Comes now Dane W. and Beverly A. Love, property owners, affected by the proposed
Clay Creek development, and hereby object to the Clay Creek Plat Plan. In support of
their objection they would assert as follows:
1. The rClii"oval of K acre of mature woodlal"lds adjacent and north of the property
located at 12011 Hoover Road will affect their property value in a substantially
adverse manner. Solutlbn: The proposed lot 12 shall be eliminated.
a. Ref. sca 3.07.02 The use or value of the area ad;acent to the proTJertv
included in the oroposed plat will not be affected in a substantiallv
adverse manner.
b. Ref. sca 7.05 .07 Woodlands. 1. No more than (15%) of/and..
occupied, as of December 1,1998. bv Mature Woodlands shall be
cleared.
2. The property located at 12011 Hoover Road, Carmel, Indiana is an
"underdeveloped tract of ground" due to the lack of road frontage (land locked).
The property currently has no access to public utilities including sewer, water, and
natural gas. Solution: 50' Easement rights shall be granted for both utilities
(water, sewer. and gas) and access (12' -0" wide driveway).
a. Ref. sca 6.03.03 Certain proposed streets, where appropriate, shall be
extended to the boundary line of the tract to be subdivided so as to provide
for normal circulation oftraffic within the vicinity. Consideration shall
be given to vrovidinf! access to ad;acent, underdeveloped tracts of
f!fowtd, including temporary vehicle turnaround \vhere streets are
extended to a tract boundary line.
b. Ref. sca 6.05.01 AHlots shall abut and have access to a street; said lots
each having a minimum frontage at the street right-of-way of {if tv (50)
feet. The required lot width cited in the zoning Ordinance shall be at the
building setback line.
c. The Community supports this access easement as evidenced by the
attached petition, which was signed by 100% of homeowners adjacent to
the proposed Clay Creek development. The access easement poses no
safety threat, will not affect adjacent lot values, and benefits the
community due to increased resale values of nearby properties.
For all of the foregoing reasons, the undersigned property owners hereby object to the

It is our position that if a road is designated as a Collector then it should comply with
construction requirements [or same. A cited example of an exception to this is Lake
Shore Drive West however it measures 40 feet wide curb to curb.
We were aImexed by the city of Carmel with the promise of city services. Those services
were to include police and fire department protection as well as access to municipal
water. Inasmuch as direct access to a city street is currently nonexistent and that weather
conditions sometimes prevent ingress and egress through the current 1000-foot long
driveway we are requesting that an access easement be granted. The easement shall be
granted by the proposed developers of Clay Creek as shown in the attached modification
of the plat plan (Plan A or B).
For all of the foregoing reasons, the undersigned property owners hereby object to the
pro sed CIa fee plat plan.

Petition for the llroDosed Clay Creek lllat plan
We, the undersigned, request that the Carmel Subdivision Committee require
easement rights be granted to Dane W. and Beverly A. Love by the developers of
the proposed Clay Creek subdivision. This easement is intended to provide
access to and from their property (12011 Hoover Road) from Meeting House
Road as shown on the attached photograph. We feel that it would benefit the
community if easement rights were granted. This eliminates a land locked
property, which present day regulations do not permit.

My property at 12021 Hoover Road borders your proposed subject development on the
south side. I am requesting easement access to utilities for future hook-up.
At a meeting on June 19, 2007 with Carmel Mayor Jim Brainard, Michael HolhDaugh,
Department of Community Services and Dane Love, my neighbor we were informed that
developers of adjacent land try and provide easeqlents for access to utilities.

Dear Mayor Brainard,
I've attached two jpg files for your review and consideration.
The file titled "plat plan" is the latest revision to Clay Creek which is scheduled for the
June 28th Carmel Subdivision Committee meeting. My property is shown somewhat in
the center and titled "Love Deed Book 315". As you can see I am land locked with an
easement through the property adjacent and west. What I want is a private drive through
Clay Creek and rights to access municipal water, sewer, and gas.
The file titled "modified plat plan with overlay RA" shows what I think is an ideal
solution and better serves the community. The modifications include; a) Elimination of
the retention pond and the addition of a detention basin north of the proposed extension
oflvfeeting House Road b) Lot 12 was moved from the south side of Meeting I-louse
Road to the n01th side. This move along with the elimination of the pond will save at
least 1/2 acre of Mature Native Indiana Hardwood Trees. It also provides an approximate
2-acre park like setting that could be enhanced with the addition of a shelter and picnic
area. The park would be accessible from the proposed multi-use trail and from Meeting
I-louse Road. This modification \vould bring the proposed Clay Creek Subdivision closer
to compliance with SC07.05.07,c) Meeting I-louse Road was somewhat modified to
allow lot 12 to be moved, and d) The addition of a private driveway for access to my
property. This is consistent with SC06.05.01.
It should also be noted that Meeting I-louse Road is a "Collector Road" and plans are to
extend this road to the northwest tluough the Village of West Clay connecting to
126th Street and to the southeast where it will connect to Ditch Road. What this means is
that there will one day be a significant increase in traffic as the ll(?rthwest portion of west
Clay Township uses Meeting House Road to commute. The proposed subdivision does
not comply with SC06.03.19.
Clay Creek has been plated by ME Development Co., Inc. of Indianapolis (317)264-
1833. I have had some contact with Gary Merritt. Charlie Frankenberger represents
them.
