The following items are in response to comments received at the June 19, 2007 Plan
Commission meeting and further discussed at the June 28, 2007Special Studies
Committee:

One "green" parking space to be included in the site layout.
Special Studies Committee recommended the alternate site plan
presented be approved contingent on Board of Zoning Approval for
the variance to allow the Drive-Thru Lane to be located in the side
yard. 15 copies of the alternate Site Layout and Landscape Plan aTe
attached to be included with the previously submitted Information
Packets. Please note this plan has been submitted to staff for review
and also directly copied to Scott Brewer for landscape review.
Special Studies Committee requested the cross access be maintained
especially considering the flow allowed by the alternate Parking layout
presented.
The flush exterior doors are to be painted terra cotta to match the
brick. (The color difference on the drawings is due to the printing
program.)
Samples of the actual materials were submitted for the awnings and it
is our understanding the Special Studies Committee found both the
material and the color to be acceptable.

We will comply with the request to make the trash enclosures taller
than the trash receptacle. Please note the walls surrounding the trash
enclosure are currently design to be 8 feet in height.
Special Studies Committee requested a masonry base to match the
building be added to the menu board. Please note with the alternate
site layout the menu board will be hidden by the masonry walls of the
dumpster enclosure. We have also included plant materials that will
screen the dumpster enclosure and the sign. The sign is not as visible
from the road with the alternate site layout. Please note the area of
the sign is currently before the BZA for variance approval.
The light fixtures to be used have been directed by the developer. The
proposed fixtures will match the existing parking lot lighting.
Burger King Corporation will maintain the sign as required.
Special Studies Committee did not rule in favor or against the awning
to be included above the order box. This is included for the
convenience of the customer during inclement weather. It is our
understanding staff is to review this item and advise.
See Item No.6 above concerning the base of the menu board. No
further comments were received concerning directional signage. It is
our understanding this comment is not directed towards the directional
slgnage.

Other outstanding issues/concerns from DOCS:
Item No.1 We have included a copy of the response from City of Carmel
Engineering indicating the project was out of their jurisdiction and
they are not going to review this project.
Item No.2 With the alternate site layout the access ladder is no longer visible
from 421. We have screened the "maintenance and utility area"
behind the building with masonry walls.
Item NO.3 it was our understanding Scott Brewer had approved our plans.
Obviously his review and approval of the alternate site layout will be
required. We have already e-mailed plans to him for his review.

The following items are in response to review comments received at the Plan
Commission Public Hearing June 19, 2007.
Item No.1 - Two of the gentlemen on the commission commented that they did
not like the site layout as presented. No specific reasons were indicated, but we
are assuming they were commenting to traffic flow.
We have two concerns for this comment.
First if this is truly a concern why was this not addressed by staff prior to this
meeting? We have complied with the ordinance requiring the drive-thru stack and
drive-thru windows be located in the rear yard and rear of the building and have
provided the required ten stack spaces. If this is truly a concern a much better
approach may be to allow the drive-thru window service to be located on the north
side of the building oriented towards the access drive to the Home Depot. This
would facilitate a better flow around the building and eliminate the conflict we think
was inferred by these comments. Would a variance to allow the drive-thru
window o'n the north side of the building be considered?
Our second concern is related to the variance request we have before the board
of zoning to allow a reduction in the number of spaces required. Should we table
our variance request until such time as we have a site layout and plan that is
approved by the Plan Commission?
Please note the Wendy's restaurant located to the north of our development has a
similar layout for their entrance from the access drive and for their stacking space.

We would also appreciate clarification on the comments r0cerning color. The
overlay ordinance does not address the color of awnings. Please note the tenant
shop property developed to the north of the site has blue awnings on the front and
side elevations of the building and the Applebee's restaurant has the "Apple logo"
on their awnings.
Item No.3 - Trash enclosure height required to be taller than refuse boxes.
We will comply and will verify with Burger King Corporation the height of the
refuse boxes to be used at this site.
Item No.4 - Request for two parking spaces near the door designated for
alternative fuel vehicles.
While we agree with this ~ , el efficient vehicles and a
"greener environment, this is ot required by ordinan . Burger King is
concerned that "preferential tre ent" for customers ecause they drive a
particular type of vehicle may not be receive positively by all of their customers.
Please note there wasn't even consensus on this item by the Commisioners.
Item No.5 - Consider using a different lighting manufacturer because "LSI

low to the ground. We will comply with this request but need clarification as to
what is requested for the menu board sign bases? Are you looking for post on
each end so the menu board is similar to "monument sign"? Or is the concern of ~

Item No.8 - Staff Comment to provide additional screening for the roof access
ladder.
We understand your concerns but hope you would appreciate that safe use of the
access ladder to the roof prevents us from adding screening further up on the
ladder.
It is our understanding these items will be discussed in further detail at the June
28th Special Committee meeting however, we would appreciate some immediate
feedback so we can advise our client on the Variance Hearing scheduled for this
coming Monday, June 25th. We must decide if we wish for these items to be
heard or if we should ask for them to be tabled and continued to the July meeting
so we would have time to work out these issues with the Plan Commission.

Mike - I am responding to your emailletter via email. I will add your comments and the commission's comments to the
dept report for the June 28 meeting.
II may be best to table your June 25 BZA variance items (parking, menu board, logo sign) until you get things worked out
with the plan commission at the subcommittee level. You may have to add a variance for the location of the drive thru
window, if your site layout will change. (Please let Christine and me know if you choose to table your variance items. let us
know via email or fax. )
The site layout comment from the plan commission had to do with a conflict between those coming on off the access drive
and wanting to turn into the stacking lane for drive thru. I think there was also a comment about the cross access
easement to the south, and that it should be removed. If you can provide the subcommittee with an exhibit that shows
adequate and safe traffic flow on the site, this may alleviate some of their concerns. Staff did not see an issue with the site
layout.
A variance request may be looked upon favorably by the BZA, for a drive thru window to be on the north side of the bldg,
but Staff would need to see a revised layout. It may make sense to see if the subcommittee has further comments on the
site layout and traffic flow. Perhaps presenting two site plan layout options may be best, if it is not too hard to do.
The canopy comments were about the aluminum system canopy that has an order box on it. One pc member stated that it
looks industrial and does not match the character of the site or development. There was talk about adding an 18-24 inch
brick base to this structure. Perhaps this canopy structure and be removed altogether, leaving the clearance panel that
states: clearance 8'6".
The blue fabric awnings were not seen as a favorable color. Even though the overlay does not require specific awning
colors, the plan commission does have the authority to review and approve colors. This is part of the ADLS process that
the ordinance does spell out. At the subcommittee meeting, try to provide some exhibits showing different awning colors
or shades of a darker blue.
Noted: you will comply with the trash enclosure height request.
Providing two 'green' parking spaces is NOT required by the ordinance. It is only a request from the plan commission, and
an opportunity to go above and beyond what the ordinance requires.
LSllighting does match the lighting of the existing development, and probably should not be changed. But it may earn you
extra brownie points with the commission, if you do research another product that is similar but a little better quality.
If menu board sere located on the north side of the building, a variance would NOT be required. The ordinance does not
specify a menu board location on a site.
A plan commission member did request a brick border around the menu board panel, and possibly on the back side of the
menu board sign, to make the sign enclosed with brick. This was in addition to the request to provide 10-24 inch brick
bases on the signs.
I hope this addresses all of your comments. More discussion will take place at the committee meeting on June 28.

The Amur maackia is a rather bold choice. I do hot think that they will provide much shade to the parking lot, being a
smaller tree, and I think they will require some early structural pruning to develop good structure (because of their
branching habit), but they are unusual for this area. I will support their use. The plan is acceptable, thank you again.

Our standard for species diversity is normally limited to 15% for each species and 25% for each genus. You have the
Acer genus as 69% of the species on this site. I know that it is a small site, anq that you have been asked by Duke to
match the species along the roadways, but that diversity level is not acceptable to Carmel. Duke's plans for the entire
site were a little different because it was such a large site and it contained a large number of plants and number of
species.

For the AR (Acer rubrum), I would suggest you go with something like the honeylocust you put in the parking lot, and for
AF (Acer freemanii), I would suggest a larger maturing tree for more open areas like a shingle oak (Quercus imbricaria)
or Kentucky coffee tree (Gymnocfanus dioica) or London plane tree (Platanus x acerifolia). That should take care of the
diversity issues.

Here are my comments on the Michigan Road Burger King landscape plan:
1. The Site will be covered by Section 26.04 Perimeter Bufferyard requirements and by the Michigan Road
Overlay Zone. It requires a 30; Greenbelt across the front and an addition 6; planting strip across the front of
the parking lot,
2. On the graphic planting detail, please change the note about placing the top of the root ball to the "root flare"
must be placed even with the finish grade. We have a detail if you would require one.
3. Tree Species: For species diversity reason, we require that you limit individual species to 15% and genus to
25%. You have 100 many maple (Acer) species, and red maple are very thinned barked, and do not do well in
parking 101s and paved situations. Please choose and alternative large maturing shade tree species to replace
the Armstrong and Autumn Blaze cultivars. I have attached Carmel's list of recommended street trees, In the
Greenbelt, oaks (not pin oaks), London plane tree, or Kentucky coffee tree would be good choices, in the
parking lots, honeylocust, ginkgo, zelkova or Prairie Pride Hackberry would be good choices.
4. If another large maturing shade could be placed in the long planting island to the southeast of the building, it
would shade the building (lowering energy costs) in the future. And could some ornamental trees be placed
nearby the corners of the building,

2. On the graphic planting detail, please change the note about placing the top of the root ball to the "root flare"
must be placed even with the finish grade. We have a detail if you would require one.
3. Tree Species: For species diversity reason, we require that you limit individual species to 15% and genus to
25%. You have too many maple (Acer) species, and red maple are very thinned barked, and do not do well in
parking lots and paved situations. Please choose and alternative large maturing shade tree species to replace
the Armstrong and Autumn Blaze cultivars. I have attached Carmel's list of recommended street trees, In the
Greenbelt, oaks (not pin oaks), London plane tree, or Kentucky coffee tree would be good choices, in the parking
lots, honeylocust, ginkgo, zelkova or Prairie Pride Hackberry would be good choices.
4. If another large maturing shade could be placed in the long planting island to the southeast of the building, it
would shade the building (lowering energy costs) in the future. And could some ornamental trees be placed
nearby the corners of the building,

In reviewing your petition, it looks as though you would need the following variances:
1. Metal awnings are not permitted in the Overlay District. You would need either a Variance of Development
Standards (DSV), or change the material to cloth.
2. Signage is limited in the Overlay and further limited in this development. You would need variances for:
a. Logo sign over 25%
b. Two menu boards over six feet in height
c. Two wall signs.
d. One wall sign not oriented towards a public right-of-way
e. Size and height of directional signage
3. Reduction in required parking spaces, unless documentation can be provided showing that parking will be
shared with the rest of the retail center.
Each of these issues would be treated as an individual variance. There have been a few sign variances granted
in this pari of the city, but the signage is largely uniform. You may want to schedule a meeting with our
Department to discuss possible amendments to the design.
