Mark,
Based on the information you have provided I am using a 4,848.50 average daily consumption. This would figure to
145,455 gallons per month. One e.d.u equals 9,000 so if you divide 145,455 by 9,000 it figures to 16.16 edu's. One edu is
$1396 so the connection fee would be $22,559.36 which is payable at the time the building permit is pulled.
There is also an availability fee of $1010 per acre. I am not sure how many acres there are. There will be a $150 review
fee also.
As far as the retail is concerned, the connection fee is figured at one edu per 1,000 sq. ft. So, 17,600 sq. ft. would be 17.6
edu's or $24,56960. Retail space is tough because we really have no idea what will be going in.

Can you verify that this project is in your service territory and not IWC's? It is Weston Park,

was IWC's territory by IWC. You received this project as a part of the TAC submittal on June

I am confused by the location you mention. It appears that Mayflower Park
Drive is quite a ways west of our site. The site I am speaking of is at the SW
quadrant of US 421 and 106th Street, directly south of the Ford dealership and
directly west of the National City Bank (bank address;;:: 10570 Michigan Rd). I
just received a drawing from Kite this morning that has the water plan. It is
your job J04-021 and the line I am speaking of is an 8" PVC along a private
drive.

Dear Ms. Conn:
We have received your July 9, 2007 review letter of the Final Engineering plans for the
proposed LA Fitness at Weston Park, Block A in Carmel, Indiana. We have revised the
drawings accordingly and bubbled all modifications. The following are our written
responses to your comments:
1.) Remember to include the DP application Finding of Facts sheet in your info packets.
Response:
The DP Findings of Fact Sheet will be included in the Carmel Plan Commission
Packet submittal, delivered on August 10.
2.) Provide the filled out and notarized affidavit of notice of public hearing page.
Response:
The notarized Affidavit of Public Notice will be sent to you by August 17, as
required.
3.) Provide the filled out and notarized Public Notice Sign Placement affidavit.
Response:
The notarized Public Notice Sign Placement Affidavit will be sent to you by
August 17, as required.
4.) Provide a copy of the Official list of Adjacent Property owners from Hamilton County
Auditor's Office. Make sure you also get the Official list of Adjacent Property owners
from the Boone County Auditor's Office.
Response:
Adjacent property owners from Hamilton County and Boone County have been
notified and green cards have been returned. The list and certified mailings
receipts will be sent to you by August 17, as required.
5.) Bring materiallcolor samples to the Plan Commission meeting.
Response:
A material/color sample board will be presented at the Carmel Plan Commission
meeting.
6.) Provide an aerial photo with site plan overlaid on it.
Response:
The aerial photo with site plan overlay will be included in the Carmel Plan
Commission Packet submittal, delivered on August 10.
7.) Show the mechanical equipment location and how it is screened from view.
Response:
All top of parapet heights will exceed the height of the tallest roof-top mechanical
unit. Rooftop mechanical equipment will not be visible from any ground level
view or sightline. This is a consistent standard for all LA Fitness corporate
prototype models.
8.) LA Fitness Signage: you propose two wall signs, each 238.54 sq ft. The Sign
Ordinance only permits a 115 sq ft sign facing 1061h Sf. and a 90 sq ft sign facing US
421. Please reduce the signage size or seek variance approval from the BZA.
Response:
The signage on the East elevation has been reduced to meet the 115 SF
allowance. The signage on the North elevation has been reduced to meet the 90
SF allowance. The drawings have been updated to reflect these revisions.
9.) Signage: please provide sign age details! cut sheets.
Response:
Actual shop drawings for the Signage details will be include in the Carmel Plan
Commission Packet submittal, delivered on August 10.
10.) Lighting: please provide fighting fixtures detailsl cut sheets.
Response:
Light fixture data sheets will be included in the Carmel Plan Commission Packet
submittal, delivered on August 1 O.
11.) Please verify measurement scale on building elevations.
Response:
An accurate scale will be shown on all drawings.
12.) Please provide bike parking, per Chapter 27.06 of the Zoning Ordinance.
Response:
Bicycle parking has been shown on Sheet C2.1 and described as Note 20.
13.) Please add 1/3 RIW to the 50-ft measurement on 10&h Street, per the 20- Yr
Thoroughfare Plan. Verify this R/W with the County Highway Department.
Response:
Right-at-way indications along 1 06tl1 Street have been clarified with the Surveyor
and will be noted on a forthcoming revision to Sheet C2.1.
14.) Please consider using pervious pavers in the parking lot.
Response:
We are not able to utilize pervious pavers in the parking lot for this project.
15.) Please consider using "green" building practices.
Response:
As a standard, we try to practice sustainable architecture where Ordinance and
budget allows. Some of the considerations for this building include daylighting,
recycled material use, and a decreased use of steel framing and gypsum drywall
beyond the LA Fitness corporate prototype model. Additionally, the Project
Architect is certified as a LEED Accredited Professional.
16.) Provide pedestrian/ bicycle connections within the site, and to the streets.
Response:
Pedestrian connections have been added at the Southwest corner of the LA
Fitness building and north trom the retail shops to 106tt1 Street, as discussed in
the TAC meeting and per David Littlejohn's request. This addition will be
reflected on the revised Sheet C2.1 .
17.) Site Plan: Showl label the bufferyard/landscape setbacks; see chapter 26.04 and
23C.10 of the Ordinance.
Response:
Per our discussion, we are required to meet the Class A bufferyard requirements
(5' -0" along 106th Street and side yard and 10'-0" rear yard). The revised Sheet
C2.1 adds the required bufferyard notations, including the 5'-0" along the outlot
and the building setback notations. Per our discussion, the 30'-0" greenbelt
requirement does not apply on the east side at the site, as we do not have
frontage on Michigan Road.
18.) Building Material: What is alumina specialty finish coating most simifar to? Stucco?
Response:
The Alumina specialty finish coating offers a more genuine stone appearance,
with the use at natural aggregates and greater surface texture. A material
sample will be provided on the material/color sample board.
19.) Architecture: variance approval from the alA may be required for faqade
projections/ recession; see chapter 23C.09.D of the zoning ordinance.
Response:
Additional projections have been added to the North and East fac;ades of the
building. These projections exceed the 8'-0" requirement.
20.) Please provide the building material percentage breakdown. Stucco, dryvit, or
equivalent cannot make up more than 20% of the overall non- window faqade area, per
chapter 23.09.K.2.e of the ordinance.
Response:
E.I.F.S. accounts for 17% of the overall non-glazing elevation area. All vertical
surface areas will be the upgraded Alumina specialty finish coating. Standard
E.I.F.S. will only be used in cornice applications. Other materials include
structural brick, cultured stone and slate tile.
21.) Future Retail Building: will the elevations, signage, lighting, landscaping be
submitted for approval at a later date under a separate docket no. ?
Response:
Our request includes site plan approval for the retail building; however, building
elevations, building lighting (if any), signage and foundation landscaping will be
submitted separately at a later date.
22.) The maximum parcel coverage (buildings and pavement) is 90%. Please provide
your lot coverage.
Response:
Parcel coverage is 73%, which is less than the allowed 90% coverage. The
percentage will be indicated on the revised Sheet C2.1.
23.) Please show/ provide building address numbers that comply with Sign Chart C in
Chapter 25.07.
Response:
Building address numbers are now shown on the East elevation of the building.
24.) Show/label the 15-ft front yard setback along 10(jh Street.
Response:
The 15'-0" front setback along 1 06lh Street has been added to Sheet C2.1.
25.) Work with Scott Brewer, City Forester, on the landscape plan approval and number
of plating required.
Response:
Per T AC comments from Scott Brewer, we have replaced the Hop Hornbeam
trees as requested. We have also shifted the parking and landscaping along the
west side of the site to clear the regulated drain, as requested by the Surveyor's
Office. Additionally, we have double checked the count of interior parking lot
trees; we have 52 trees, which does exceed the required 51 trees (for 459
parking spaces), therefore we feel we have complied with ordinance
requirements. We previously sent Mr. Brewer a copy of Sheet L 1.2, Landscaping
Details.
It is our understanding that this letter addresses the concerns of the City of Carmel. The
project team will continue to work through other T AC agency comments prior to building
permit issuance. We will provide you with copies of any T AC correspondence we
receive by August 10.

please advise at your very earliest convenience.

Yes, we can allow you to encroach with the landscape up to 5' or so. What I will need is
an Individual Non-enforcement agreement for the encroachment of the landscaping and the
appropriate fee. This form is available on our website with the outlet and others. We
will take it to the Drainage Board and will recommended approval to the board. This would
allow the landscaping in the easement as an encroachment, that would could remove in the
future if they are in our way for maintenance of the drain. Being that we still have 25'
or so of clear flat area, I would not see that happening, but it still makes everything
official. You will need to have the owner of the property sign the N.E., whether that be
Kite or LA Fitness at this time, I don't know. If you have any questions, please let me
know.

Just wondering if you had the opportunity to chat with Kent to see if we were OK with the
slight easement encroachment at the south edge of the parking lot? We are hugging the
landscaping close to the parking lot and they are only a few feet into the easement, with
a good deal of flat area before the detention area.
We have fixed the west side as discussed, including piping the portion of the drain you
are requiring plus moving the parking east so the plant material is out of the easement.

I reviewed one additional items on the LA Fitness plans when I got back to the office from
TAC and have one additional comment that I missed on my review letter.
No landscape planting will be permitted or allowed within the existing regulated drainage
easements per Indiana Code 36-9-27-33 (d). The landscape plans show several trees within
the existing platted easement for the Park Northwestern Drain. This platted easement is
our only maintenance access to the drain, as the other side pretty much has buildings up
to the top of bank of this drain/detention area. If the trees are planted as they are
shown of the L.S. plan, they will grow to a point where they completely block off the
"flat" maintenance area to the point you will not be able to even drive a pick up along
the drain, let along take heavy equipment down the easement when maintenance is required.
One the section along the west property line, it appears the parking lots is extending
right to the top of bank and the trees will need to be planted on the slope of the ditch,
which will hinder maintenance access even more.

please review the landscape plans and make the necessary changes that will allow for us to
maintain our existing drain without being hinder by newly planted buffer area trees.

We have reviewed the construction plans submitted to the Bamiltou County Surveyor's
Office on June 22, 2007 for this project and have the following comments:
1, The project in located in tlJe unincorporated area and MS4 jurisdiction of
Hamilton County.
2. The projoct faUs in the Park Northwestern Regulated Drain Watershed.
). The proposed site DOES NOT fall in a Caunel Wellhead protection Area.
4. The detention for this site was master plann.ed with the design of Weston Park.
5. Please s.ubmit an outlet permit (2 outlets) for the direct discharge to the Park
Northwestern Regulated Drain. The application is available on our website at
htLP:/lwww.co.hamilton.in.l1s. go to Departments. Surveyor, and Forms.
6. While the detention is provided, the drainage calculations seem to use a Rational
<<C" value that seems to low for this site use. TI)e Hamilton County Stormwater
Technical Standards Manual suggests a 0,85 Runoff Coeffici ent for Business,
Commercial, and Industrial uses (Tab Ie 201-1 on page 200-7). This would seem
to be a wore appropriate number then the 0.67 used in the drainage calculations
provided for this proj ect.

7. The open ditch along the west side of this parcel-ls part of the Park Northwestern
Regulated Drain. W'hen Weston Park was platted, the intent was the open ditch
would be piped from l06111 Street south to where the detention area begins, which
is what the easer,nent wi.dth was based on. Since the open ditch is remaining, the
easement is not sufficic::nt to cover the open ditch, let alone provide maintenance
access along the drain. If the open ditch is to remain, HCSO will require 25'
Regulated Drain Easement grant beyond the existing easement. HCSO would
l1ave no problems with parking area remaining jn the easement, but the trash
enclosures would be an obstacle to the maintenance access. This can be discussed
in more detail in the near future.
8. Please provide about 3 cross-section views of the open ditch along the west side
of the project, including the parking lot to the top of bank.
9. Wbat pipe material is being used on this site? HCSO will require the pipe located
within the Park Northwestern Easement to be RCP so we oan still maneuver
heavy ma.chine in the easement at the time maintenance is required.
10. HCSO would prefer the Aqua-Shield BMP Structures not be placed within the
Park Northwestern RDE. The property owner will be responsible for the
maintenance of the BMP, but location within the easement could hinder
maintenance access.
ll. How are the existing curb inlets being addressed that end up in the drive isles?
These structw:es are also part of the Park Northwestern Drain a.."1d any changes
will need to be approved by us and as-built changes submitted back to HCSO.
12. Please address all comment from the SWPPP review by Bob Thompson of

3. It is impractical to change the term "Erosion Control Plan" to "SWPPP" as we have a Sheet C4.1 titled
Erosion Control Plan, a Sheet C4.2 titled Erosion Control Details and Sheet C4.3, which is the SWPPPIStorm
Water Pollution Prevention Plan. All three of these sheets make up the package to address the Rule 5
requirements.
4. The requested language has been added to item C5 on Sheet C4.3 to address providing copies of the
inspection and maintenance reports to your office. This was covered in our previous response to you on July
9 but had gotten eliminated when we reformatted the sheet to meet your requirements on July 12.
5. See Sheet C4.3 for revised language in the Dewatering and Pumping Operations section to address your
requirement for dewatering bags.
6. Your office has been added to item H on Sheet C4.3 under the spill alert procedures.
7. As addressed in our previous submittals, post-construction water quality is accomplished through the use of
two BMP units as shown and detailed on the plans. All of the developed areas of the site are routed through
the BMP units. We have added additional language to Sheet C4.3 (item C6) to address trash removal, lawn
and landscape maintenance, noted the existing detention device and proposed outfall protection, etc.
8. We will send you a full-set of plans after we get through the TAC meeting and assuming the above meets
with your approval. Greg has a full-set of plans in case you need to look at them in the meantime (the only
sheets that have changed from the full-set are the ones that you have been sent addressing your comments).

The technical review and comments are intended to evaluate the completeness of the Construction/Stormwater Pollution
Prevention Plan for the project. The Plan submitted was not reviewed for the adequacy of the engineering design. All
measures included in the plan, as well as those recommended in the comments should be evaluated as to their feasibility
by a qualified individual with stmctuml measures designed by a qualified engineer. The Plan has not been reviewed

The construction component of the Stormwater Po{[ution Prevention Plan includes stormwater quality

I think we can change the angle of the sanitary sewer counterclockwise to make a straight shot eastwardly out of the building
(rather than angled) and then we can locate c1eanouts in each of the three islands to address your comments #1 and #2. OK?
Regarding #3, we will add the type 1 c1eanout detail for the one at the building, but am thinking we will not need the Type 2
cleanout detail any longer since we can move the c1eanouts of the paved areas - agree?
Otherwise, comments #4 thru #13 are straightforward and we will proceed accordingly.

Thanks for your reply. Our client does not think 35 gpd is a reasonable number. Attached is a spreadsheet for two other
similar sized facilities showing actual water meter readings. These average out between 20 and 25 gpd/person. There is
a juice bar with a couple of sinks and an ice machine, but no food prep.

As far as the application goes we do use the 327 lAC 3-6-11 as a general rule of th umb the calculation of 210 people is
acceptable but because this facility has showers we will need to use 35 gpd per person as a calculation. Will you have
any food preparation areas within the facility?

In speaking with the Director and looking at the zoning ordinance, the fa<;ade projections/recessions depths shown on the
LA Fi1ness building will require a variance request approval form the BZA, due to them not being 8-ft deep.
The Department will most likely be in support of your variance request, and so, one option is to appear before a Hearing
Officer of the BZA. It is one member of the 5-member Board, the fee is less, and the public notice deadline is 10 days
prior to the BZA meeting, rather than 25 days.

I wanted to take care of your comments while they were still fresh. We received Greg Hayes' comment letter trom your
office last week but I am waiting to address his comments until we go thru the TAC meeting tomorrow to see il the city or
anyone else has any changes that might affect the drainage. The following is a response to your various emails from
7/13:
1. As requested. we added the pre-con and NOI language to the Pre-construction activities as item #1 on attached
Sheet C4.3.
2. We addressed your seeding fertilizer comment in our previous submittal to you on July 9th. See our response
letter item #9 and revised Sheet C6.5 (change bubbled with revision triangle A).
3. It is impractical to change the term "Erosion Control Plan" to "SWPPP" as we have a Sheet C4.1 titled Erosion
Control Plan. a Sheet C4.2 titled Erosion Control Details and Sheet C4.3, which is the SWPPP/Storm Water
Pollution Prevention Plan. All three of these sheets make up the package to address the Rule 5 requirements.
4. The requested language has been added to item C5 on Sheet C43 to address providing copies of the inspection
and maintenance reports 10 your office. This was covered in our previous response to you on July 9 but had
gotten eliminated when we reformatted the sheet to meet your requirements on July 12.
5. See Sheet C4.3 for revised language in the Dewatering and Pumping Operations section to address your
requirement tor dewatering bags.
6. Your office has been added to item H on Sheet C4.3 under the spill alert procedures.
7. As addressed in our previous submittals, post~construction water quality is accomplished through the use of two
BMP units as shown and detailed on the plans- AI! of the developed areas of the site are routed through the
BIV1P units. We have added additional language to Sheet C4.3 (item C6) to address trash removal, lawn and
landscape maintenance, noted the existing detention device and proposed outfall protection. etc.
8. We will send you a full~set oi plans after we get through the TAC meeting and assuming the above meets with
your approval. Greg has a full-set of plans in case you need to look at them in the meantime (the only sheets
that have changed irom the full-set are the ones that you have been sent addressing your comments).

transportation. I have reviewed the drawings submitted for the July 18,.2007 Teclmical Advisory Committee and
offer the following comments:

1) Please revise the plans to connect all internal sidewalks as much as possible
We request that all responses to our comments be provided in writing. Failure to provide written responses may
result in delay of the review process.
It is critical that this office be made aware of all modification made on the plans being re-submitted, particularly if
any such changes are considered "new" or fall outside of our previous reviews. Please provide revised plans
indicating all revisions. Please notify us of any changes and specifically state any changes, including changes
resulting from Plan Commission, Special Studies or other conm1ittee meetings.
The Department of Community Services reserves the right to provide additional comments based on subsequent
reViews.
