7. Corner Breaks. Each home shall have a mini mum of three (3) corner breaks on the front
and rear elevations. The exterior corners of a covered porch, the outermost corners of the

A. Front yard landscaping shall include sixteen (16) shrubs, eighteen (11\) inches in

26.02.1.91" Residential Districts:
A. One-half ofan alley abutting the rear of the lot may be included in the required rear yard.
B. The measurement for the required front yard of any lot accessed via a frontage place may
include the frontage place.
C. Where twenty-five percent (25%) or more of the lots of record in the block are occupied
by buildings, the average setback of such buildings determine the dimension ofthe front
yard in the block.
D. Building lines or building setback lines established in a recorded subdivision shall
establish the dimension of front yards in such subdivisions except such building setback
lines shall not be less restricting than this Ordinance.
26.02.20 In Business. Industrial and Manufacturing Districts:
A. One-half of an alley abutting the rear of a lot may be included in the rear yard but such
alley space shaH not be included for loading and unloading berths.
B. Where twenty-five percent (25%) or more of the lots of record in a block are occupied by
buildings, the average setback of such buildings shall determine the dimension of the
front yard in the block.
C. Parking is permitted in the required front yard in the Business and Industrial Districts.
26.03 Additional Lot Area and Widtb Roouirements.
26.03.01 Where a lot of record has less area than herein required in the district in which it is located, and
was of record on December 21, 1957, and the owner of such lot does not own any other parcel or
tract adjacent thereto, said lot may nevertheless be used for a dwelling or for any non-dwelling use
permitted in the district in which it is located.
26.03.02 In no circumstances, other than on a lot of record, shall the minimum lot width and lot size be less
than that provided by this Ordinance; however, the State Board of Health or the Hamilton County
Board of Health may prescribe an increase in those minimums in accordance with their
regulations.

26.03.03 Double frontage lots should not be platted except along arterial streets where lots may face on an
interior street and bock up to such thoroughfares. In that event, a planting strip easement, at least
twenty (20) feet in width, shall be provided along the back of the lot.
26.04 Perimeter Bufferio2 ReCIIllliremcUlts.4
26.04.01 The requirements of this Section shall apply to all Special Uses, Subdivision Plats, properties
containing multi-family uses, and properties within all Business, Manufacturing, and Industrial
districts, unless other buffer or perimeter planting standards are specified within an individual
district or zone.
26.04.02 Where required, perimeter buffering shall be located along the front, side and rear lot lines of a
lotJparcel and shall extend the entire length ofthe front. side and rear tot lines.
46.04.03 Where residential or other buildings back onto a public thoroughfare, buffer plantings shall occur

26.04.04 Perimeter buffering shall not be located within any portion of a dedicated public street right-of-
way, private street right-of-way, or County regulated drain easement.
26.04.05 Existing vegetation may be used to achieve project buffering if:
(a) the vegetation located upon the subject parcel is of a quality and state of health to achieve
buffering, and,
(b) the vegetation is proposed to be preserved using accepted best management practices for
tree protection during construction.
26.04.06To determine the applicable bufferyard requirements:
(a) Use the Table for Bufferyard Determination to identify the land use category of the
proposed project use.
(b) Use the Table for Bufferyard Determination to identify the land use(s) of the adjoining

COMMITMENTS CONCERNING THE USE
AND DEVELOPMENT OF REAL ESTATE
ME Development Co., Inc., the contract purchaser of the real estate located in Hamillon
County, Indiana, and described in what is attached hereto and incorporated herein by referenced
as Exhibit "A" (the "Real Estate"), makes the following Commitments (the "Commitments")
applicable to the Real Estate.
Section 1. Definitions. Ditferent words and terms are defined throughout these
Commitments and. further, the following definitions shall apply throughout these Commitments:
I. ARB: The Architectural Review Board established by the Devcloper in the Declaration
of Covenants.

Declaration of Covenants. A Dec laration of Covenants, Conditions and Restrictions ror
the Real Estate which shall be prepared by the Developer and recorded in the office of the
Recorder of Hamilton County. Indiana, and which may, from time to time, are amended.
Department. The Department of Community Set'vices of the City of Carmel, Indiana.
Developer. ME Development Company, 1m;., its successors and assigns.
Historical Architectural Style. Historical Architectural Styles arc established by and shall
mean and refer to such homes as (i) colonial homes, (ii) cape cod homes, (iii) craftsman
homes, (iv) traditional farmhouse homes, (v) french country homes, or (vi) homes with
various exterior architectural clements, taken from the foregoing, to create more recent
versions of the foregoing.
Homeowners Association. Anoilprofit corporation established for the promotion of the
health, safety and welfare of the residents of the Real Estate once developed, and to
manage, maintain, and repair the common areas within the Real Estate and any
improvements located thereon.
Lot A parcel of land designated as such upon the Plat (as l1ereinafter defined) upon
which there is constructed one (1) si ngle detached home.

which form the peak of a pitched area.
Section 2. Commitments Applicable to the Real Estate. The following commitments are
applicable to the Rea] Estate:
I. Density. No more than 30 single family residences shall be constructed upon the Real
Estate.
2. Masonry Recluirements.
A.
Subje(.'[ 10 Section (2)(B) immediately below, Masonry shall be the
exterior building material on the first tloor of the front, side, and rear elevations,
excluding doors, garage doors. windows, and other openings.
B. The Masonry requirements may be modified by the Developer's Archile(.'tural
Review Board (the" ARB '") for up to lOaf the residences with a Historical
Architectural Style.
3. Minimum S(lUare Fomage.
A. One-story homes shall have a minimum living, area of 2,500 square feet. exclusive
of garages. basements, porches, carports and any unfinished area.
B. Two-story homes shall have a minimum living area of :';000 square feet,
exclusive of garages, basements, porches,.carports and any unfinished area,
C. AI least seventy percent (70%) of the residences shall have a mi nimum I iving area
in excess of 3,000 square reet, exclusive of garages, basernenls, porches, carports,
and any unri nished area.
4. Permitted Exterior Building Materials. Permitted Exterior Building Materials shall be

A. All homes shall have a minimum of three (3) ridgelines: provided, however, that
when fewer is consistent with a Historical Architectural Style, a minimum of two
(2) ridgelines shall be pennitted.

peak of a pitched area. Covered and enclosed porches shall count as a ridgelinc.
7. Corner Breaks. Each home shall have a minimum of threc (3) corner breaks on the front
and rear elevations. The exterior corners of a covered porch, the outermost corners of the
home, and a projection with a height of no less than six feet (6') shall counltoward this
requirement.
8. Front LandscapinQ:.
A. Front yard landscaping shall include sixteen (16) shrubs, cighteen (18) indIes in
height at the time of planting.
B. Front yard landscaping shall include at least I yard tree (2'" minimum caliper
outside planting bed).
I 9.
Tree Preservation. Tree preservation areas are outlined in yellow on the Tree
Preservation Plan attached hereto and incorporated herein by reference as Exhibit B. As
shown. tree preservation areas are located in common areas and not upon Lots. Except as
noted below. each Builder, Developer. Owner, and the Homeowners Association shall
preserve trees within the tree preservation areas, and shall not remove trees:
A. The clearing of dead trees shall be allowed~
B. The removal or trees for public health and safety shall be allowed
Miscellaneous.
A. All new homes, landscaping and exterior color plans must be approved by the
ARB prior to beginning construction.
B.
All driveways shall be concrete unless otherwise approved by the ARB.
C. Uniform mailhoxes, as determined hy the ARB, shall be required.
D Dusk to dawn yard lights shall be required in a uniform location, as determined by
the ARB.

Section 3. Binding on Successors. These Comrnitl1lent~s are binding on the Developer, each
o(herperson acquiring an interest in the Real Estate, unless modified or terminated by the
Commission, These Commitments may be modified or terminated only by a decision of the Plan
Commission after a public hearing wherein notice as provided by the rules of the Plan
Commission has been made. The provisions of this Sect.ion _ notwithstanding, these
Commitments shall terminate as to any part or parts of the Real Estate hereafter reclassilied
(rezoned) on the Cities" Official Zone Map.
Section 4. Effective Date. The Commitments contained herein shall be effective upon the
occurrence of all of the fol lowing events:
I. The commencement of the development of the Real Estate
Section 5. Recording. The undersigned hereby authorizes the Secret.ary of the Commission to
record these Commitments in the Of rice of the Recorder of Hamilton County, Indiana.
Section 6~ Enforcement. These CommitmenLs may be enforced by the Common Councilor the
