1. Docket No. 64-02, Z~ Rezone of Dixie Hi-Way Addition,
Lot 8 & the west balf of Lot 9
The petitioner seeks to rezone one lot from the R-3/ Residence District within the Home
Place District Overlay Zone to the B-l/Business District within the Home Place District
Overlay Zone. The site is located at 10820 North College Avenue. The site is zoned R-
3/Residence within the Home Place District Overlay Zone.

The applicant is proposing to rezone two parcels of real estate at 10820 North College Avenue.
Please see the information packet provided by the applicant prior to the Public Hearing.
There were no comments from the public at the June 18th Public Hearing. Commissions had
questions regarding improvements to College Avenue and medical waste.
The following are relevant issues related to this request:
1. The City Council adopted the Home Place Overlay District Ordinance earlier this year
designating the subject area for future commercial development.
2. The improvements proposed today by the applicant are minimal. TIns is in an effort to
ensure that at some point in the future the site would be ripe for redevelopment in full
compliance with the vision identified within the Home Place Overlay.
3. The applicant wants to take the existing single family home and use it for his office. It
needs to be understood that the applicant's intent is to create a transitional use ofthe
property that will ensure future commercial development. Under the ordinance today,
even though it is under the overlay, the site could be developed for duplexes. This is not
the type of development desired under the overlay. However, short-term returns may
dictate this use. This is only an ob:;ervation based on discussions with others in the area.
4. The use, as proposed by the applicant, would require additional approval after the rezone
by both the Plan Commission and BZA. ADLS and Development Plan Approvals are
required as well as the variances that would be necessary for all tile existing home to be
utilized. The applicant should be aware now of the position oftlle Plan Commission
regarding these necessary approvals. We do not want to rezone the property now with the
full understanding of what the applicant wants to do and then not support the other
requests after the rezone would be approved.
The Department recommends that this item be forwarded to the full Plan Commission with
a favorable recommendation after all comments and concerns have been addressed.
