Irwin Union Bank - Signuge The applicant seeks the following development standards variance approval: Docket No. 07070027 V Section 25.07.02-09 Sign locuted in the right-of-way. The site is located on West Carmel Drive in the Carmel Science and Technology Park, and is zoned M3/lndustrial Park. Filed by Jim Shinaver of Nelson & Frankenberger for Irwin Union Realty Corporation and Irwin Union Bank. General Info: The applicant is seeking approval for a ground sign that meets all the Sign Ordinance requirements, except for its location. The sign is located within the designated City Center Dr. right-of-way. There are two other wall signs on the building, both of which meet the requirements of the Sign Ordinance. Analysis: The proposed sign is set back 22 feet, 3 inches from the center line of the road. The building itself it set back 60 feet from the road right-of-way. The sign would need to be set back at least 10-12 feet more in order to be in compliance. However, setting the sign this far baek could create safety hazards [or drivers trying to locate the entrance of the site. The sign is 33 sq. ft. and 45 sq. f1. is allowed. The sign was approved by the Plan Commission Special Studies Committee (Docket Number 07050012 DP/ADLS) on Tuesday, August 7 with a 3-0 favorable recommendation to the full plan commission. The Plan Commission approved this project with a 10-0 favorable vote on Tuesday, August 21, 2007. Findings of Fact: Sign located in the Right-of-Way. 1.) The approval of this vuriance will not be injurious to the public health, safety, morals, and general welfare of the community hecause: The proposed ground sign would still be set back an appropriate distance from the adjacent roadways and would not obstruct the vision of drivers driving along the adjacent roadway. 2.) The use and value of the area adjacent to the property included in the variance will not he affected in a substantially adverse manner because: The variance applies to location of a ground sign and the surrounding properties are zoned manufacturing and business. 3.) The strict application of the terms of the Zoning Ordinance to the property will result in practical difficulties in the use of the property because: The petitioner will be prevented from utilizing a ground sign that is an appropriate location and is designed to provide notice of the business location to its customers. Recommendation: The Dept. of Community Services recommends positive consideration of Docket No. 07070027 V after all questions/concerns are addressed. The petitioner will also need to seek consent to encroach approval from the Board of Public Works and the Engineerlng Department.
