9. Docket No. 07030037 DP/ADLS: Midland Atlantic-Market Place at West Carmel
The applicant seeks site plan and design approval for a proposed one-story, 21,600-square foot
retail building on 2.73 acres. The site is located at the northeast comer of 98111 Street and
Michigan Road, and is zoned B3lBusiness, and is within the US 421 Overlay.
Filed by Paul Reis of Bose McKinney & Evans, LLP for Midland Atlantic Properties.
This site is just south of and adjacent to the West Carmel Marketplace development. The Plan
Commission is also reviewing a project just north of this site: the Burger King at West Carmel
Marketplace. The site has recently been rezoned from Sl to B3. The architecture complements
that of West Cannel Marketplace to appear as a seamless expansion southward. Please refer to
the info packet for further detail.
DOCS concerns/comments:
1. The petitioner should provide a sign package with greater detail regarding each wall
sign's square footage, color (preferably white to match West Carmel Marketplace), etc.
2. The City Forester, Scott Brewer, is still reviewing the plan, but has tentatively approved
the landscape plan.
3. The petitioner should provide County Surveyor and Engineering Dep't approval updates.
4. The petitioner should re-check or amend the percent of stuccolEIFS on the facades to
make sure they comply with the US 421 Overlay requirements. Right now, they show an
overa112l.47% stucco/EIFS, whereas the ordinance requires 20% or less.
At the July 17 meeting, the petitioner said he would work with Duke Realty to address the issue
of the drainage at West Carmel Marketplace and how it affects the adjacent neighbors to the
south. The following is what has been found out from the Hamilton County Surveyor's Office:
This issue has been brought up in the PC meetings before. One of our inspectors met with one of
the property owners along 98th Street, and our inspector believes there is a private tile that
either was notpicked up in West Carmel Marketplace or the trees planted over the tile have
blocked off the tile with their roots. Our inspector requested the property owner submit a letter
stating their complaint. and then we could go back (0 Duke to resolve the issue. To date, we
have never received the letter, nor heard anything else from these property owners. If these
people want help resolving this issue, they need to work with our office. They can contact our
office at 776-8495 and file a drainage complaint or talk with Jerry Liston, who has been dealing
with this issue.
Also, at the July 17 Plan Commission meeting, the plan commission suggested planting 8-10 ft
conifers along the east property line, to better screen the east parking lot, rather than the 6-7 ft
trees.
The Department recommends the Committee forward this project with a favorable
recommendation to the full Plan Commission after all comments/concerns are addressed.
