The Claridge Faml Homeowners Association respectfully submits this .
Remonstrance to the Carmel Plan Commission as well as the attached Petition regarding
the effects of the planned development of Lakeland Subdivision in Carmel, Indiana.
Claridge Faml is a community of 218 homes located at 126th Street and Clay Center Road
and adjacent to the South property line of the property owned by Browning Investments
which is to be developed as Lakeland Subdivision.
The projected 10 acre development is currently and has been during the 15 years
since establishing Claridge Fann been a single dwelling residence and farm. The
property contains one major area of old growth deciduous forestation which incorporates
the Claridge Farm property line and approximately 100 feet of buffer zone.
The LakeIand A venue Street is pImmed to dissect that old growth and destroy
many trees in the process. We as homeowners purchased our homes and properties
adjacent to these acres paying premium values for the beauty and quiet provided by this
location. In fact, the estate homes of Claridge Farm are positioned, as with most
subdi visions, at the entrance to the neighborhood which are adjacent to this development.
The property values within Claridge Farm are set with these estate homes as the leaders.
\Ve simply petition for and request that the planned street which is parallel
to our property lines be placed a minimum of 42 feet from the property line and be
lined with evergreen trees to preserve our property values, decrease the
consequential noise of a street, avoid the creation of double frontage lots witb these
estate homes, and reduce the effects of runoff created by the street and elimination
of so many trees.
If the street is placed any closer to the Claridge Farm property line without the
addition of evergreen trees, the estate homes would become double frontage lots with a

visible street on both sides of the homes. Such placement would decrease our property
values significantly. We cannot plant evergreens on our properties due to the taller
deciduous trees along the property line which would stifle any younger tree growth and
due to the wet soil from the upgradient run off.
Although the storm water from the site is to be engineered to the Northeast sector
of the site, there will be storm water run otlfrom the eflects of the street and the
elimination of many trees. This area already experiences the effects of storm water run
ofT do to the natural topography of the middle section of the 10 acres, with the run off to
the South and onto Claridge Farm properties. We are concerned that the run offwiIl only
increase and cause a wetland area within Claridge Farm if the street is placed any closer
or without the addition of evergreen trees. It is essential that the street be placed a
minimum of 42 feet from the Claridge Farm property line and that evergreen trees be
planted along the street where it lies parallel thereto.
On July 30, 2007, Mark and Mary Ann Saggese, Claridge Farm homeowners and
President of the Homeowners Association Board of DirectOl's, met \\'1th Michael Bush,
Christian Browning, and Mike DeBoy of DeBoy Land Development to discuss the
planned development. During that meeting, Mr. Bush and Mr. Browning agreed to set
the street back a minimum of 42 feet off the property line, to preserve the trees up to the
street and to install evergreen trees along the street as a year-round buffer between the
properties.
It should be recognized that the Lake1and Subdivision is a development for only
four. to five residences on 10 acres and that the minimum setback in no way encumbers
the usefulness or positioning of those residences. The preservation of the old growth
forestation on the middle section of the 10 acres will in fact enhance the beauty and value
of these 10 acres. There is truly no logical, practical or engineering argument to support
any reduction of this agr"eed upon setback of 42 feet.
We request that the agreement of these parties be given the full support of the
Commission and imposed as a legal requirement for the development of Lakeland
Subdivision. Specifically, the planned street edge must be required to be setback a
minimum of 42 feet from the property line between Claridge Farm and the Lakeland
Subdivision, the trees up to the street must be preserved, and evergreen trees must he
placed along the street where it parallels the Claridge Farm property line to establish a
year-round buffer between these properties.

We the undersigned residents of Claridge Farm located West of the Clay Center
and 126th Street intersection in Carmel, Indiana, do hereby petition to preserve the
individual property values within Claridge Farm by requiring the setback of the planned
Lakeland Avenue within the plmmed development of Lakelalld subdivision such that the
curb is positioned a minimum of 42 feet from the Claridge Farm property line, This
minimum setback requirement will preserve the property values of all homes within
Claridge Farm by not diminishing the propel1y values of the homes adjacent to the
planned Lakeland subdivision. We wish to prevent the creation of double frontage lots
with the homes that set the upper property values for Claridge Farm. The minimum
setback of 42 feet has been established upon the agreement of Christian Browning and
Michael Bush, principals of Browning Investments, thc owncr of the propcrty, with Mr.
and Mrs. Mark Saggese of Claridge Farm on July 30,2007. Browning Investments has
further agreed to place evergreen trees along Lakeland A venue for year-round buffering
between Claridge Farm and Lakeland. We further petition to the Carmel Plan
Commission to honor these agreements by imposing the agreements, previously made
and set forth above, for evergreen trees and a 42 feet setback as legal requirements for the
development of Lakeland subdivision.
