EXPLANA nON OF SIGN V ARlANCE REQUEST
The Applicant, House Investments ("House"), previously obtained ADLS and
Development Plan approval from the Plan Commission on July 17,2007 for an office
building to be constructed upon a parcel of real estate that is located at 10250 Illinois
Street, which is located south of I06th Street and west of US 3'1/Meridian Street. The real
estate is zoned B-] Business and the parcel is approximately 1.187 acres in size.
On August 2ih House appeared before the BZA Hearing Officer and obtained
approval to construct an additional tenant wall sign on the building. As a result, two (2)
tenant wall signs will be utilized for this building. However, at the August 2ih BZA
Hearing Officer meeting, it was also determined that House was required to obtain a
variance to permit these two (2) tenant wall signs because neither faced a public frontage
or public right-of-way. House is now seeking its final variance for signage, a variance
from the BZA Hearing Officer for permission to construct two (2) tenant wall signs that
will not face a public frontage or public right-of-way.
Both tenant wall signs will comply with the size requirements for such signs and
will not be illuminated. Absent approval of the variance request, the tenants of this
building will not be able to provide adequate and proper notice of its location.

photograph is a closer perspective of the lot in question with the site plan
superimposed onto the aerial photograph.

B. Exhibit 3 - Site Plan - This exhibit is the approved site plan for this project.
C. Exhibit 4 - Rendering of Proposed Tenant Wall Sign - This exhibit is a
rendering ofthe proposed tenant wall signs. The Plan Commission, on July
] ih, approved the design of these signs. The variance is required in order to
locate these tenant wall signs on a building fac;ade that does not face a public
frontage or public right-of-way.
D. Exhibit 5- Proposed Findings of Fact- This exhibit is the proposed findings
of fact for this variance request.

I, The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because the proposed tenant wall signs that are the subject of the
variance request would not be illuminated and the grantin'g ofthis variance will not be injurious to
the public health, safety, morals and general welfare of the community.

2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because the variance applies to the placement of two (2) tenant
wall signs on a building fayade that does not face a public right-of-way and the underlying zoning
is B-1 Business~ which permits the proposed use of an office building. The proposed building is
part of an overall office park development, and, as a result, the granting of the variance would not
have an adverse impact on the area adjacent to the property.
3, The strict application of the terms of the Zoning Ordinance, to the property will result in practical
difficulties in the use of the property due to the fact that Petitioner will be prevented from utilizing
teriant wall signs on the most appropriate building fayade, which location is designed to provide
notice ofthe tenant's business location to its customers.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that
Variance Docket No. 07090004V is granted, granted subject to any conditions stated in the
minutes of this Board which are incorporated herein by reference and made a part hereof.
Adopted this 22nd day of October, 2007.
