"WHEREAS, the Common Council finds mat it is ~easonable and necessary to promote and
accommodate the orderly growth and development of the City of Carmel and Clay Township by
establishing standards under which Model Homes and Temporary Sales Offices shall operate as
temporary uses within new subdivisions, and by strikfug abalance between the needs of residential
developers in the City and Township to adequately identify model homes and temporary sales offices
and the community's desire to promote an attractive, uncluttered appearance within new subdivisions
that preserves quality of life for new residents; and
WHEREAS, the Common Council further finds that the changing character of housing
design necessitates an :increase in the allowable rnaxlmmn height for residential structures in certain
districts; and
"WHEREAS, the Common Council the Common Council fInds that it is reasonable and
necessary to protect the public health, safety, comfort, morals, convenience and general welfare of
the citizens of the City and Township by regulating the manner in which off-premise automobile
sales. advertising is accomplished, thereby protecting the community's desire to promote an
attractive, tmc1uttered appearance within the City and Township thatpreserves quality aflife for the
residents; and
WHEREAS, the Common Council also finds that businesses that have invested in signage
that conforms with current zoning standards should not be compelled to compete with businesses
that utilize vehicle signage as additional identification sigJ.lage, and that the parking of such vehicles,
therefore,. should be regulated; and
WHEREAS, the Common Council finds that it is reasonable and necessary to protect the
public health, safety, comfort, morals, convenience and general welfare of the citizens of the City
and Township by setting forth a minimum size for corrunercial swimming pools that would
necessitate that lifeguard protection be provided; and

'WHEREAS, the CarmeVClay Plan Commission has duly approved and recommended to the
Common Council the following amendments to the Zoning Ordinance for the City and Township
that will update the Ordinance and various procedures and penalties therein, pursuant to the Advisory
Planning Law of the State of Indiana as well as the 2020 Vision Comprehensive Plan, such plan
having been duly approved by resolution of the Common Council on September 24, 1996, and
remaining in effect as the official Comprehensive Plan ofthe City of Cannel and Clay Township;

NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Carmel, Indiana,
as follows: thatpurstIant to Ie 36-7-4-600 et seq. and IC 36-74-700 etseq., it adopts this Ordinance
as an amendment to the CarmeIiClay Zoning Ordinance, No Z-289, as amended (the "Zoning
Ordinance"), and amends and adds certain provisions to the ordinance as follows:
Section I:
a; Adopt new ~ection 25.16 of the Zoning Ordinance to read as follows:
25.16: Model Homes.
25,16.1 Model homes, which may include Temporary Sales Offices, may be
permitted in all residential districts, but only as a Temporary Use, subject to
approval by the Director based on a Finding that the Temporary Use will not
detrimentally affect the health, welfare, safety, or morals of the neighborhood
under consideration for such Temporary Use.
25.16.2 The duration ofaModel HomePemut shall be fixed by the Director
for a term not to exceed eighteen (i8) months. However, upon written
request, the Director may extend such a permit for increments of sox (6)
nlOnths, so long as the Temporary Use in the aggregate does not continue for
a more than thirty-six (36) months.

The Director shall ensure, before issuing a Model Home Permit, that:
adequate acceSS and off-street parking facilities will be provided,
that public address systems will not be used,

i) Sales office Identification Sign - On the same lot as the approved
temporary sales office; sign shall not intelfere with Vision Clearance
and shall be minimum often (10) feet from the street right-of-way.
ii). Model home Identification Sign - On the same lot as the approved
model home; sign shall not interfere with Vision Clearance and shall
be a minimum often (10) feet from the street right-of-way.
t) Design: As approved by the Plan Commission.
g) Copy: No restrictions.
h) lllumination: Not permitted.
i) Landscaping: Not required.
j) Required Approval: Either a Sign Plan showing the design of any sales office
Identification Signs must be approved by the Plan Commission as part of the
Primary Plat petition, or an ADLS application must be filed prior to the

Sign Permit: Required for signs with a Sign Area over six (6) square feet.
Time: Shall not be Established until either a temporary of final Certificate
of Occupancy has been issued for the Principal Building; may remain until

approval has expired, or until such time as the Principal Building is sold for
private occupancy, whichever is earlier.
c. Amend Sections 5.4.1, 6.4.1, 7.4.1, 8.4.1, and 9.4.1, substituting "thirty-five (35) feet" in
place of "twellty-five (25)feet.":
d. Amend Section- 25.7,01-2: Definitions to add the following language to the definition of
"Vehicle Sign":
"A sign iI:l or on a vehicle that advertises the vehicle for sale, lease or rental shall
notbe considered a Vehicle Sign. See also Section 27.2.5."
e. Amend Section 25. 7.01-4: Prohibited Signs, Subsection (L) to read as follows:
(L) Signs tb,at advertise goods, products, services or facilities or direct persons to a
different location (or to a telephone number at a different location) from where the
sign is installed. (Off-premise signs shall require a Developmental Standards
Variance from the Board.)"

27.2.5 It shall be'prohibited to park or use a vehicle in such a way as to function as a sign,
defined to include the parking of any vehicle, trailer or similar movable structure
containing or s~pporting any signage between the right-of-way line of any public

A. Vehicles actively involved in construction on or the serving of the site.

on the doors or integral body panels that do not exceed sixteen (16) square
feet in area.

Due to the fact that ninety days \ had passed since the Carmel/Clay Plan Commission
Secretary bad certified the Plan Commission's Favorable recommendation on August 30, 2001,
Ordinance No. Z-366-01 became effective Wednesday, November 28,2001. IC 36-7-4-607 (e)
(3) provides that, "lithe legislative body fails to act on the proposal within ninety (90) days after
certification, it takes effect as if it had been adopted (as certified) ninety (90) days after
certification. "
As you are aware, the Department of Community Services had been working with the Land
Use & Annexation Committee to amend the Ordinance for reconsideration by the Plan
Commission. Due to this unusual turn of events. the Department will be asking the Plan
CoIIll!lission to include those revisions as part of me proposal currently before them as Docket No..
160-010A, and wbich will come before you in turn as Ordinance No. Z-369-02.

Dear ~1r. Nelson:
This 'will acknmvledge receipt of your July 9th letter regarding the revision requested by our Department of
Conununity Services. Assuming this will be the only revision to the plans submitted and certified by
Weihe Engineers on June 25, 2002, we offer tlle following:
1. All appropriate sheets in the set of dmwings submitted for tllis project need to be revised to reflect
tl1e above revision requested by our Department of Community Services. It appears that this
revision will affect Sheets 3, 4, 5, 6 and E-l. 1llerefore, the four sets of dra\\'ings submitted to this
office on June 25, 2002 will be obsolete.
2. Board of Public Works and Safety approval of Sanitary Sewer availability for this project expired
on June 21, 2001. You will have to resubmit your request for availability to the Board. Be
advised that all Plan Commission and/or BZA approvals must be obtained prior to any request to
be placed on the Board's agenda. I believe this project was on the July 16th Plan Commission
agendrl for public hearing I assume this was probably forwarded to the next available Special
Studies Committee for review, so approval by the Plan Commission is probably at least a month
away?
3. When tlIe project has received Plan Commission and/or BZA approval, received all BPWS
approvals and the drawing has been approved by lllis office, tlle following remaining requirements
must be satisfied:
.. Provide tllis office with 4-sets of certified and revised construction drawings. The
drawings submitted for approval must correspond to the most recent set submitted and
approved by our office. The City Engineer and the Director of Carmel Utilities \,ill
approve and sign the drawings. One approved set is to be maintained on the construction
site at all times One set is distributed to Carmel Utilities; one set to our Public Works
inspector and the final set is maintained in the Department of Engineering.
.. Payment of Sanitary Sewer Connection Fees in the total amount of $7,] 91.00. The check
is payable to the City of Cannel. Upon payment of the Sanitary Sewer Connection Fee,
you will be issued a Sewer Permit. You ''Irill be required to designate a bonded
plumber/excavator when you apply for your Sewer Permit This is the person who will
make the outside sanitary sewer service line connection [rom tlle building to the main.
.. When you are issued the Sewer Permit, you will be able to schedule the pre-submittal
meeting ,,,itl1 our Building and Code Enforcement.

Dear Jon,
Find enclosed twenty-one (21) booklets and three (3) revised full sized sets of plans for
the above referenced project. These plans include the revisions of our meeting on May
24th excepting and landscape revisions. The changes to the plans include the following
items:
1. The proposed Ramp RfW has been added to the plans and the 15 foot
greenbelt is shown to it's convergence point with the US 31 - 90 foot
build to line and the associated greenbelt line of 31.
2. Three renderings are included in the booklets.
3. Landscaping revisions not made. We did not receive comments on
landscaping until 4:39 p.m. on June 5th, which did not allow time to
address the comments and incorporate changes into the material
submitted today. We will be issuing a letter response to the comments
within the next few days but no changes will be made to the plans until
planning commission hears this petition at which time we will incorporate
any landscaping revisions or other revision necessary.

RE: Hamilton Crossing Building #5 Landscape Plan
Dear Mr. Carmosino:
These Comments are based on review of plans received in this office on April 29, 2002,
and reflect my comments made in the TAC Meeting in May, 2002:
1. Please confirm the final width of the planting striplbufferyard on the east and
northeast sides (along the U.S. 31 Highway ramp right-of-way) with Jon
Dobosiewicz. I believe that his determination was that it needed to be at least 15
feet in width. This planting stIiplbufferyard (about 600 feet in length) should be
planted using Bufferyard Design Standard D (bordering Expressway or Highway
- 5 shade trees, 5 omamental trees and 27 shrubs {or 9 evergreens} per 100 linear
feet).
2. Bufferyards andlor planting strips on the south property perimeter and along the
drive on the northwest side should meet the minimum base planting unit
requirements found in 23B.IO.2.B(5) ofthe U.S. 31 Overlay Ordinance. The west
perimeter bordering Hanlilton Crossing Boulevard and your parking lot should
meet Bufferyard Design Standard B ( 3 shade trees, 3 omamemal trees, and 15
shrubs {or 5 evergreens}).
3. These requirements are in addition to those for the foundation plantings and the
interior parking lot plantings. Those shrubs required for parking lot interior
should be planted somewhere on site ifnot planted in the parking lot islands. The
parking lot islands should not be planted with sod, but rather mulched or planted
with a ground cover. Sod will be hard to maintain (and an additional mowing
expense) due to the shade of the maple trees and compete with the trees for water,
root space, and nutrients.
4. Hawthoms - trees with thorns should not be placed within 15 feet of a path,
street, or parking lot as a safety concern. Thornless hawthorn varieties are subject
to a number of disease and insect pests. They require an extra amount of care,
and may have to be replaced within a shorter periodoftime.

Hello everyone;
Following are CTRWD comments on the agenda items effecting our sanitary sewers or service
area for the May 22nd TAC meeting. Please feel free to copy and distribute this email or
attach it to your meeting minutes. We have also created a new page on our website linked
to the "Construction" page where we have posted all CTRWD TAC comments from 2001 and 2002
meetings held to date. We will contintie to add to this page every month so please let
everyone know they can view our comments online now too.
Village of West Clay Commercial Building No. 2
Our comments remain the same from last month: District specifications should be added to
the plans. The plans are not clear as to the location of the sewer connection. Building
permits should NOT be issued unless the District has issued connection permits. The
developer needs to submit current plans to the District for review.
Village of West Clay, Section 3004, Block C, Townhomes
The plans received by the District only show the mainline sewer for the development but
there must be individual connections for each unit in each building in case these are sold
as condominiums. Revised plans need to be submitted showing each building with its own
individual connection to the District's sewer along with an address list for permits and
inspections. Building permits should NOT be issued unless the District has issued
connection permits.
West Carmel Center Block D, Lot 2 - 5th 3rd Bank
The plans show a questionable connection to sanitary sewers along US 421. The project
developers will need to consult with the District as to the appropriate lateral connection
point which may be within the West Carmel Center development, not along US 421. In any
event, the District will not allow a direct connection to the main along US 421 which
appears to be represented on the plans we received. Building permits should NOT be issued
unless the District has issued connection permits.
Hayden Run Section 2
The District has received plans but it is unclear whether the developer has sent a set to
the District's consulting engineers at Samuel L. Moore & Associates for review. Please
have the petitioner do so if they have not already.
Hamilton Crossing Building No. 5
It was our understanding that this project had been abandoned. As such, the District needs
current plans to review, so please advise the developer to provide plans. Building permits
should NOT be issued unless the District has issued connection permits.
Dixie Hi-Way Addition Lot 8 Rezone

The District has no comments on the re-plat unless it effects the sanitary sewers in
development.

We have received and reviewed your letter dated May 6, 2002 addressed to Mr. Daniel
J. Kuester, PE for the above referenced project. This correspondence is to serve as a
response to all items of your letter. I have attached a copy for your reference. I have
referenced the numbering of your correspondence.
General
1. The site was laid out with digital plans provided by John W. Myers of Parsons
Srinckerhoff Quade & Douglas, Inc. (PBQD) There are no metes and bound
ROW to show. I am confident that if you compare our plans to the
attachment referenced in your letter as Resolution No. 08-07-00-03, you will
find that we have best planned to accommodate this ROW if it ever
materializes, but at this point in time, all we have done is use the potential
ROW line of the digital plans provided by PBQD as a reference tool. No
metes and bounds description has been provided to accurately represent any
ROW associated with the 131 sl Ramps and therefore a proposed ROW line
is not shown on the plans.
a. Our plans show a minimum parking setback of 15 feet from the
proposed ramp ROW. For clarification purposes, please provide
where the in the ordinance this setback requirement is established.
b. Our plans show a minimum building setback of 15 feet from ROW.
For clarification purposes, please provide where in the ordinance this
setback requirements is established.
c. We acknowledge the matter of the 30-foot landscape buffer and 90
foot build-to-line for the US31 ROW. You will see some adjustments
to the plans addressing the 3D-foot landscape buffer. The 90-foot
build-to-Iine follows the intent of the corridor. As discussed previously
with you, due to site geometry, we have aligned the facades of the
buildings along the 31 corridors. In the case of this particular

causing the aligned building fa<;:ade to measure a bit more than 90
from the US31 ROW. This combined with the potential of the 131 sl
Street Ramp ROW caused us to hold to the aligning of the building
facades in Hamilton Crossing as geometrical base line for this
building. We believe that this approach was the best planning tool for
the situations surrounding this property. Should this approach require
a variance, please advise of such and we will file the appropriate
applications.
d. Section 23B.17.4 requires the reservation of land for pending State
Highway improvements as shown on plans developed for INDOT by
the consulting firm, Benardin, Lochmueller and Associates, for the
Major Investment Study (1997) ("BLA") or shown on plans from the
Parsons Transportation Group prepared for the Environmental Impact
Study. There was no reservation of land required at the location by
the BLA study, as evidenced by the approval of 22-99 DP/ADLS. AS
mentioned above, the current site has been laid out using digital plans
provided by John W. Meyers of PBQD and we are not requesting
approval of any improvements within the proposed right-of-way of the
proposed 131 s Street Ramp. A copy of our transmittal letter to the
INDOT Commissioner is enclosed.
2. Find enclosed with this correspondence a copy of the plan approved under
22-99 DP/ADLS. I have included a copy of the site plan only and did not
include the remaining required and approved plans of this submittal. You
should have a copy of the entire approved package in your tifes. If you need
additional copies please call and I will arrange for copies to be made and
delivered.
Development Plans
1. The original master plan for this park had the building orientated parallel to
Meridian Street and aligning it with the other Hamilton Crossing buildings.
However, the proposed right-at-way for the ramp at the intersection of 131 st
Street and Meridian Street has reduced the length of the frontage along
Meridian Street. This caused the orientation of the building to be turned
perpendicular to Meridian Street and front on 131 sl Street. Any attempt to
front the building along Meridian Street would have resulted in a building that
would be square in configuration. This is not a desirable footprint for an
office building because the lease depths become too deep. We do fee that
by rotating the building perpendicular to Meridian Street that we are still being
respectful to the Meridian Street building line by aligning the end of the
building with the other Hamilton Crossing building in the park. The corner

LETTER OF APPROVAL
The undersigned has reviewed the proposed plans for
Hamilton Crossing Building # 5
and has approved the plans subject to the following:
1. Since the proposed building is to be sprinklered, a meeting will need to be set up to discuss the
location of the Fire Department Connections.
2. We are requesting that a Knox Box be installed on the building for fire department emergency
access.
3. Due to the location of the fire hydrant to the west, we will require that the parking space in front
off the fire hydrant be stripped off to prevent parking from in front of the hydrant.

It does not appear that tlus project will require any Board of Pub lie Works and Safety approvals.
4. T.A.C. Review/Drawings submitted for approval:
We request that all conunents and comment letters generated by tllis office be answered in writing
and be accompanied by a drawing reflecting requested revisions. Final drawings will not be
approved for construction until all Engineering Department issues have been resolved. The design
engineer must certify all drawings submitted for final approval. TIlls office will require a
minimum oftluce-setsof drawings for approval after all issues have been resolved. The drawings
will be stamped as approved and ,viII be signed by the City Engineer. The Owner wilt receive
one-set which is to be maintained on tllC construction site at all times. Our Public Works
Inspector will receive one-set and one-set will be mallltained in the Engineering Department.
PROJECT COMMENTS
5. Identify on the plans the development adjacent to the south property line of tIus project.
6. Identify and dimension the right of way line ofHalllilton Crossing Boulevard.
7. Identify the west right of way line of U. S. 31.
8. Will the area labeled as future parking remain in grass until the parking area is developed?
9. Do you intend to dedicate the right of way of Hamilton Crossing Boulevard?
10. Regarding the gravel drive that is being partially removed, what is tIle purpose of this drive and
where docs it terminate?
The City Engineer is out of town this week and has not had tllC opportunity to review the plans or the
drallJagc calculations Therefore, we reserve tile right to provide additional commcnts after she has

We have reviewed the drawings submitted for tius project We offer the following initial comments:
GENERAL INFORMA nON
1. The project site is located within current City of Cannel Corporate Limits.
2. Jurisdictions:
. Streets and Curbs - Private
o Water - Indianapolis Water Company Service Area
o Sanitary Sewers - Clay TO\'vnship Regional Waste District Service Area
. Stonn Sewers/Storm Drainage - Hamilton County Surveyors Office/City of Carmel
3, Board of Public Works and Safety approval requirements:
It does not appear that Olis project will require any Board of Public Works and Safety approvals.
4. T.A.C. Review/Drawings submitted for approval:
We request that all corrunents and comment letters generated by this office be answered in writing
and be accompanied by a drawing reflecting requested revisions. Final drawings will not be
approved for construction until all Engineering Department issues have been resolved. The design
engineer must certify all drawings submitted for final approval. This office will require a
minimum of thrce-sets of drav.-ings for approval after all issues have becn resolved. The drdwings
will be stamped as approved and will be signed by tlle City Engineer. The Owner will receive
one-set which is to be maintained on the construction site at all times. Our Public Works
lnspectonvill reccive one-set and one-set will be maintained in the Engineering Department.
PROJECT COMMENTS
S. Identify on tlle plans the development adjacent to tlle south property line of this project.
6. Identify and dimension tIle right of way line of Hamilton Crossing Boulevard.
7. Identify the wesl right of way line of U.S. 31.
8. Will the area labeled as future parking remain in grass until the parking area is developed?
9. Do you intcnd to dedicate the right of way of HarniIton Crossing Boulevard?
10. Regarding the gravel drive that is being partially removed, what is the purpose of this drive and
where does it temlinate?
The City Engineer is oul of town this '\-veek and has not had the opportunity to review the plans or the
drainage calculations. Therefore, we reserve the right to prm-ide additional comments after she has
reviewed the plans and tile calculations.

Dear Mr. Kuester:
This letter is in response to the applications you filed for Building # 5, Hamilton Crossing. The
following conunents need to be addressed and/or plans/applications updated accordingly:

1. Identify ROW per thoroughfare plan, specifically for 131 ,t Street ramps, per Resolution
No. 08-07-00-03 (see attached).
a. Parking setback is 15' from the ROW ofthe ramps.
b. Building setback is 15' from the ROW of the ramps.
c. 30' landscape buffer and 90' build-to-line still follow current US 31 ROW.
d. Provide transmittal addressing compliance with 23 .B.l7.4
2. Provide copy of the plan approved under 22-99 DP/ ADLS. The existing approved
development plan for the site needs to show compatibility of proposed project with
existing development(s). To that end there is very little real estate between this parcel
and 131 sl Street. We need to assess the ability of that area to be developed after the
approval of the proposed plan.
Oevelopment Plan
1. Per section 23.B.8 of the Zoning Ordinance, the intent is to orient the building with its
longest axis parallel to the adjoining highway. Revise plans accordingly (turn building 90
degrees).
2. The side yard setback along south property line is 15' per 23.B,8.2.B. Not 45' as shown.
3. Show 5' sidewalk along Hamilton Crossing Boulevard.
4. Provide pedestrian connection from sidewalk and path to the building.
5. Is there a dumpster proposed? If so, where? Please advise.

1. Building Design:
a. The minimum building height is 38' per 23.B.8.3.Al. The plans as submitted
display 26' tall building elevation. Revise plans accordingly or apply for a zoning
waiver.
b. All buildings shall be designed with a minimum of 8 external comers, in order to
eliminate box buildings. The department questions the "bump-out" on the south
elevation in meeting that requirement.
2. Provide all exhibits required under Section 23.B.9.G. (Context site plan, three perspective
renderings, and Golden Section Analysis).
3. Landscaping:
a. Provide additional plantings, both shrubs and trees, adjacent to parking along the
ramps.
4. Parking:
a. Per 23.B.12.A, remove proposed future parking between the 90' build-to-line and
the ROW line.
b. Note: 154 parking spaces are required, 179 are provided.
c. The identific(ition of parking spaces within the area required to be reserved for
future development of streets would require a variance in addition to a zoning
waiver.
5. Lighting:
a. There are areas where lighting levels exceed the allowable 0.3 footcandle level at
the property line. Please revise plans.
