Please find enclosed revised site plans tbat address the following conullents: 1, . The legal description has been added to the plans. 2. Each tenant will have a wall sign located over the tenant space. The signs will be individual letters, dark bronze in color and back lit. Their allowable size is dictated by the Sign Ordinance. 3. Additional attention needs to be paid toward section 23C.9 regarding Architectural Design Requirements. The ordinance requires buildings of greater than 90' in width to provide offsets of not less than 8' in depth, revise building footprint. The building has no defmed base, revise elevation. '( The northerly pipeline (400 line) was secured by condemnation, Cause No. 8544, Book 109, Page 225 in the Tipton County Circuit Court. The permanent easement and right-of- way is a strip of land 66 feet in width, being 16' on the northwest side and 50' on the southeast side ofthe pipeline. The southerly pipeline on this parcel (300 line) was defined by Modification of Right-of-Way Grants dated 3-31-58. The easement and right- of-way is a strip of land 100 feet in width, being 50' each side of the pipeline (See page 3, paragraph B). In response to plans dated March 13,2002, Panhandle would request the tollowing prior to any approval: 1. Field locate, and mark the pipelines across subject property; 2. Illustrate the location afthe pipelines and compare the centerline descriptions in the legal docUlllents for accuracy. The plans illustrate a future building 3 of which a comer appears within the pipeline easement or at the easement boundary. Specific circumstances may neceSsitate additional considerations. GENERAL REQUIREMENTS: No permanent structures of any kind shall be permitted, placed or erected within the easement parcel, including storm drains, catch basins, water impoundments, fire hydrants, sign boards, supports, brace poles, telephone and power line poles, lighting poles, decks, fences, railroad tracks, garages, buildings, trailers, septic tanks, leach fields, swimming pools, berms. All roads, driveways, streets, sidewalks, alley or cUrbing shallcross the pipeline(s) at an angle near to 90 degrees as practical extending the width of the easement parceL A minimum. cover of36" of cover between the top of the pipeline(s) and bottom of the pavement must be maintained across the entire width of the easement parcel. No portion of the easement parcel shall be utilized for the parking of vehicle"s, and no impervious type pavement in connection "\Vith the establishment or use of any vehicular parking area shall be placed over or within the easement parcel. Proposed street intersections, cul de sacs, drainage and utility easements shall be designed outside the easement parcel. All utilities shall be constructed below the pipeline(s) with a minimum of 18" of clearance. Additional separation may be required in marshy areas or other areas where the 18" of clearanc~ would have a potential for future problems. Telephone, electric, and plastic gas lines under 4" shall be .installed under the pipeline( s) where practical, and encased in conduit. Ifunderground cables are over 600 volts, the cable must cross below the pipeline(s), placed in non-metallic rigid conduit encased in concrete that has been colored in red dye, or covered with bags of sakrete, extending across the confines of the easement parcel. Storm drains must be solid impervious material extending the width of the easement parceL No foreign.structures, appurtenances or related fittings will be permitted within the easement parcel. u u No trees,sbrubs, or evergreens shall be permitted, placed or planted anywhere on the easement parcel No cover or any lateral or subjacent support be removed. from said pipeline(s) except temporarily and as an incident to the construction of utilitymstallatians, streets sidewalks, driveway, road, ditch or swale, alley or curbing authorized to be placed across the easement parcel. DRAINAGE SWALESIW ATERW AYSIDITCHES: Proposed ditches or waterways must cross the pipeline at near or right angles across the easement parceL A minlmum cover of36" between'the top ofpipeline(s) and bottom of ditch or waterway must be maintained. No drainage swales or reductions in grade are permitted on the pipeline easement. Limited additional fill may be deposited. Proposed grades shall not restrict the Company's access to the right-of-way easement, cause ponding of surface water on the easement, nor redirect the flow afwater, which could generate any amount of erosio'n on or near the easement. Ditches, waterways or swales will riot be permitted to run parallel and within the easement parcel. ' TERRACES: No cover should be removed untillocatian of facility crossing and depth of pipeline can be determined. If it is necessary to remove cover within the right-ai-way confines, the remaining cover of36" must be maintained. Prior approval from the company must be o btamed. EARTHWORK: The adding of cover may be permitted, if necessary, but the depth of cover should not exceed 7' from the top of the pipeline to final grade. Prior approval from the company must be obtained. BLASTING: No blasting will be permitted within the pipeline(s) easement. The Company must be advised of any blasting proposed within 500' of its facilities. The party responsible tor the blasting must submit detailed plans to allow far evaluation and ta make arrangements for witnessing the blasting operations. u ...u DRA. EXCAVATION: When necessary to excavate near company pipeline(s), a Company repre~entative must be on site to witness the excavation, to locate the pipefuies, and to detenftine the depth of cover before and during the excavation. The contractor must not perform any excavation, crossing, backfilling or other cnnstruction operations unless the Company representative is on site who shall have full authority to stop the work if it is being performed in an illlSafe manner. Excavation with a third party backhoe or other mechanical equipment shall not be permitted within the Company's easement until the excavation procedure has been reviewed and approved by a company representative. As a minimum, the excavation procedure will require the contractor's backhoe to have a plate welded over the teeth of the backhoe bucket and to have the side cutters removed prior to excavatiOb. VEmCULAR CROSSiNGS: Heavy equipment crossings should be stopped until calculations can be made too determine the effects of the external loads on the stress of the pipeline(s). Immediate or long-term damage to the pipeline(s) may occur as a result ,of external stresses associated wnh crossing buried pipeline(s}by heavy _equipment. The developer.or .c.ontractor must discuss this matter with the company and provide to the company's technical staff the total loaded axle weight for each piece of heavy equipment. After reviewing the plans the Highway Department has the following comments: 1. In accordance wIth the Hamilton County Thoroughfare Plan, additional right of way is required at the intersection of 1oa1h Street and Commerce Drive. On Commerce Drjve, the right of way from the intersection to a point 500' to the south [s a 60' half. From that point to the southern property line the right of way is 45'. On 1 061n Street, the right of way from the intersection to a point 500' to the east is a 65' half, From that point to the eastern property line the right of way is a 50' half. A 50' triangular cut is also needed at the intersection, connecting the right of way for the perimeter streets. 2. As a part of this project, the eastbound lane of 1061" Street will need to be widened to a total width of 24', The widening should extend to the east property line. A taper will need to be striped to transition the traffic back to one lane. east 01 the prOject. 3. Adequate roadside drainage wilJ need to be provided along the widened section of 10Sth Street. 4. Please correct Note 2 In Section 02510 of the Specifications to read Hamilton Coonty Highway Department. 5. The curb retum radius at the north entrance should be increased to 30' and 45' at the south entrance. 6. Road cuts will not be issued for any installation of utilities.
