Dear Diana:
Since my earlier letter, Fifth Third has received approval of its development plans from
the CarmeVClay Plan Commission and has submitted its construction plans to the State of
Indiana for approval, which should be received in less than two weeks. At that point we will be
ready to obtain our building permit from the City of Carmel. With the situation of the Target
sign unresolved, we have been told by the City that there will be delays in obtaining either the
building permit or the required sign permits. Thus, Fifth Third is quite anxious to work out some
resolution to this matter.
As we discussed, the two possibilities are obtaining a variance for an off-site sign from
the CarmeVClay Board of Zoning Appeals or converting the sign into an integrated center sign
by adding sign panels for the other two outlots. As it stands now, Fifth Third's application for
building or signage permits will likely bring this matter to a head, resulting, we are told, in the
City issuing a notice of violation to Target for this sign.
We would appreciate hearing something from you yet this week.

Per the TAC meeting I am forwarding you the cut-sheets for the exterior lighting. There
are (3) different fixtures: pole. ground mounted "up" lights, and the fixture used at the
drive-thru.
Also, I will Include 11X17 copies of the footcandle level drawing in each packet. The
drawing will have an outline showing the extent of the .3 footcandle level. Please let me
know if you need any additional information.

The technical review and comments are intended to evaluate the completeness of the erosion and sediment control plan for the
project. The erosion and sediment control plan submitted was not reviewedfor the adequacy of the engineering design. All
practices included in the plan, as well as those recommended in the comments should be evaluated as to their feasibility by a
qualified individual with structural practices designed by a qualified engineer. The plan has not been reviewed for local, state,
or federal permits that may be required to proceed with this project. Additional information, including design calculations may
be requested to further evaluate the erosion and sediment control plan.
The erosion and sediment control plan has been reviewed and it has been determined that the plan:
Satisfies the minimum requirements and intent of 3271AC 15-5 (Rule 5). Notification will be forwarded to the
Indiana Department of Environmental Management.
Refer to the comments section for additional information.

criteria, standards, and specifications outlined in the "Indiana Handbookfor Erosion Control in Developing Areas" from the

the above-mentioned project. Atter reviewing the plans the Highway Department has the following
comments:
1. Any work to be performed within the right of way of Retail Parkway will require permits from
the Highway Department. Before any work Is scheduled. please contact the Highway
Department If permits are needed. It appears at this time no permits will be needed.
2. Please note on the Landscaping Plan that decorative signs. sprinkler systems, trees,
landscaping mounds, light poles or other such amenities are not permitted in the right of way.

Hello everyone:
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the May 22nd TAC meeting. Please feel free to copy and distribute this email or
attach it to your meeting minutes. We have also created a new page on our website linked
to the "Construction" page where we have posted all CTRWD TAC comments from 2001 and 2002
meetings held to date. We will continue to add to this page every month so please let
everyone know they can view our comments online now too.
Village of West Clay Commercial Building No. 2
Our comments remain the same from last month: District specifications should be added to
the plans. The plans are not clear as to the location of the sewer connection. Building
permits should NOT be issued unless the District has issued connection permits. The
developer needs to submit current plans to the District for review.
Village of West Clay, Section 3004, Block C, Townhomes
The plans received by the District only show the mainline sewer for the development but
there must be individual connections for each unit in each building in case these are sold
as condominiums. Revised plans need to be submitted showing each building with its own
individual connection to the District's sewer along with an address list for permits and
inspections. Building permits should NOT be issued unless the District has issued
connection permits.
West Carmel Center Block D, Lot 2 - 5th 3rd Bank
The plans show a questionable connection to sanitary sewers along US 421. The project
developers will need to consult with the District as to the appropriate lateral connection
point which may be within the West Carmel Center development, not along US 421. In any
event, the District will not allow a direct connection to the main along US 421 which
appears to be represented on the plans we received. Building permits should NOT be issued
unless the District has issued connection permits.
Hayden Run Section 2
The District has received plans but it is unclear whether the developer has sent a set to
the District's consulting engineers at Samuel L. Moore & Associates for review. Please
have the petitioner do so if they have not already.
Hamilton Crossing Building No. 5
It was our understanding that this project had been abandoned. As such, the District needs
current plans to review, so please advise the developer to provide plans. Building permits
should NOT be issued unless the District has issued connection permits.

Dear Jon:
As a follow-up to our meeting with Fifth Third's architects on Tuesday, I have reviewed the
Operation and Easement Agreement ("OEA") for Block D of West Carmel Center as it pertains to shared
parking and access. Section 2.1 (A) of the OEA provides that "each Party hereby grants and conveys to each
other Party for its use and for the use of its Permittees, in common with others entitled to use the same, a
non-exclusive easement for the passage and parking of vehicles over and across the parking and driveway
areas of the grantor's Tract. . . ." Also, Section 2.1 (B) of the OEA provides that "the Parties hereby grant
and convey to each other Party for its use and for the use of its Permittees, in common with others entitled
to use the same. . . a non-exclusive, perpetual easement for the passage and accommodation of pedestrians
and vehicles (but not for parking purposes) upon, over and across that portion of each grantor's Tract
designated on the Site Plan as the Permanent Access Drive. . . ." "Party" is defined in Section 1.13 and
"Permittee" is defined in Section 1.14.
The above portions of the OEA create the necessary shared parking arrangements we discussed on
Tuesday. This should permit Fifth Third to provide both the five (5) foot buffer required on Target's side
ofthe common property line, as well as Fifth Third's similar buffer, as indicated on the preliminary plans.
In addition, these provisions will allow the northerly access point to the Fifth Third parcel to be located
through the adjacent outlot, as discussed, which will align with the Target parking layout. By copy of this
letter, I will ask Jeff Klump to provide a revised sketch indicating this access arrangement for your review.
Let me know if the above reasoning conforms with the matters discussed on Tuesday. Thanks for your
assistance.

RE: 5/3 Bank - US 421: Initial Review
Dear Mr. Klump:
This letter is in response to the plans we reviewed for the proposed 5/3Bank at the northeast comer of US 421 and
Retail Parkway. The following conunents need to be addressed and/or plans/applications updated accordingly:
General:
1. A Replat for Block D of West Carmel Center must be submitted. This will require signature by all owners
of real estate within the Block. The one-acre parcel is not currently recognized by the Zoning Ordinance as
a legal parcel. This application can be submitted prior to or concurrently with the Development Plan
Amendment.
Development Plan Amendment:
1. Redraw 60' Building setback Line along Retail Parkway to follow right-of-way contour.
2. Section 23C.8.3 requires a 15' rear yard setback. The Canopy portion of the building must meet this
setback (revise plans accordingly).
3. The minimum parking requirement is one space per 300 square feet of gross floor area. 27 spaces have
been provided. The minimum parking requirements have been greatly exceeded. If necessary the four
spaces along US 421 could be deleted and the building moved forward to meet the 15' rear yard
requirement.
4. We will administratively approve the drive-thru layout. As we discussed the ordinance required stacking
for five vehicles for teller window(s). We will consider the provision of four teller lanes with stacking for
four cars per lane as meeting this requirement.
5. As we discussed individual access will not be permitted onto Retail Parkway. (revise plans accordingly)
This is an area where you could gain additional parking spaces.
6. Display Target site improvements on site plan. The drive aisles within the target site shall align with access
into this site. We have concern with the drive access located in close proximity to Retail Parkway. Drivers
waiting at the entrance to turn left into the site may block the drive. Provide a detail of the drive on the
Target site.
7. Access shall be provided between this site and the adjacent outlot. A conunon ingress/egress may be
considered.
8. Display all improvements within the right-of-way.
9. The minimum building base planting width for the side of the building facing US 421 is 10'. All other sides
of the building require a minimum of 5' in width.

The minimum building height is 20' measured at the roofline. This applies to all portions of the
building. Avoid long uninterrupted roof planes. I would encourage a two (2)-story design. A I Yz-story
design is required. I need additional elevations to fully evaluate the proposed design. However,
modifications are necessary for the proposed building to meet the minimum specifications.
Additional attention needs to be paid toward section 23C.9 regarding Architectural Design
Requirements. It is my understanding based on our conversations that Target may have placed some
unrealistic restrictions on this outlot area. Height restrictions specifically. We should discuss this
further. Submit to us a copy of any covenants or restrictions on the property.
Submit Landscape Plan.
Submit lighting plan to illustrate property lines and meet maximum of 0.3 footcandles at all property
lines.

All signage will require approval by the Plan Commission.
The site is permitted two signs based on the frontage. These signs must face the subject frontages.
Based on the setbacks and building frontage a sign on the south elevation could be 80 square feet in
area and a sign on the west elevation could be 75 square feet in area.
A sign on the north elevation would require a variance.
A sign for the Target exists on the parcel today. Locate this sign on the plans. With subdivision of the
parcel the ground sign would no longer be located on Target site. Off-premise signs require a variance
from the Board of Zoning Appeals.
