FINDINGS OF FACT - USE VARIANCE

The approval of this variance will not be injurious to the public health, satety, morals and general
welfare of the community because the proposed ground sign that is the subject of the variance
request would still be set back an appropriate distance from the adjacent roadways and would not
obstruct the vision of drivers driving along the adjacent roadway. As a result, the granting of this
variance will not be injurious to the public health, safety, morals and general welfare of the
community.

The use and value ohhe area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because the variance applies to location of a ground sign and the
surrounding properties are zoncd manufacturing and business and, as a result, would not be
adversely impacted by the granting of this variance.

The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property due to the fact that Petitioner will be prevented from utilizing
ground sign that is an appropriate location and is designed to provide notice of the business
location to its customers.

DECISION

IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that
Variance Docket No. 07070027V _is granted, granted subject to any conditions stated in the
minutes of this Board which are incorporated herein by reference and made a part hereof.
