11. Docket No. 07040022 PP: Justus Business Park, lots 1-2
The applicant seeks primary plat approval for 2 lots on 7.298 acres.
The site is located at the southeast comer of 136th St. and Pro Med Ln. and is
zoned B-6/Business within the US 31 Overlay.
Filed by Paul Reis of Bose McKinney & Evans for Justus Home Builders.
The petitioner seeks Plan Commission approval to divide a parcel into 2 lots. Lot] will be 2.651
acres, and Lot 2 will be 4.647 acres, to total 7.298 acres. Approval of this commercial
subdivision will give Justus the option of selling the land not used for their proposed office
development to another party for development. The site is bordered by Pro Med Lane and
Smokey Row Road. Kensington Place is to the east of the site. Please see the petitioner's
informational packet for more detail.
The following are outstanding issues/concerns from DOCS:
1.) The petitioner should provide Engineering Dep't approval updates.
2.) The petitioner should provide Landscape Plan approval updates. Scott Brewer, City
Forester, has not seen revised plans yet.
3.) Provide a copy of proposed covenants/restrictions for this subdivision, if applicable.
4.) Due to time constraints, Engineering Dept and Landscape Plan approval
comments/concerns will be provided by Staff at the hme 28 Committee meeting.
After all questions/concerns have been addressed, the Department of Community Services
recommends the Special Studies Committee forward this item to the full Plan Commission
with a favorable recommendation.

12. DockeLNo. 07040023 UP Amend/ADLS Amend: Justus Business Park, lot 2-
Justus Office Building.
The applicant seeks site plan &design approvaL for an office building. The site is located southeast of
136th St. and Pro Med Ln. and is zoned B-6fBusiness within the US 31 Overlay. Filed by Paul Reis of
Bose McKinney & Evans for Justus Home Builders.
The petitioner seeks site plan and design approval for an office building. This proposed otTice buiLding
is very similar to the office bUilding presented with the Jackson Square PUD (Planned Unit
Development) rezone (Docket No.s 05020038 Z and 05020039 DP/ADLS), which was approved by the
Plan Commission in 2005, but was ultimately denied by City Council in JuLy 2005. Now, the only major
difference is that town homes are no longer proposed, the office buildmg location has shifted east, closer
to Kensington Place, and the building architecture has been modified slightly. The office building design
is the same, but the building has increased about 10,000 square feet, and a walkout basement level has
been added. The site is currently zoned B-6 Busmcss, which permits office land uses. No rezone is
required for this office building proposal. Per conunitments recorded with the land when the original B-6
rezone was approved, a 50-ft tree preservation area will be maintained along the east property line. Also,
bio retention areas and some permeable pavement will be utilized to make the site more environmentally
friendly. Please see the petitioner's informational packet for more detail on the site plan and building
elevations.
Currently, no variance requests will be sought from the Board of Zoning Appeals.
At the June 19 Plan Commission meeting, the following issues/concerns/requests were made:
1.) Two 'green' parking spaces for hybrid cars were requested from one PC member, but not requested
by another. Providing 1\'1/0 'green' parking spaces is NOT required by the ordinance. It is only a
request and an opportunity to go above and beyond what the ordinance requires.
2.) There was a request for the path that connects the north side ofthe building to the I O-ft pedestrian
path along Smokey Row be constnlctedin a way to take down or interfere with as little trees as
possible. The petitioner was instructed to contact David Littlejohn, Transportation Systems
Coordinator, for some options.
3.) A request was made in regard to the sidewalk at the southwest comer of the site, to either make
better use of that walkway or possibly stub out to the street to provide some sort of connectivity.
4.) A request was made to provide a white roof and sky lights to provide some 'green' building design.
The following are outstanding issues/concerns from DOCS:
1.) The petitioner should provide Engineering Dep't approval updates.
2.) The petitioner should provide Landscape Plan approval updates. Scott Brewer, City Forester, has
not seen revised plans yet.
3.) A traffic study may be required.
4.) Due to time constraints, Engineering Dept and Landscape Plan approval
comments/concerns will be provided by Staff at the June 28 Committee meeting.
After all questions/concerns have been addressed, the Department recommends the Special Studies
Committee forward this item to the full Plan Commission with a favorable recommendation.
