Docket No. 07030037 DP/ADLS: Midland Atlantic-Market Place at West Carmel (now called West Carmel Shoppes) The applicant seeks site plan and design approval for a proposed one-story, 21 ,600-square foot retail building on 2.73 acres. The site is located at the northeast comer 01'98111 Street and Michigan Road, and is zoned B3/Business, and is within the US 421 Overlay. Filed by Paul Reis of Bose McKinney & Evans, LLP. This site is just south of and adjacent to the West Cannel Marketplace development The Plan Commission is aLso reviewing a project just north of this site: the Burger King at West Cannel Marketplace. The site has recently been rezoned from S 1 to B3. The architecture complements that of West Carmel Marketplace to appear as a seamless expansion southward. Please refer to the info packet for further detail. DOCS concerns/comments: I. The petitioner should provide Hamilton COUllty Highway Dept approval updates. 2. The petitioner should provide Hamilton County Surveyor's Office approval updates. 3. The City Forester, Scott Brewer, is stil1 rcviewing the plan, bUl has tentatively approved the landscape plan. 4. Thc petitioners will need variance approvals from the BZA tor the total munber of signs (per tenant) and having two signs facing the same road right-of-way. 5. The proposed sign l:Olors of green, white and black are acceptable. Allowing the Cannel Sign Ordinance to determine the square footage of each sign is also acceptable ,. , At the July 17 meeting, the petitioner said he would work with Duke Realty to address the issue of the drainage at West CanTle! Marketplace and how iT affects the adjacent neighbors to the south. The following is what has been found out from the Hamilton County Surveyor's Office: This issue has been brought up in the PC meetings before. One afoul' inspectors met with one of the properZv owners along 98th Street, and our inspeclOr believes there is a private tile that either was not picked up in West Carmel Marketplace or the trees planted over the tile have blocked off the lile with their roots. Our inspector requested the property owner submit a letter stating their complainl. and then we could go hack to Duke to resolve the issue. To date, we have never received the letter, nor heard anything else ji-'om these properly owners. If these people want help resolving this issue. they need 10 ~vork with our office. They can contact our office at 776-8495 andjile a drainage complaint or talk with Jerry Liston, 'who has been dealing with this issue. At the Aug. 7 Special Studies committee meeting, the Committee voted: 3-0, positive recommendation conditioned upon additional submittals: 1) Landscape plan showing the sidewalk 2) Delineated Fayade Breaks (or variance) 3) Planltimeline for resolution of drainage issues, and 4) Detailed Sign Package. The an.;hitect is also going to eliminate the Fypon and reduce the percentage of EIFS. As of 8/13/07, George Small of DesignPoint (one of their architects) has confirmed that the EIFS surface of the building eomes in at 19%, and does not exceed the 20% maximum allowed by the ordinance. The Department of Community Services recommends the Plan Commission approve this item, after all comments/concerns are addressed.
