As you are aware, the Department of Engineering has been involved with the petitioner
since November of 2006 to improve the access to the property and to construct the parking
lot. In discussions with the petitioner related to these improvements, it became apparent
that the petitioner did not have approval to construct the proposed parking lot. The
Department did recommend to the Board of Public Works and Safety the proposed
modifications to the existing curb cut as such modifications could be made even if the on-
site improvements were to remain in their existing state. The BPW&S approved the curb cut
modifications on December 6, 2006. The Department indicated to the petitioner that
construction could commence for the curb cut modifications but requested that no work
commence for the proposed parking lot until it was determined that all proper approvals
for such work were obtained. Construction of the parking lot is the item being considered
by the Plan Commission at this point.
As it relates to the construction of the parking lot, Engineering provides the following
comments for the Plan Commission to consider in their approval:
1. Is the construction of the parking on-site necessary to comply with zoning requirements
or are the spaces simply desired by the petitioner?
2. The following is related to creating on-street parking in the area. I am unclear as to
the long term goal for this area:
a. If the City creates more on-street parking, would these spaces serve the needs of the
property?
b. With the potential rezone of the area back to residential, will the City pursue on-
street parking in the area?
(S) Could the plan bear to lose one proposed space on-site in favor of preserving the tree
~d creating new green space knowing that there will be future on-street parking spaces?
Is a variance needed for the proposed dimensions of the parking spaces?
~ 4. From what I understand, at the BZA hearing the petitioner committed that employees
would utilize off-site parking. The petitioner should confirm that the parking is being
constructed for customers.
5. The Department suggests that any approvals be conditioned upon adhering to the
requirements outlined in an email to the petitioner from Gary Duncan dated November 14,
2006 as well as the conditions of the BPW&S approval for the curb cut modifications. The
current plan does not represent the conditions of the BPW&S approval or the email noted
above.
6. The following comments are related to the site plan attached to the applica.tion:
a. While I have not discussed this with Mr. Hartmann, the current ordinance requires all
parking lots to be curbed with City Standard Curb unless water quality system necessitates
absence of such curb. The petitioner has indicated a curb along the east side of the
proposed parking lot; but not around the entire parking lot. The installation of a curb
may further help preserve the tree.
b. The curbing indicated does not meet current City Standards.

f. Engineering supports the preservation of the existing tree on the property. Engineering

actually provided a suggested parking layout to the petitioner in November of 2006 that
attempted to minimize the impact to the existing tree.
g. Engineering supports any efforts to utilize low impact improvements such as permeable
pavers.
h. Engineering indicated reservations related to the restricted area available to
construct an adequate parking area in accordance with accepted practice in previous
correspondence with the petitioner.
7. I have attached the previous exhibits issued to the petitioner for the Plan Commission
to consider. The parking lot layout ~as a suggestion to the petitioner and is by no means
an ideal layout.

\VHEREAS, pursuant to Indiana Code 36-7-4, the Common Council has lawfully adopted'

WHEREAS, the CarmellClay Plan Commission has favorably recommended the rezoning
orthe real property, the legal description and location map of which is attached hereto as
Exhibit A.
NOW, THEREFORE, BE IT ORDAINED, by the Common COllncil of the City of
Carmel, Indiana, as follows:
Section I. That the Official Zoning Map accompanying and made part of the Zoning
Ordimlnce is hereby changed to designate the real property from the R-3/Residcnce District
Classi fication to the B-l/Business District Classi fication.
Section 2. All prior Ordinances Or parts thereof inconsistent with any provision of this
Ordinance are hereby repe(lled.

The undersigned, Jennifer Hartmann (hereafter "O\\'ner"'), the Contract Purchaser of the
following described real estate located in Hamilton County, lndiana (hereafter "Real
Estate"), makes the following Commitments concerning the use and development of Real
Estate to the Clay Plan Commission ("Commission").
I. Description of Real Estate. See Exhibit "A" hereto ("Real Estate").
2. Docket No. Z-466-04 (Carey's Addition Lot 9)
3. Statement of Corrunitments.
A. Owner Commits to the following
I. As a part of the rezoning of 1 051 sl A vc. NE, we \'lfill have all
employees, with the exception of two, use the public parking
lot at the Lion's Club as a parking area.
4. Binding: on Successors and Assigns. These commitments are binding on
the Owner of the Real Estate, each subsequent Owner of the Real Estate
and each other person. acqui ring an interest in the Real Estate from the
Owner. These commitments may be modified or temiinated only by a
decision of the Commission made at a public hearing after notice as
provided by the rules of the Commission.
5. Effectiveness. These commitments are a condition to the approval by the
Commission of Carey's Addition Lot 9 Docket # Z-466-04.
6. Recording. The undersigned hereby authorizes the SecretHlJ' of the
Commission or the Director of the Department pfthe Community Services
to record these Commitments in the Office of the Recorder of Hamilton
County, Indiana following the approval of Carey's Addition Lot 9 (105 1 sl
Ave. NE) Docket # Z-466-04.
7. Enforcement. The Commission and City of Carmel, Indiana may enforce
these commitments.
