Docket No. 64-02 Z; Rezone of Dixie Hi-Way Addition, Lot 8 & the west halfof Lot 9 The petitioner seeks to rezone one lot from the R-3/ Residence District within the Home Place District Overlay Zone to the B-1/Business District within the Home Place District Overlay Zone. The site is located at 10820 North College Avenue. The site is zoned R- 3/Residence within the Home Place District Overlay Zone. Filed by Leonard Voight. The applicant is proposing to rezone two parcels ofreal estate at 10820 North College Avenue. Please see the information packet provided by the applicant. The following are relevant issues related to this req uest: 1. The City Council adopted the Home Place Overlay District Ordinance earlier this year designating the subject area for future conunercial development. 2. The improvements proposed today by the applicant are ntinimal. This is in an effort to ensure that at some point in the future the site would be ripe for redevelopment in full compliance with the vision identified within the Home Place Overlay. 3. The applicant wants to take the existing single family home and use it for his office. It needs to be understood that the applicant's intent is to create a transitional use of the propeliy that will ensure future commercial development. Under the ordinance today, even though it is under the overlay, the site could be developed for duplexes. This is not the type of development desired under the overlay. However, short-term returns may dictate this use. This is only an observation based on discussions with others in the area. 4. The use, as proposed by the applicant, would require additional approval after the rezone by both the Plan Commission and BZA. ADLS and Development Plan Approvals are required as well as the variances that would be necessary for all the existing home to be utilized. The applicant should be aware now of the position of the Plan Commission regarding these necessary approvals. We do not want to rezone the property now with the full understanding of what the applicant wants to do and then not support the other requests after the rezone would be approved. This request will be interesting to review due to its position as the first out of the gate under the new Comprehensive Plan Amendment for Home Place Overlay. There are long tenn advantages and short-term disadvantages that will need to be discussed. The Department recommends that this item be forwarded to the Subdivision Committee on July 2" for further discussion.
