Angie,
I have reviewed EMH&T's response to the remonstrance. You should have recived this by fax this morning; just before
lunch.
The majority of the comments are not related to Engineering; however, several of the comments require input from the
Department.
Bio-Retention Area:
EMH& T outlines the Departments understanding of the proposed drainage plan in that the system, overall, is intended to
sheet flow into bio-retention areas and vegetated swales, infiltrate through permeable media and into an under drainage
system. The under drainage system will collect and discharge the water south to the existing detention pond. It is unclear
if these systems will be "sealed" and completely prevent water from percolating into the groundwater. As water typically
seeks the path of least resistance, the Department would expect the majority of this water to be discharged through the
under drainage system. The Department could review the need to "seal" the system as the construction plans are
developed.
Permeable Pavement Areas:
There is one area of permeable pavement area that is presently indicated to discharge to the existing storm piping
network in Kensington Place. The Department is researching if these pipes are public or private. The inlet to which the
permeable pavement area will discharge presently receives surface runoff from the northern area of the proposed
development. In the post-developed condition, the proposed watershed draining to this inlet would be significantly
reduced.
Retaining Wall:
The Department has commented the same as Mr. Doxater as it relates to the location of the retaining wall. EMH& T has
responded to this question in the response letter issued this morning.
Traffic Considerations: -,
The Department's comments related to the traffic study have been previously issued. The office use is consistent with the
surrounding uses and overall contemplated uses for Pro-Med Park. Thus, it is not expected that this use will generate
traffic in excess of what was contemplated when Pro-Med Park was approved in the mid 1990's. The Department thanks
Mr. Doxater for the summary that was developed and will consider this growth in the area as future plans are developed
for 136th Street and the Guilford/Old Meridian/136th Street intersections.

Dear Mr. Duncan;
The following respohse is offered to the.comments contained vvithin a letter provided to
EMH&T by your office on July 16, 2007 as prepared by Mr. Gary D. Doxtater entitled
"Justus Office Business Park - Comments on Application." We understand that your office
receive~ this letter on July 5,2007. The following responses to Mr. Doxtater's comments are
offered:
Bioretention Area:
Carmel's drainage ordinance requires treatment of stonnwater runoff for removal of
pollutants prior to discharge 'from a developed site. Bioretention is an approved Best
Management Practice (BMP) under the ordinance. Preliminary drainage calculations for the
. design of the bioretention systems are included in the "Initial Drainage Report for Justus
Office Building at Justus Business Park" as prepared by EMH&TI dated April 19, 2007 and
submitted to the Carmel Engineer's Office on April 30, 2007. The bioretention facilities will
include a perforated underdrain system to collect infiltrated runoff and convey it to the storm
sewer system in Pro~Med Lane and ultimately to Meadowlark Lake.
Permeable Pavement Areas:
The development plan proposes the use ofpermeable pavement in two areas on the site.
Permeable pavement allows runoff to infiltrate through the pavement matrix and into a
subsurface stone layer and underdrain system. Permeable pavement has many benefits
including reduction of pollutants and attenuation of peak flow rates for storm water
discharges. The surface area and runoff quantity associated with each area of permeable
pavement is identified in the "Initial Drainage Report for Justus Office Building at Justus
Business Park" as prepared by EMH&T, dated April 19, 2007 and submitted to the Carmel
Engineer's Office on April 30,2007.

Dumpster Screening and Drainage:
The dumpster will be fully screened by a masonry enclosure. Runoff from within the
dumpster enclosure will be directed to the south bioretention area via sheet flow across the
parking lot.
Proposed Easements:
The 3' Non-access easement (NAE) was required by DOCS to prevent drive connections to
Smokey Row Road.
The 20' drainage easement is necessary to allow for a piped stonn sewer connection to the
existing sewer that runs to Meadowlark Lake.
A 40' Building Setback Line and 40' proposed right-oi-way are shown per zoning ordinance
and per Carmel's Thoroughfare Plan.
Vegetative Swale:
The vegetative swale is an approved BMP which will serve to reduce pollutants from the
building roof as identified in the "'Initial Drainage Report for Justus Office Building at Justus
Business Park" as prepared by EMH&T, dated April 19, 2007 and submitted to the Cannel
Engineer's Office on April 30, 2007. Discharge from the swale will be piped to Meadowlark
Lake.
Landscape Plan:
The Landscape Plan has been approved by Scott Brewer, Carmel Urban Forester.
Lighting Plan:
The lighting and photometric plan has been approved by DOCS.
Tree Preservation BMP's:
. The Tree Preservation Plan has been approved by Scott Brewer, Carmel Urban Forester.
Additional language can be added at the time of submittal of construction plans if Mr.
Brewer desires.
Retaining Wall:
The retaining wall is located outside of the tree protection area. A Tree Preservation Plan has
been approved by Scott Brewer, Cannel Urban Forester. The walls will have footing drains
along the west side. These drains will be piped to the storm sewer system.

Traffic Considerations:
We understand that a traffic study is not required for this project as we discussed'on July 6,
2007 and as you confirmed by email on July 16,2007 (attached for reference).
We look forward to securing approval of the Plan Commission for our ADLSIDP amend and
Primary Plat applications at this evening's meeting and will continue to work closely with the
Engineering Department to ensure all issues are adequately addressed on the final
construction plans for this project.

Confirming our conversation yesterday afternoon;
Regarding item #41,g. of your reView letter dated July 5, 2007, requesting that a traffic study be conducted for the Justus Business
Park/Offlce development, you stated that you intend to rebacl: this requirement from the letter for the following reasons;
1. The Justus proposal currently before the Pl311 Commission is a DP Amendment with the same
office component as previously approved by the Plan Conunission in 2005 formerly know as Jackson
Square. A traffic study was not required as a part of that approval.
2. The office use is consistent with the surrounding uses and overall contemplated uses for Pro-Med
Park. Thus, it is not expected that this use will generate traffic in excess of what was contemplated
when Pro-Med Parkwas approved in the mid 1990's.
3. Ifa traffic study is required, it is lUore appropriately related to the proposed hotel project adjacent to
1he Justus Office parcel since the hotel use mayor may not have been a contemplated use when Pro-
Med Park was originally approved and may generate different traffic patterns than a general office
use.

Comments On Application
Drainage has been and will continue to be a major concern for Kensington place until
development is completed within our watershed. The Primary Plat Application submitted
by Justus does not address this concern. Their dOClUllent, (TAB 11, Primary Plat) shows
the "preconstruction topography" which determines the present surface drainage pattern.
I find no illustration or text addressing the "post construction contours." This must be
shown to determine the fmal surface water drainage pattern. TIrls information will
identi1)1 possible future problems. Is there a formal Drainage Plan that is not included in
the Application? If so, this may have some of these answers.
Bioretention Area: (TAB 3)
This relatively new type of smface water Best Management Practice (BIvfil) is being used
more to reduce the use of large retention ponds. The concept being used here needs more
description because of some of the drainage issues described above. Normally these
types of structures depend upon three ways to handle the surface water runoff. One is
that the wetland vegetation takes up a lot of water which is then released into the air as
part of their respiration. Another is through increased surface area (their leaves) for
water evaporation. Finally, and most important to Kensington Place, is that these
structures also depend on the infiltration of the surface water into the water table below.
There is no discussion as to what happens to the water that leaves these structures. If it
infiltrates into the existing water table, it appears that this storm water would work its
way dovm grade to the Kensington Place properties. All of the townhouse units have
sump pumps and one townhouse has a basement with two sump pumps necessary to
handle the present ground water movement. I would suggest that the consultant retain a
qualified Groundwater Hydrologist to analyze this issue. How many acres are involved
in the two bioretention areas? With this infonnation, one could figure the amoWlt of
water that would be trapped. during a specific storm event. Are they completely sealed
and piped to Meadowlark Lake?

There are two areaS that will use the penneable pavement concept. Where wiU the water
go from these areas? 1 could not find how many acreS are proposed in the two areas
shown at the entrance to the office building and on the patio in the back of the building
next to Kensington Place. This information is needed to predict impacts of the ground
. water on the area. No clear a.nswer was given as to where this water goes.

had approved the Landseape Plan. Needs to be addressed for the following reasons:
1. Conifers provide a year-round screening of the project buildings from the view of
Kensington Place neighbors.
2. The Tree Preservation Area provides an important corridor for deer and other
wildlife species. This winter protection by conifers is very important
The Justus Business Park is adjacent to Kensington Place which was certified in 2005 by
the Indiana Wildlife Federation as a Wildlife Friendly Neighborhood. It was the first one
in the State. In addition, the business park joins the Carmel-Clay Meadowlark Park
which supports a large variety ofwild1ife. The Indiana Wildlife Federation promotes the
Use of native species in landscaping plans. The species list should be reviewed to reflect
more natural native vegetation that will still be pleasing to the landscaping appearance.
The development of the Justus Business Park offers a great opportunity to consider
wildlife in the Justus Business Park campus. The IWF offers several other Wildlife
Friendly certification programs. Justus may consider the programs Wildlife Friendly
Workplace and Wildlife Friendly Development that are described at
under wildlife habitat programs.

Lighting Plan:
Since the Lighting Plan was approved in an earlier application, I hope that it will be
reviewed again to see if any of the changes in the building plans will affect the viewshed
of adjacent Kensington Place neighbors. The lights on 24~ 7 in several existing bildings at
Meadowlark Office Park are causing some nearby Kensington residences some
annoyance. This was Dot addressed in the Special Study
Tree Preservation Area Bl\fP's: (TAB 4) (suggested changesm holded parenthesis)
"All the contractors shall meet with the (Carmel Forester and) Consulting Arborist at
the site prior to beginning work to review aIL work procedures, access and haul roads, and
tree preservation measures. (Tbe Tree Preservation Area fencing and signs sball be
instaDed at tbis time before any construction equipment arrives on site.)"
This was not addressed at the Special Study.
Retaining Wall:
The location of the retaining wall must be placed outside of1he TPA fence; therefore, any
construction activities should not impact the trees and ground vegetation within the TPA.
What are the plans for protecting the Tree Preservation A(ea? Are there any drain tiles
coming out of the retaining walls. If so where is this water coming from and where is it
going? This was not addressed at tbe Special Study.
Traffic considerations:
During the Public Meeting,. I believe there was a concern by one of the Commission
members about traffic issues. I believe it was mentioned that a traffic study was made in
1990, but because of the US 31 plan that INDOT has for this area, no recent studies have
been done so apparently traffic was not considered a problem.
I have been concerned about the Smokey Row, Rangeline, Gilford, Old Meridan and
U.S. 31 existing traffic problems for some time now. I know the traffic is only going to
get worse with the present developments in planning or now undenvay. I submit the
following information, not as a "'traffic study" but as imperica1 data that can be used to
give one and idea of how future development migbt affect the existing traffic proplem.
This analysis makes the assumption that parking spaces is an indicator of potential traffic.

I have been concerned about the Smokey Row, Rangeline, Gilford, Old Meridan and
u.s. 31 existing traffic problems for some time now. I know the traffic is only going to
get worse with the present developments in planning or now underway. I submit the
following information, nul as a "traffic study" but as imperical data that can be used to
give one and idea of how future development might affect the existing traffic proplt:m.
This analysis makes the assumption that parking spaces is an indicator of potential traffic.

The City has received your construction plans dated April 4, 2007 on April 30, 2007. We offer the
following comments:
GENERAL INFORMATION
1. These comments represent the Department of Engineering's fll'St review of the
construction plans for this project at this location. However, a project at this site named
Jackson Square was reviewed for the March 16,2005 Technical Advisory Committee
Meeting. Our review of that project was dated March 25, 2005.
2. We request that all responses to our comments be provided in writing and be
accompanied by a drawing reflecting the requested revisions. Failure to provide written
responses may result in the delay of the review process.
3. It is critical that this office be made aware of all modifications made on the plans being
re-submitted, particularly if any such changes are considered "new" or fall outside of our
previous reviews. Please provide revised plans including all.revisions. Please notify us
of any changes and specifically state any changes, including changes resulting from Plan
Commission, BZA or other committee meetings.
4. We bave engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide a set of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor
(if applicable) issues have been resolved.
b. All bonds and perfonnance guarantees are posted.
c. All Board of Public Works and Safety approvals and any other governing agency
approvals (ifrequired) are obtained.
d. All off-site easements necessary to install utilities to serve the development are
secured.
e. SWPP is approved.
f. Digital Files are submitted.
g. All outstanding fees are paid.
6. The Department reserves the right to provide additional comments based upon
subsequent reviews.

7. An approved Storm Water Management Permitis required prior to commencing any
earth disturbing activity.
8. An approved right-of-way permit is required prior to commencing any work in the
public right-of-way.
9. If it will be necessary to relocate existing utilities or utility poles, they must be relocated
to within one foot of the proposed right-of-way. Costs for such relocations are to be
borne by the developer.
10. Compliance with the Thoroughfare Plan includes construction of the improvements
prescribed by the Thoroughfare Plan across the frontage controlled by the development
(including sections with no access). A commitment equal to the value to construct these
improvements for deposit into the City's non-reverting thoroughfare fund is acceptable
in lieu of the physical construction. This comment would apply to the 136th Street
frontage.
I I. The Department requires that the construction drawings be developed in accordance with
the City of Cannel digital submission standards and that all required submittals for
primary plat, secondary plat, and construction drawings be made. The digital files must
be submitted to the Deparbnent of Engineering prior to the approval of the construction
plans. Please contact the City GIS Department for the requirements.
12. Jurisdictions:
a. The project site is located within current City of Carmel Corporate Limits.
b. Streets and Right of Way - City of Cannel (Pro Med Lane, 136lh Street (Smokey
Row Road)
c. Water - City of Carmel Utilities
d. Sanitary Sewers - City of Carmel Utilities
e. Storm SewerslDrainage - City of Carmel.

13. Drawings submitted for approval:
a. The design engineer must certify all drawings submitted for final approval.
b. This office will require a minimum of 5-sets of drawings for approval after all issues
have been resolved. The drawings will be stamped as approved and signed by the
City Engineer and by Carmel Utilities. The Owner will receive I-set which must be
maintained on the construction site at all times. If additional approved sets are
desired, we will approve a maximum of2-additional sets. However, the additional
sets must be submitted with the required minimum 5-sets.
14. Carmel Utilities will provide separate reviews of this project for water and sanitary
sewer issues. Please assure that copies of all drawings are sent to:

BOARD OF PUBLIC WORKS AND SAFETY
17. I am enclosing a schedule for Board of Public Works and Safety meeting dates and
agenda deadlines for your use. Please use the Engineering Department deadlines for
submissions to the Board.
18. Any submission to the Board requires prior approval by the Carmel Clay Plan
Commission and/or the Board or Zoning Appeals (if applicable) and completion of
review by tbe Tecbnical Advisory Committee. All written requests to be placed on
tbe Board's agenda must include the appropriate Docket Number and the date (or
dates) of approval by the Plan Commission and/or the Board of Zoning Appeals (if
applicable).
19. Water and Sanitary Sewer Availability (EDU) approval from the Board is based upon
the proposed usage of the building. Reference item #34-37 below for a more detailed
explanation. If an irrigation system, restaurant and/or bar/cocktaillounge is to be
included with this development, approval for additional Water Availability (and Sanitary
Sewer if applicable) must be obtained from the Board and additional Water (and
Sanitary Sewer if applicable) Connection Fees will be assessed.
20. Commercial Curb Cut Approval witl be required for the Pro Med Lane curb cut Please
provide 8Yi x 1 I exhibits with your request for Board approval. The exhibits should
include all pertinent data including drive width. drive width at street, radii, opposing
curb cuts, etc.
21. Temporary Construction Entrance approval is required if the location is at a site other
than the location of the proposed permanent entrance to the development.
22. The installation of any permanent, privately owned and/or maintained improvement
(signs, decorative street signs, walls, streetlights, etc.) within dedicated right of way or
dedicated easements requires the execution of a Consent to Encroach Agreement
between the Owner and the City of Cannel. Such agreements are executed by the Board
of Public Works and Safety. The City Engineer may approve irrigation system
agreements.
23. Secondary Plat approval if applicable. All performance guarantees must be posted prior
to submission of secondary plats for Board of Public Works and Safety approval.
24. Dedication of Right of Way if not platted.
25. Any open pavement cuts of Pro Med Lane or of 136m Street (Smokey Row Road). This
would apply to the installation of the sanitary lateral ifit is to be by open cut method.
BONDING REOUIREMENTS
26. Upon initial review, it appears performance guarantees shall be provided for the
following:
a. Public Sidewalks/Asphalt Paths within the dedicated right of way of Pro Med Lane
and 136th Street (Smokey Row Road)
b. Work in rightMof-way, connections to existing infrastructure and right-of-way
improvements. This would include reconfiguration of the existing "bulb", entrance
construction including curbing, water service line connection and portion of lateral in
the right-of-way, sanitary sewer lateral construction in right of way, etc. The on-site
storm sewer system is considered to be a private system.

c. Erosion and Sediment Control and Storm Water Quality. Please contact Amanda
Foley, Engineering Department Storm water Administrator, for details regarding
engineer's estimates/performance guarantee requirements for these items.
27. The amount of the Performance Guarantee is based upon a certified Engineer's Estimate
for 100% of the cost of labor and materials to construct the individual improvements, to
be provided by the design engineer. Please provide detailed Engineer's Estimates for
each improvement including quantities, unit costs, pipe sizes and materials, etc.
28. Upon completion and release of individual Performance Guarantees, a three-year
Maintenance Guarantee will be required. The Maintenance Guarantee amount is based
upon 15% of the Performance amount for Streets and Curbs and 10% of the Performance
amount for all other improvements.
29. Performance Guarantees may be Performance or Subdivision Bonds or Irrevocable
Letters of Credit.
30. Please reference the enclosures for more detailed explanation of our procedures.
RIGHT OF WAY PERMIT AND BONDING
31. Any work in the dedicated right of way of Pro Med Lane or 136th Street (Smokey Row
Road) will require an approved Right of Way Permit and a License & Permit Bond.
32. The bond amount is determined by the number of instances of work in the right of way
at $2,000.00 per instance. However, if the work is included in the scope of work ofa
required and posted Performance Guarantee, the Performance Guarantee may be used to
satisfy the bond requirements of the Right of Way Permit.
33. Please contact our Right of Way Manager, Fred Glaser, to arrange right of way
permitting and bonding.
AVAILABILITY AND CONNECTION FEES
34. The Availability and Connections Fees are current as of this date but are subject to future
revisions.
35. Availability (acreage) and Connection (BDD) Fees must be paid after all other
Engineering Department requirements have been satisfied and prior to pre-submittal and
approval and start of construction activities. Availability Fees are based upon total
platted acreage or legal description acreage for the development at the current rate of
$1,010.00 per acre for Water Availability and $1.365.00 per acre for Sanitary Sewer
Availability. Please provide this office with a legal description of the property.
According to the Legal Description on the Cover Sheet, Sheet CS, the project area is
7.298 acres. Based on this description, tentative Availability Fees are:
Water - 7.298 Acres @ $t,OtO.OO/Acre = $ 7,371.00
Sanitary Sewers - 7.298 Acres fa) $1.365.00/Acre = $ 9.962.00

Sanitary Sewer Connection Fees will be assessed based upon the total number of
seats.
SECONDARY PLAT REVIEW COMMENTS
38. Please identify, label and dimension all existing and proposed right-of-way lines. Please
confirm the existing right-of-way on 136th Street is a 40' half or greater.
39. Please confinn the current right-of-way needs for U.s. 3 I from the INDOT
environmental impact study. The Thoroughfare Plan requires compliance with these
right-of-way needs.
40. Please verify that no other proposed easements overlap the proposed tree preservation
and planting strip easements.
CONSTRUCTION DRAWING REVIEW COMMENTS
4 I. General Comments
a. This project is subject to the City's Stonn Water Management and Storm Water
Quality Ordinances.
b. The City has adopted a new curbing policy. Please revise any notes, specifications,
and details to accommodate this policy. The language of this policy must be added to
a specification sheet on the final construction plans. All curbing on-site must be City
Standard curbing.
c. Please provide the requisite storm water/drainage information required by Section
100 of the Stonn Water Technical Standards Manual on the plan sheets.
d. Please contact Amanda Foley to review storm water qualityltreatment requirements.
Please confirm if inlet protection is needed for the inlets on Pro-Med Lane.
e. For the plan submitted for final engineering department approval, please remove the
landscape plan sheets and site lighting plan sheet from the plans and remove the titles
of those sheets from the Index on the Cover Sheet.
f. Please add a note to each appropriate sheet that reads: "No earth disturbing activity
may take place without an approved storm water management permit."
g. The Deparbnent requests a traffic study be provided that identifies the need for a left
turn for westbound traffic on Smokey Row Road, auxiliary lanes (or modifications to
existing auxiliary lanes) at the Pro-Med Lane entrance and any modifications to the
Old Meridian and Smokey Row Road intersection. Any such needed improvements
shall be the sole responsibility of the developer.
h. Please provide a Maintenance-of. Traffic Plan for the work to remove the "bulb" and
to construct the proposed entrance.
i. The City's Paving Policy needs to be added to a sheet in the plan set.

a. It is our understanding that the correct street name is Pro Med Lane, not Drive.

a. Please add a note that requires existing pavement to be saw cut to a dean edge to the
full depth of the section and existing curbing and walk to be saw cut to the full depth
of the existing walk or curbing at the joint nearest to the removal limits.
b. A concrete apron is required in the right-of-way. Pleasetevise site legend hatching
to require concrete apron in lieu of right-of-way pavement.
c. A depressed curb is required across the entrance unless the existing curb is roll curb.
d. Entrance curbing within the right-of-way shall match the existing curbing of Pro-
Med Lane.
e. Curb return radii shall be a minimum of30 feet.

c. Is the HDPE roof drain header pipe a solid wall or.a perforated pipe? Please indicate
the installation detail for this HOPE pipe. Is it possible to revise the proposed

d. Please verifY that there is no proposed storm sewers or structure in the right-ai-way.

Dear Mr. DeBoy:
The City has received your construction plans dated April 2, 2007 for the April 18, 2007 T AC meeting.
We offer the following comments:
GENERAL INFORMATION
I. These comments represent the Department of Engineering's first review of the construction
plans for this project at this location.
2. We request that all responses to our comments be provided in writing and be accompanied by
a drawing reflecting the requested revisions. Failure to provide written responses may result
in the delay of the review process.
3. It is critical thatthis office be made aware of all modifications made on the plans being re-
submitted, particularly if any such changes are considered ''new'' or fall outside of our
previous reviews. Please provide revised plans including all revisions. Please notify us of
any changes and specifically state any changes, includirig changes resulting from Plan
Commission, BZA or other committee meetings.
4. We have engaged Crossroad Engineers, PC to review all drainage plans and drainage
calculations submitted to this office for review. If you have not already done so, please
provide a set of drainage plans and calculations to their office for review. We will share
Crossroad's comments as they are received.
5. Final drawings will not be approved for construction until:
a. All Engineering Department and Utility Department and Hamilton County Surveyor (if
applicable) issues have been resolved.
b. All bonds and performance guarantees are posted.
c. All Board of Public Works and Safety approvals and any other governing agency
approvals (if required) are obtained.
d. All off.site easements necessary to install utilities to serve the development are secured.
6. The Department reserves the right to provide additional comments based upon subsequent
reviews.
7. An approved Storm Water Management Permit is required prior to commencing any earth
disturbing activity.
8. An approved right-of-way permit is required prior to commencing any work in the public
right-of-way.
9. Ifit will be necessary to relocate existing utility poles, they must be relocated to within one
foot of the proposed right-of-way. Costs for such relocations are to be borne by the
developer.
10. Compliance with the Thoroughfare Plan includes construction of the improvements
prescribed by the Thoroughfare Plan across the frontage controlled by the development
(including sections with no access). A commitment equal to the value to construct these
improvements for deposit into the City's non-reverting thoroughfare fimd is acceptable in
lieu oftbe physical construction. This comment would apply to the 136th Street frontage.

19. Water and Sanitary Sewer Availability (BDU) approval from the Board is based upon the

21. Temporary Construction Entrance appruval is required if the lacation is at a site ather than
the locatian of the propused permanent entrance to the development.
22. The installatian of any permanent, privately awned.andlar maintained improvement (signs,

easements requires the execution of a Consent to Encroach Agreement between the Omler

28. Upan campletion.and release .of individual Perfonnance Guarantees, a three-year

RIGHT OF WAY PERMIT AND BONDING

c. If the facility includes a restaurant andlor bar/cocktail lounge, additional Water and
Sanitary Sewer Connection Fees will be assessed based upon the total nlimber of seats.
CONSTRUCTION DRAWING REVIEW COMMENTS
38. General Comments
a. Please confirm with the Department of Community Services regarding public pedestrian
access and connectivity requirements from both Pro Med Lane and 136lb Street (Srnokey
Row Road).
b. This project is subject to the City's Storm Water Manangement and Storm Water Quality
Ordinances.
c. The City has adopted a new curbing policy. Please revise any notes, specifications, and
details to accommodate this policy. The language of this policy must be added to a
specification sheet on the final construction plans.
d. Please provide the requisite storm water/drainage infonnation required by Section 100 of
the Storm Water Technical Standards Manual on the plan sheets.
e. Please contact Amanda Foley to review storm water quality/treatment requirements.
f. For the plan submitted for Department of Engineering approval, please remove the
landscape plan sheet and remove the title of that sheet from the Index on the Cover Sheet.
g. Please identify, label and dimension aU existing and proposed right-of-way lines. Please
confirm the existing right-oC-way on 1361h Street is a 40' half or greater.
h. Please identify aU public streets (street names) on all applicable sheets. Also darken the
street names to be more readable.
i. Please add a note to each appropriate sheet that reads: "No earth disturbing activity may
take place without an,approved storm water management pennit."
j. The Department understands that Pro.Med Lane is a public Street.
k. Please confirm the current right-of-way needs for U.S. 31 from the INOOT
environmental impact study. The Thoroughfare Plan requires compliance with these
right-of-way needs.

l. Please verifY that the detention was master plarmed. Please verify the downstream pipe
capacity to receive the runoff from this development. Please verify that the proposed "c"
value of this site is no greater than the "c" value anticipated at the time the drainage and
detention system was master planned. Please indicate the lOO-yr flood route from the site
to the ultimate receiving system.
m. The Deparbnent requests a traffic study be provided that identifies the need for a left turn
for westbound traffic on Smokey Row Road, auxiliary lanes (or modifications to existing
auxiliary lanes) at the Pro.Med Lane entrance and any modifications to the Old Meridian
and Smokey Row Road intersection. Any such needed improvements shall be the sole
responsibiiityofthe developer.
39. Sheet CS
a. Revise the Sanitary Utility Contacts on the Cover Sheet from Clay Township Regional
Waste District to City of Carmel Utilities.
b. The Vicinity Map and Location Map both indicate an inaccurate location of the
development. What does the arrow represent on these two maps?
c. Please darken the street names and add U.S. 31 to proposed site.
d. It is our understanding that the correct street name is Pro Med Lane, not Drive.
40. Sheet Cl.O
a. Please confirm with the urban forester that the tree removal plans are acceptable.
b. Please revise keynote 2 to require pavement to be saw cut to a clean edge and curbing to
be saw cut at the joint nearest to the removal limits.
c. Are there any existing inlets in the vicinity of the proposed entrance?
41. Sheet C2.0
a. A concrete apron is required in the right-of-way. Please revise site legend hatching to
require concrete apron in lieu of right. of. way pavement.
b. A depressed curb is required across the entrance unless the existing curb is roll curb.
c. Entrance curbing within the right-of-way shall match the existing curbing of Pro-Med
Lane.
d. The hatching of the right-of-way pavement is obscW'ing the curbing in the right-of-way.
This is much clearer on other sheets and should be the clearest on this sheet.
e. Curb return radii shall be a minimum of 30 feet.
f. Please label the width of the proposed entrance.
g. The Alternative Transportation Plan requires 10' multi-use path across the Smokey Row
Road frontage and 5' sidewalk across the Pro-Med Lane frontage. Please indicate ADA
ramps where this path and walk cross Pro-Med Lanf;l and the proposed entrance.
h. What does the shaded dashed line through the parking lot parallel to Smokey Row Road
represent? Is this a BSL?
i. Did not find keynotes "I" and "n" on the site plan.
j. The City is not requesting widening, milling, or resurfacing of the Smokey Row Road or
Pro-Med Lane frontages from this development.
k. The Department requests that the existing "bulb" be removed and the intersection at the
southeast comer be made into a "T" intersection. Please indicate demolition and
construction work for the portion of the bulb across the developer's frontage.
42. Sheet C3.0
a. Please indicate any existing inlets across the proposed entrance.
b. It is apparent by the proposed contours that 2 swales are being created east of the
entrance and south of the parking lot and east of the building and parking lot. Are two
swales necessary for SWQ purposes?
c. In the southeast comer, what is the slope from the swale adjacent to the right-of-way up
to the parking lot?
d. The construction limits adjacent to Smokey Row Road need to be revised.
e. Will grading along the property line kill the trees on the adjacent property? Justus is
indicating removal; but what if that project is not realized?

The project for Jackson square PUD, docket no 05020038 Z, showed two separate tax id parcels for the 7 acres. However
a 1990 document of commitments shows a site plan for the:site as one whole parcel and no split of the to tax id parcels.
The split of land, for tax RurRases occurred between 1990 and 2005, as a best guess.

-- The initial rezone of the parcel also shows the initial gevelopment plan for this overall area. It was well over 5
acres. After the initial rezone, the land can be divided up and sold as smaller parcels. Fell free to contact Mike Hollibaugh,
DOCS director, for additional clarification at 571-2417. See below.
Regarding your question about requiring a minimum tract size of 5 acres in the us 31 overlay - read the following zoning
ordinance excerpt:
23B.07 Minimum Tract Size:
A. Except as provided in Paragraph C, below, the minimum area covered by a DP within the U.S. Highway 31 Overlay
Zone must be 217,800 square feet (5 acres).
B. If a Parent Tract (Tract) is located both inside and outside of the U.S. Highway 31 Overlay Zone, a DP shall be
submitted to the Commission for the entire tract. Wherever there exists a conflict between the requirements of the
underlying zoning and those of the U.S. 31 Overlay Zone, the requirements for the U.S. 31 Overlay Zone shall prevail.
C. If a parcel of land or subdivision lot was recorded prior t6 April 21, 1980 (the "Effective Date"), and said parcel or lot
does not contain the minimum area required by this Paragraph, said parcel or lot ("Undersized Lot") may be used for any
use permitted in the U.S. 31 Overlay Zone provided that:
(1) At the time of recordation of the Undersized Lot or on the Effective Date, the Undersized Lot met the
requirements for minimum lot size then in effect for a lot in the underlying primary zoning district(s);
(2) The owner of the Undersized Lot must include any adjoining vacant land (not separated by a street or public
way) owned or owned by an affiliate on or before the Effective Date or at the time of application which, if combined with

D Section 238.07 does not preclude the sale or other transfer of any parcel of land within a Parent Tract after the
approval of a Development Plan (DP) for the entire tracl. However, the development of the parcel must still conform to the
DP for the Parent Tract as approved or amended by the Commission, and all other applicable requirements contained in
the Zoning Ordinance.
Regarding your question on lot coverage percent and green area:
238.08.06 Maximum Parcel Coverage and Density~
A. Maximum Parcel Coverage shall be sixty-five percent (65%) of any parcel covered by a DP.
B. Maximum Floor Area Ratio (FAR.) shall be 070, with the FAR. being calculated by dividing the total gross floor area
of a building or buildings on any parcel by the area of such parcel.

Whichever is less. I will bring this up at the Plan commission meeting tomorrow.
Traffic: the engineering dept is still reviewing this item. I will make sure they know your comments. You can contact the
City Engineer, Mike McBride, at 571-2441. A traffic impact analysis was done in January of 1990, as part ofthe rezone,

2) Please see the City of Carn1el' s Parking Ordinance in order to determine specifications and construction
details for bicycle parking.
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re-submitted, particularly if
any such change::: are considered "new" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other committee meetings.
