LLC i U Dear Members of the City of Cannel and Clay Township Plan Commission: LJ On October 16,2007, representatives of ESe II LLC., will appear before you to present the Petition for the approval of a Primary Plat with Subdivision Waivers. The 9.05:1: acre parcel is located at the southeast comer of the intersection of 106th Street and Spring Mill Road. The property is zoned S-2 Residential and lhe plat would establish three (3) residential lots and a common area. LJ L:J The property was previously improved with two single family residences that utilized a common driveway for vehicular access. The petitioner desires to construct three single family residences on the property utilizing the existing common driveway. The property is heavily wooded. The desire to add a third lot requires that the property be platted. The platting process raises a number of development issues which could result in the three lot development being no longer economically feasible. For example, the petitioner is being asked to donate approximately 1.1 acres for future ri ght-of-way improvements, either construct sidewalks that include several pedestrian bridges or make a monetary donation to the City of Carmel, and designate a significant portion of the property as a County legal drain. Each of these requests has a material economic impact upon the petitioner and the proposed subdivision. Although these requests are lypically associated with subdivision development, they can be unreasonably burdensome and unfair when applied to a subdivision of this size. As a consequence, the petitioner is requesting a minor reduction in the amount of right-of-way to be donated, a waiver of the obligation to construct sidewalk improvements, and a reduction in the required legal drain width. These requests will be discussed in greater detail at the pubLic hearing.
