Docket No. 07040019 DP/ADLS: West Carmel Marketplace - Burger King The applicant seeks site plan and design approval for a proposed restaurant building. The site is located at 9853 N Michigan Rd, and is zoned B-3/Business within the US 421 Overlay. Filed by Richard Sampson of Burger King Corp. The petitioner seeks site plan and design approval for a fast food restaurant with a drive thru, within the West Cannel Marketplace development. There will only be one wall sign, and the building's design/architecture will follow the architectural theme established for the overall development. Please see the petitioner's informational packet for more detail on the site plan and building elevations. As a side note, variance approvals will be sought from the BZA for a reduction in the number of parking spaces, increased square footage of drive thru menu board, location of the drive thru, and having a wall sign that is 100% logo. Other than that, the building and site comply with all other zoning ordinance regulations. The BZA meeting will be July 23. At the June 19 Plan Commission meeting, the following issues/concerns/requests were made: 1.) Two 'green' parking spaces for hybrid cars were requested from one PC member, but not requested by another. Providing two 'green' parking spaces is NOT required by the ordinance. It is only a request and an opportunity to go above and beyond what the ordinance requires. 2.) There seems to be a conflict with traffic flow and stacking. This is a dangerous site plan. 3.) Eliminate the cross-access easement. 4.) Provide different colors for the blue awnings and orange door. 5.) Commit to making the trash enclosure height taller than refuse boxes. 6.) Menu board: surround the sign face with brick. Brick the back of the sign, too. Make it look better. 7.) Consider using a different lighting manufacturer because "LSI Lighting is cheap." 8.) Commit to refreshing the signs in 5 years, via new paint and new sign panels. 9.) The Aluminum canopy with the order box is not in character; it is out of place. 10.) Add an 18-24 inch (approximate) brick base to the sign structures. At the June 28 Special Studies Committee meeLing, the following issues/concemslrequests were made: 1. The site plan was changed to show safer traffic flow and drive thm stacking. 2. The menu board design was discussed with a possible brick base being explored. 3. An additional variance approval from the BZA is being sought, regarding the location of the drive thru stacking. The following are outstanding issues/concerns/comments from DOCS: 1.) The County Surveyor's Office has no major issues with tbe approval of this project. The petitioner will continue working with the County Surveyor's Office on final engineering and construction plans. 2.) The City Forester, Scott Brewer, has tentatively approved the new/revised landscape plan. 3.) The revised site plan is acceptable to DOCS. The Department of Community Services recommends the Plan Commission approve this item after all questions/concerns are addressed.
