Docket No. 07090002 OA: US 31 Overlay - HoteJJCultural/Entertainment uses
The applicant seeks to Amend the Zoning Ordinance, Chapter 23B: US Highway 31
Corridor Overlay Zone in order to limit hotel and other cultural/entertaiinnent land uses.
Flied by the Carmel Department of Community Services
The enclosed amendment proposes to place square footage limits on Cultural & Entertainment Uses in the US 31
Overlay Zone. The proposed limits match the limits currently in place for Retail uses in the Corridor. Such uses
would be limited to 15% of the Gross Floor Area of a building, or up to 30% in a building if the total square footage
does not exceed 15% of the entire development plan, and are located either on the ground floor or below grade.
Several Cultural & Entertainment Uses are currently excluded completely from the Corridor, and are listed as such in
Zoning Ordinance Appendix A; this proposal will not affect them. However, this would limit the square footage of
the following uses, which are allowed in the Corridor today:
Art Gallery
Art & Music Center
Hotel (full service)
Catering Establishment
Restaurant, without drive-thru food sales
Meeting or Party Hall
Museum
Stadium or Coliseum
A copy of the proposed language and applicable portions of Appendix A are enclosed for your reVIew and
information.
Please note that the Indiana Code required to-day public notice was achieved; however, the Plan Commission Rules
of Procedure requires 25 days. To have the Public Hearing, the Plan Commission must vote to suspend their
Rules of Procedure.

Retail and Service Uses:
Retail and Service uses may he included in one or more buildings within a DP, subject to the
following:
A. Retail and Service uses may cOlllprise up to:
(I) Fifteen percent (15%) of the Gross Floor Area (GFA) of any building: or,
(2) Up to thirty pcrl"ent (30l7o) of the GFA of one building may be retail and service
uses, provided thaI:
(a) Total square footage of rdail and service uses designated in the
development plan does not excet'd fifteen percent ( 15%) of the GrA of
all buildings combined: or.
(b) Retail and service uses over fifteen percent (15cA}) of the GFA of any
one building he located on the ground tloor or below grade.

the same building proportions, architectural features. construction materials. and in general be
architecturally compatible with the Principal Building(s) with which it is associated.
