Petition to rezone parcels from B-I/Business, B-2/Business, B-3/Business and 1-
lIIndustrial to C-2/0Id Town~ The sites are located in Old Town and along Third Avenue
SW. Filed by the Department of Community Services.
Please find enclosed the Plan Commission-certified ordinance to amend Rezone parcels to the C-
2/01d Town District. The proposal was forwarded with a positive consideration and two
conditions: 1. Remove parcels along First Street SW, and 2. The eRC will consider privacy and
sun-rights issues as development i's proposed for the parcels.

PLAN COMMISSION'S RECOMMENDATION
ON THE PETITION OF THE CITY OF CARMEL
TO REZONE 56 PARCELS IN OLD TOWN AND ALONG THIRD AVENUE SW
PURSUANT TO INDIANA CODE 36-7-4-605

Dear Members:
The Carmel Plan Commission offers you the following report on the application (Docket Nos. 07070024 Z
& 07080030 Z) of The City of Carmel, petitioning the Commission for a favorable recommendation to
rezone 56 parcels located in Old Town and along Third Avenue SW, from B- L/Business, B-2/Business, B-
3/Business, and I-I IIndustrial to C-2/0Id Town.
The Carmel Plan Commission's recommendation on the petition of the applicant is "FAVORABLE."
At its regularly scheduled meeting on September 18, 2007, the Carmel Plan Commission voted seven (7) In
Favor, one (1) Opposed (Eric Seidensticker), zero (0) abstaining, to forward to the Cornmon Council the
proposed Ordinance Z-510-07 with a FAVORABLE recommendation with the following Conditions: a) 3
parcels were removed from the list of affected parcels to be rezoned, and b) that sections for privacy and sun
rights will be prepared for each projecUsite.
Please be advised that by virtue ofthe Plan Commission's Favorable Recommendation, pursuant to IC 36-7-
4-608(f)(4), the Council has ninety (90) days to act on this petition before it becomes effective as Certified
by the Commission. Ninety days from the date of thJS Certification (September 20, 2007) is Tuesday,
December 19, 2007.

3 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF CARMEL,
4 INDIANA, REZONING DISTRICT CLASSIFICATION

6 Rezoning properties in Southwest Old Town from the B-l/Business, B-2/Business, B-3/Business
7 and l-l/Industrial District Classifications to the C-2/0Id Town District Classification
8

10 WHEREAS, pursuant to Indiana Code 36-7 -4, the Common Council has lawfully adopted
11 a zoning ordinance, the terms of which are applicable to the geographic area consisting of the
12 incorporated area of the City of Cannel, Indiana, and the unincorporated area of Clay Township,
13 Hamilton County, Indiana, which zoning ordinance has been codified in Chapter 10 of the
14 Carmel City Code; and
15
16 WHEREAS, pursuant to Indiana Code 36-7-4-602 the Common Council is authOlized to
17 amend the map that is part of the zoning ordinance; and
18
19 WHEREAS, the Carmel City Council of the City of Carmel, Indiana received a favorable
20 recommendation from the Cam1el Advisory Plan Commission on Tuesday, September 18, 2007,
21 regarding the rezoning of the real property, the property description of Exhibit A, and which is
22 illustrated in the location map of Ex bib it B also attached hereto.

24 NOW, THEREFORE, BE IT ORDAINED, by the Common Council of the City of
25 Carmel, Indiana, as follows:

27 Section 1. That the Official Zoning Map accompanying and made part of the Zoning
28 Ordinance is hereby changed to designate the real property from the B-IIBusiness, B-2/Business,
29 B-3IBusiness and I-1/Industrial District Classifications to the C-2/0Id Town District.

31 Section 2. All prior Ordinances or parts thereof inconsistent with any provision of this
32 Ordinance are hereby repealed.

34 Section 3. This Ordinance shall be in full force and effect from and after its passage and
35 signing by the Mayor.

37 Ordinance Z-SlO-07 PASSED by the Common Council of the City of Carmel,
