HomeMy WebLinkAboutBPW-10-17-07-04 Worker Comp/Street '" -", "'x RESOLUTION BPW 10-17-07-04 A RESOLUTION TO SUPPLEMENT WORKER'S COMPENSA nON BENEFITS FOR MARK CARTER WHEREAS, the City of Carmel (the "City") provides worker's compensation benefits, which are equal to l\vo-thirds of the employee's normal compensatIOn, for employees who must take time off due to job-related injuries; and WHEREAS, the City automatically supplements worker's compensation benefits to allow an employee to receive his or her normal gross pay for the first forty_l\vO (42) days of a compensable absence; and WHEREAS,continuation of the worker's compensation supplement after the initial forty-two (42) day period must be approved by the Board of Public Works and Safety; ~nd . WHEREAS, Mark Carter ("Carter") was injured while performing his job duties on July 20, 2007; and WHEREAS, Carter has followed the prescribed course of treatment for his work injury, but has not yet been released by his worker's compensation physician to return to work; and WHEREAS, it isin the best interests of the City to provide supplemental worker's compensation payments to Carter beyond the initial forty-two (42) day period, allowing him to. focus on his rehabilitation. NOW, THEREFORE, BE IT RESOLVED by the Carmel Board of Public Works and Safety as follows: I I I i The City of Carmel will continue to supplement Mark Carter's worker's compensation payments, as. outlined in Section 2-52 of Carmel City Code, until the earliest of thl' fOllowing: November 16,2007; the date on which his worker's'compensation physiciall releases him to return to full-time work with the City; the date on which the City's worker's compensation. caI-:i~r offers him a settlement for a permaneni partial impainl1~1l1 or.a .rernlanent total dIsabilIty; or, the date on which his employment with the City is ternlll1ated. .
