Commitments Concerning the Development of Real Estate
F.e. Realty Thiliv Nine LLC (hereafter, "Owner"), makes the following Commitments to the J)..Yf
Carmel/Hamilton County Surveyor's Office ("Government Entity").
Description of Real Estate:
See Attached Exhibit "A"
Statement of Commitments:
The Owner ofthe Real Estate agrees to install certain stormwater drainage tile in
accordance with the plans identified as Exhibit "B", attached hereto and previously approved by
the Hamilton County Surveyor's Office. The Owner shall complete the required 'v'lork by
October 31, 2007. This document shall not be recorded nor be effective until such time as Owner
takes title to the Real Estate.
Binding on Heirs, Successors and Assigns. These commitments are binding on the owner of the
Real Estate, each subsequent owner of the real estate, and each person acquiring interest in the
real estate, unless modified or terminated by the go'lenmlental authority authorized to modify.
Recording. The undersigned agrees to record these commitments in the Office of the Recorder of
Hamilton County, Indiana, upon granting ofthe approval of the project.
Enforcement. These commitments may be enforced by the Carmel Plan Commission and/or the
City of Carmel, Indiana.
