleanouts shall be structures per the Storm Water Technical Standards. d. If the on-site storm system is to be maintained by the City; doghouse structures are not accepted. e. Utility Notes 5-7 - If system is to be maintained by the City, these notes must conform to the standards established in the City's Storm Water Technical Standards. f. I have reviewed the drawings submitted for the March 21, 2007 Technical Advisory Committee meeting and offer the following comments: ALTERNATIVE TRANSPORTATION REVIEW COMMENTS The comments from the Alternative Transportation review have been satisfactorily addressed. It is critical that this office be made aware of all modification made on the plans being re-submitted, particularly if any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans indicating all revisions.
