EXPLANATION OF REQUESTED SIGN VARIANCES
The Applicant, 4000 East LLC, is the owner of the building located at 4000 East
96th Street. The building that is located upon this site will actually contain two (2)
tenants. The fIrst tenant will be "C Smart/Smart Center Indianapolis" a new car
dealership. The second tenant will be "World Wide Motors Used Cars" a pre-owned
Mecedes-Benz car dealership. Because two (2) tenants occupy the real estate, the
building would be defIned as a "multi-tenant ground floor building" per Section
25.07.02-09 of the Carmel Sign Ordinance. The site is located west of and adjacent to
Lake Short Drive and north of and adjacent to 96th Street. Thus, the building has
frontages on two (2) roadways.
Docket No. 07090007V requests a Variance to permit two (2) oftbe wall signs on
the southem elevation of the building facing 96th Street. Docket No. 07090009V requests
a variance to permit two (2) ground sign facing Lakesbore Drive. The Sign Ordinance
would permit only one (1) wall sign facing 96th Street and only one (I) ground sign
facing Lakeshore Drive.
The purpose of these signs is to properly identifY the two (2) separate car
dealerships that will occupy the building. Previously, numerous businesses occupied this
building and the building actually contained more signage than what is proposed as part
of the re-development of the property. Further, other car dealerships exist along this 96th
Street corridor on both the Hamilton Cmmty and Marion County sides of the street. 'fhe
Appl icant would face a hardship and practical difficulty if it were not permitted to utilize
its car dealerships as its competitors.

FINDINGS OF Ii' ACT - USE VARIANCE
I. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because the proposed wall signs that are the subject of the variance
requests are designed to provide adequate notice of the Petitioner's business and location and as a
result, the granting of this variance will not be injurious to the public health, safety, morals and
general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because the variance applies to additional wall signage on the site
and building and the surrounding properties are all used and/or zoned for commerciallbusiness
uses.
3. The strict application of the tenns of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property due to the fact that the Petitioner will be prevented from
utilizing wall signs that are an appropriate size and designed to provide notice of the business
location to its customers.
DECISION
IT IS THEREFORE the decision of the Cannel/Clay Board of Zoning Appeals that Variance Docket
No. 07090007V is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof
