Dear Angie:
We have received your review letter dated .T anuary 14, 2004' regarding the Cannel
Centre West Office BUllding on Lot #2. Please find enclosed revised site plans tbat
address the following conullents:
1, . The legal description has been added to the plans.
2. Each tenant will have a wall sign located over the tenant space. The signs will be
individual letters, dark bronze in color and back lit. Their allowable size is
dictated by the Sign Ordinance.
3. The drive at the rear of the bui Iding wi 11 be used for the loading berth.
4. All easement have been labeled on the plan.
S. No rooftop mechanical equipment is planned and the dumpster area will be shared
with Building #1.
6. Building dimensions have been labeled on the plans.
7. We have not received a letter from the Urban Forester but we have addressed in
plan fonn his verbal comments from the T AC meeting.
8. Your comment is duly noted.
9. The 10 ft. path was shown on the previous plans.
Also, please find enclosed responses to the review letters that we have received to

AutoLux S
Housing.
.Allhousings are manufactured using technologically advanced
computer numerical control (CNC) machinery. Precision
sheared and formed, .080 gauge, corrosion resistant aluminum.
. The computerized (CNC) machinery enables all AutoLux
housings to be constructed quickly, efficiently, and adhering to
exacting ISO 9002 standards. All external hardware is
stainless steel.
Lens and Door Assembly
. Door assembly is (CNC) precision, sheared and formed from
.080 corrosion resistant aluminum and Quali-Guard@ finish.
. The lens is a tempered clear safety glass, secured by
aluminum lens retainers and sealed with form fitting silicone
gasketing.
Optical System
~ The Optical System is (CNC) cut and bent, providing precise
and consistent, mu Iti-faceted 95 percent reflective systems for
IES types I, II, III, IV, and V distributions.
Quali-Guard@
. The finish is a Quali-Guard@ textured, chemically pretreated
through a multiple stage washer, electrostatically applied,
thermoset polyester powder coat finish, with a minimum of two
mi. thickness. Finish is oven baked at a temperature of 400
degrees fahrenheit. to promote maximum adherence and
finish hardness. All finishes are available in standard and
custom colors.

ecificafions
Mounting
. An extruded aluminum, bolt-on-arm with continuous channels,
securing (2) 3/8 inch zinc running bolts with stainless steel
hardware is standard. Extruded aluminum arm is premounted to
. fixtures by Visionaire.
. Optional slip-fit arm provides ease of installation. This is
recommended for retrofitting existing poles.
Electrical Assembly
. Ballast is factory wired and tapped to voltage specifications.
All ballasts are CWA or HPF regulating auto transformers,
available in Metal Halide, Pulse Start, and High Pressure
Sodium. Ballast is capable of providing consistent lamp
starting down to -20 degrees fahrenheit 8allast is fastened to
an easily accessible ballast tray for service convenience.
. Socket is a glazed porcelain medium or mogul base with nickel
plated contacts, rated at 5K and 600V.
Options
. Fixtures available with a variety of options, including photo
cell, quartz restrike, light shield, and fusing. Please consult
factory for custom options.
Listing
. AutoLux is UL listed, suitable for damp and wet locations.
All fixtures factory tested and prelamped prior to shipment.

A complete Shakespeare Fiber-

the dash. The lett~rs and numbers to
the left of the dash are the Basic Cata-
log Number, found in the listings of
the poles. To the right of the dash are
the options which you can specify in
the order listed. Most available options
are listed in the template below. Call
Shakespeare for all other options.
To decide which Shakespeare
fiberglass pole you need, first consid-
er your application: anchor base Or
direct burial (Shakespeare re~om-
mends direct burial far cost efficiency
and ease of installation), round or
square, regular or breakaway, and the
method of luminaire attachment.
Using your required mounting
height, wind speed, and the total EPA
and weight of aU intended attachmen-
ts, select a pole. with loading ratings
that meets your needs.
The Basic Catalog Number is list-
ed in the catalog pages (plus two dig-
. its after the dash for mast arm poles).
The remainder of the Shakespeare

AutoLux Specifications.
Housing
. All housings are manufactured using technologically advanced
computer numerical control (CNC) machinery. Precision
sheared and formed, .080 gauge, corrosion resistant aluminum.
. The computerized (CNC) machinery enables all AutoLux
housings to be constructed quickly, efficiently, and adhering to
exacting ISO 9002 standards. All external hardware is
stainless steel.
Lens and Door Assembly
. Door assembly is (CNC) precision, sheared:and formed from
.080 corrosion resistant aluminum and Quali-Guard@ finish.
. The lens is a tempered clear safety glass, secured by
aluminum lens retainers and sealed with form fitting silicone
gasketing.
Optical System
. The Optical System is (CNC) cut and bent, providing precise
and consistent, multi-faceted 95 percent reflective systems for
IES types I, II, III, IV, and V distributions.
Quali-Guard@
. The finish is a Quali-Guard@ textured, chemically pretreated
through a multiple stage washer, electrostatically applied,
thermoset polyester powder coat finish, with a minimum of two
ml. thickness. Finish is oven baked at a temperature of 400
degrees fahrenheit. to promote maximum adherence and
finish hardness. All finishes are available in standard and
custom colors.

Mounting
. An extruded aluminum, bolt-on-arm with continuous channels,
securing (2) 3/8 inch zinc running bolts with stainless steel
hardware is standard. Extruded aluminum arm is premounted to
fixtures by Visionaire.
. Optional slip-fit arm provides ease of installation. This is
recommended for retrofitting existing poles.
Electrical Assembly
. Ballast is factory wired and tapped to voltage specifications.
All ballasts are CWA or HPF regulating auto transformers,
available in Metal Halide, Pulse Start, and High Pressure
Sodium. Ballast is capable of providing consistent lamp
starting down to -20 degrees fahrenheit. Ballast is fastened to
an easily accessible ballast tray for service convenience.
. Socket is a glazed porcelain medium or mogul base with nickel
plated contacts, rated at 5K and 600V.
Options
. Fixtures available with a variety of options, including photo
cel!, quartz restrike, light shield, and fusing. Please consult
factory for custom options.
Listing
. AutoLux is UL listed, suitable for damp and wet locations.
All fixtures factory tested and prelamped prior to shipment.

Housing
.; Rugged, one piece die-cast, soft corner aluminum housing
with 0.12 inch nominal wall thickness.
(SFM-1, SFR-1, & SFL-1)
. SFRB-1 & 2 and SFL-K, are precision formed'from c?rrosion
resistant aluminum, utilizing state of the art (CNC) machfnery,
designed to ensure accuracy and consistency in all fixture
housings, as well as a weathertight seal.
. All hardware is rust resistant stainless steel.

Lens and Door Assembly
. Die-cast external hinged door frame is fully gasketed. A one
piece extruded silicone gasket seals the door frame against
the housing. (SFM.1, SFR-1, & SFL-1)
. The Lens is a clear tempered flat glass, completely enclosed
and gasketed for a weathertight seal.
Optical System
. The Optical System is (CNC) cut and bent, providing
precise and consistent, multi-faceted 95 percent reflective
systems for narrow and wide beam applications.
Quali-Guard~
. The finish is a Quali-Guard@ textured, chemically pretreated
through a multiple stage washer, electrostatically applied,
thermoset polyester powder coat finish, with a minimum of two
ml. thickness. Finish is oven baked at a temperature of 400
degrees fahrenheit. to promote maximum adherence and
finish hardness. All finishes are available in standard .and
custom colors.
Adjustable Knuckle

Mounting
. The SmartFlood luminaires are available with either a die-cast
aluminum, adjustable knuckle; designed to slip over 2-3/8 inch
to 3 inch 00. pipe, or an adjustable trunion "U" bracket, with
stainless steel hardware. Knuckles and trunion brackets are
premounted to fixtures by Visional.re.
Electrical Assembly
. Ballast is factory wired and tapped to voltage specifications.
All ballasts are CWA or HPF regulating auto transformers,
available in Metal Halide, Pulse Start, and High Pressure
Sodium, Ballast is capable of providing consistent lamp
starting down to -20: degrees fahrenheit. Ballast is fastened to
an easily accessible ballast tray for service convenience.
. Socket is a glazed porcelain medium or mogul base with nickel
plated contacts, rated at5K and 60QV.
Options
. Fixtures available with a variety of options, including photocell,
Quartz restrike, light shield. and fusing. Please consult factory
for custom options.

The Silhouette 2 Sharp Cut~Off Wall Sconce is an HID luminaire suitable
for low glare applications where light spillage is of a concern.
The Housing is available in two sizes. Size One is made of corrosion
resistant precision cast aluminum, Size Two is made of die-formed

We have received your review letter dated March 29,2002 regarding the Carmel
Centre West Office Buildings. Please find enclosed a revised ADLS application, revised
site plans, and revised building elevations that address the following comments:
Application:
1. The Development Plan consists of 4 acres. The legal description on the site plan
has been changed to reflect the 4 acres. The applicant owns 2.243 acres where the
first two office building will be located and has obtained the consent of the owner
ofthe adjoining 1. 759 acres to file a Development Plan on their behalf.
2. The first page of the ADLS application has been revised to reflect two office
buildings.
3, A Replat for Block B of West Cannel Center will be filed once it is complete.
Development Plan:
I, The right-of-way dimension along 106th Street has been revised per the
supplementary letter dated April 22, 2002 from the Hamilton County Highway
Department.
2. The setbacks have been revised to reflect the additional right-of way along 106111
Street.
3. The location ofthe casement for the pipeline is shown on the site plans,
4. The number of parking spaces shown on the site plan complies with the
Carmel/Clay Zoning Ordinance.

5. The side yard setback along the east end of the tract has been revised to reflect a

buildings.
9. A dumpster detail has been added to the plans that shows an enclosure that is
architecturally compatible with the building.
10. The phrase "Future Development" has been deleted from Sheet 4.

ADLS:
1, The buildings meet the 20-foot minimum height requirement. The building
elevations have been revised to indicate a 1 lJ2 story design on the front and sides
of the buildings.
2. An 8-footoffset has been provided in the middle of each building. Also, a base
has been added to the design of both buildings. The quoins have been removed
from the entrances of both buildings.
3. The location of the mechanical equipment has been added to the site plans.
4. A photometric plan has been added to the set of site plans that shows no more to
than .3 footcandles at all property lines.
5. The light poles wil1 be no taller than 24 feet.
6. Landscaping has been added 011 the landscape plan to the base of the center
identification ground sign.
7. The wall signs bave been changed to individual letters and comply with the size
requirements of the Cannel/Clay Sign Ordinance.

Dear Me Reis:
This letter is in response to the Development Plan and ADLS applications filed with plans on March 21, 3001 noted
above. The following comments need to be addressed and/or plans/applications updated accordingly:
Applicatinn(.~):
1. Several acreages a present within information submitted with the application; 4 acres on face of application,
1.759 acres on the zoning consent, 2.243 acres in legal description (sheet no. 4 of plans). Please clarify.
2. It appears that the Development Plan Application has been filed for the entire tract while the ADLS
application refers to only one building. Is this accurate?
3. A Replat for RlockB of West Carmel Center must be submitted. This will require signature by all owners
of real estate within the Block: Parcel splits of Block B are not currently recognized by the Zoning
Ordinance as legal parcels; This application can be submitted prior to or concurrently ,'lith the
Development Plan Amendment. The Replat application vrill be processed administratively.
nevelopment Plan:
1. Revise all right-of-way per letter from Hamilton County Highway Department dated March 26, 2002.
2. Revise all setbacks according to comment one above.
3. Verify the exact location of the Panhandle Pipeline Easement.
4. The minimum parking requirement is one space per 300 square feet of gross floor area. 157 spaces have
been provided. The minimum parking requirements of98 spaces have been greatly exceeded. Ifnecessary
spaces along 106th Street could be deleted to accommodate the additional right-of-way.
5. The side yard building setback along the east end of the tract is fifty feet. Revise plan.
6. Complete the landscape plan. Note that front and side yard parking areas are to be completely screened
from view.
7. The minimum parking lot island width is nine feet (back of curb to back of curb). Revise all islands
accordingly.
8. The minimum building base planting width for the side of all buildings is 5' in width. Revise area along all
sides of building one and area along the front of buildings two and three.
9. Provide a detail of the trash collection area. Note that it shall be enclosed and architecturally compatible
with the buildings.
10. Provide a connection between the buildings and the sidewalk along 1 06th Street.
11. Delete "Future Development" note on Sheet 4 on plans.

The minimum building height is 20'. This applies to all portions of the buiLding. A void long
uninterrupted roofplanes. I would encourage a two (2)-story design. A 1 :6-story design is required
along the front and sides of the buildings. Modifications are necessary for the proposed building to
meet the minimum specifications.
Additional attention needs to be paid toward section 23C.9 regarding Architectural Design
Requirements. The ordinance requires buildings of greater than 90' in width to provide offsets of not
less than 8' in depth, revise building footprint. The building has no defmed base, revise elevation.
Material changes are not permitted aLong a vertical line (Section 23C.9.D). The Quoins and limestone
accents do not conform to this requirement, revise elevations.
\\There is mechanical equipment to be located?
Submit lighting plan to illustrate property lines and meet maximum of 0.3 footcandles at all property
lines.
Note that the maximum light pole height is 24 feet per Section 23C.12.B.
All signage will require approval by the Plan Commission. The proposed ground sign may be a
maximum of 60 square feet in area and 6 feet tall. The sign also requires landscaping:
Based on the setbacks and building frontage a sign on the building may be either a maximum of 30 or
35 square feet in area depending on the setback of the sign from the right-of-way. Ifall signs are
proposed to be 33.6875 square feet in area a variance will be required. .

upon receipt of additional information necessary to complete the application. T AC will review the plans at their
Aprill iJJ. meeting. However, due to the changes necessary to bring the proposal into conformance with the
Ordinance it may be necessary to schedule an additional hearing at T AC in May.

Dear Mark:
Pursuant our telephone conversation on 3-26-02, enclosed is a copy of Panhandle Eastern
Pipe Line Company's map showing the approximate location of our two 30" high
pressure natural gas transmission pipelines crossing the referenced property.

The northerly pipeline (400 line) was secured by condemnation, Cause No. 8544, Book
109, Page 225 in the Tipton County Circuit Court. The permanent easement and right-of-
way is a strip of land 66 feet in width, being 16' on the northwest side and 50' on the
southeast side ofthe pipeline. The southerly pipeline on this parcel (300 line) was
defined by Modification of Right-of-Way Grants dated 3-31-58. The easement and right-
of-way is a strip of land 100 feet in width, being 50' each side of the pipeline (See page
3, paragraph B).
In response to plans dated March 13,2002, Panhandle would request the tollowing prior
to any approval: 1. Field locate, and mark the pipelines across subject property; 2.
Illustrate the location afthe pipelines and compare the centerline descriptions in the legal
docUlllents for accuracy.
The plans illustrate a future building 3 of which a comer appears within the pipeline
easement or at the easement boundary. For the safety and integrity of the pipelines, the
company would appreciate your consideration by adjusting the building location to a
minimum distance of33' measured at right angles from the pipeline. It appears that
building 1 is at least 50' from the centerline of pipe, which is a more acceptable design
adjacent our facilities.
A more detailed drawing of the south entrance into the site is needed for review.' Is a
culvert being installed at this entrance and will there be a ditch cut over the pipelines?

GENERAL ~QUIREMENTS FOR CONSTRUCTION IN THE VlCINITY OF
PANHANDLE EASTERN PIPELINE COMPANY'S PIPELINE(S) OR
EASEMENT

THE PIPELIl'I""E(S) EASEMENT
The followin~ lluidelines present the 2eneral requirements for construction in the
viCinity of Pan.h and Ie Eastern Pipe Line Company's (herein referred to as
Company) pipeline or easement. Specific circumstances may neceSsitate additional
considerations.
GENERAL REQUIREMENTS:
No permanent structures of any kind shall be permitted, placed or erected within the
easement parcel, including storm drains, catch basins, water impoundments, fire
hydrants, sign boards, supports, brace poles, telephone and power line poles, lighting
poles, decks, fences, railroad tracks, garages, buildings, trailers, septic tanks, leach fields,
swimming pools, berms.
All roads, driveways, streets, sidewalks, alley or cUrbing shallcross the pipeline(s) at an
angle near to 90 degrees as practical extending the width of the easement parceL A
minimum. cover of36" of cover between the top of the pipeline(s) and bottom of the
pavement must be maintained across the entire width of the easement parcel. No portion
of the easement parcel shall be utilized for the parking of vehicle"s, and no impervious
type pavement in connection "\Vith the establishment or use of any vehicular parking area
shall be placed over or within the easement parcel. Proposed street intersections, cul de
sacs, drainage and utility easements shall be designed outside the easement parcel.
All utilities shall be constructed below the pipeline(s) with a minimum of 18" of
clearance. Additional separation may be required in marshy areas or other areas where
the 18" of clearanc~ would have a potential for future problems. Telephone, electric, and
plastic gas lines under 4" shall be .installed under the pipeline( s) where practical, and
encased in conduit. Ifunderground cables are over 600 volts, the cable must cross below
the pipeline(s), placed in non-metallic rigid conduit encased in concrete that has been
colored in red dye, or covered with bags of sakrete, extending across the confines of the
easement parcel.
Storm drains must be solid impervious material extending the width of the easement
parceL No foreign.structures, appurtenances or related fittings will be permitted within
the easement parcel.

No trees,sbrubs, or evergreens shall be permitted, placed or planted anywhere on the
easement parcel
No cover or any lateral or subjacent support be removed. from said pipeline(s) except
temporarily and as an incident to the construction of utilitymstallatians, streets
sidewalks, driveway, road, ditch or swale, alley or curbing authorized to be placed across
the easement parcel. Prior approval by the company must be obtained for either removal
or addition of additional cover over the pipeline easement parcel.
DRAINAGE SWALESIW ATERW AYSIDITCHES:
Proposed ditches or waterways must cross the pipeline at near or right angles across the
easement parceL A minlmum cover of36" between'the top ofpipeline(s) and bottom of
ditch or waterway must be maintained.
No drainage swales or reductions in grade are permitted on the pipeline easement.
Limited additional fill may be deposited. Proposed grades shall not restrict the
Company's access to the right-of-way easement, cause ponding of surface water on the
easement, nor redirect the flow afwater, which could generate any amount of erosio'n on
or near the easement. Ditches, waterways or swales will riot be permitted to run parallel
and within the easement parcel. '
TERRACES:
No cover should be removed untillocatian of facility crossing and depth of pipeline can
be determined. If it is necessary to remove cover within the right-ai-way confines, the
remaining cover of36" must be maintained. Prior approval from the company must be
o btamed.
EARTHWORK:
The adding of cover may be permitted, if necessary, but the depth of cover should not
exceed 7' from the top of the pipeline to final grade. Prior approval from the company
must be obtained.
BLASTING:
No blasting will be permitted within the pipeline(s) easement. The Company must be
advised of any blasting proposed within 500' of its facilities. The party responsible tor
the blasting must submit detailed plans to allow far evaluation and ta make arrangements
for witnessing the blasting operations.

DRA. WINGS:
The pipeline( s) depth and location must be incorporated :into the proposed development
site plan and accurately scaled on to actual construction prints.' All construction prints
must contain th~. following on each sheet showing the pipeline:

Upon review of this information and incorporation of all applicable requirements, two (2)
complete sets of design drawings must be submitted to the. Company for review by the
Company's technical staff The Company must pre-approve development desi~.
construction and any modifications plans involving companifacilities.
EXCAVATION:
When necessary to excavate near company pipeline(s), a Company repre~entative must
be on site to witness the excavation, to locate the pipefuies, and to detenftine the depth of
cover before and during the excavation. The contractor must not perform any excavation,
crossing, backfilling or other cnnstruction operations unless the Company representative
is on site who shall have full authority to stop the work if it is being performed in an
illlSafe manner.
Excavation with a third party backhoe or other mechanical equipment shall not be
permitted within the Company's easement until the excavation procedure has been
reviewed and approved by a company representative. As a minimum, the excavation
procedure will require the contractor's backhoe to have a plate welded over the
teeth of the backhoe bucket and to have the side cutters removed prior to
excavatiOb.
VEmCULAR CROSSiNGS:
Heavy equipment crossings should be stopped until calculations can be made too
determine the effects of the external loads on the stress of the pipeline(s). Immediate or
long-term damage to the pipeline(s) may occur as a result ,of external stresses associated
wnh crossing buried pipeline(s}by heavy _equipment. The developer.or .c.ontractor must
discuss this matter with the company and provide to the company's technical staff the
total loaded axle weight for each piece of heavy equipment. Load .calculations .on.the
pipelines will be evaluated to determine the combined stresses on the pipelines and if any
tempOIary proiectiv.e measures must be taken. If stresses :ar:e not acceptable, necessary
means to distribute the load such as matting or timbers will be required prior to
equipment crossings.

This letter serves to acknowledge receipt of a transmittal received March 21, 2002, containing the
plans for the above-mentioned project. After reviewing the plans the Highway Department has the
following comments:
1. In accordance wIth the Hamilton County Thoroughfare Plan, additional right of way is
required at the intersection of 1oa1h Street and Commerce Drive. On Commerce Drjve, the
right of way from the intersection to a point 500' to the south [s a 60' half. From that point to
the southern property line the right of way is 45'. On 1 061n Street, the right of way from the
intersection to a point 500' to the east is a 65' half, From that point to the eastern property
line the right of way is a 50' half. A 50' triangular cut is also needed at the intersection,
connecting the right of way for the perimeter streets.
2. As a part of this project, the eastbound lane of 1061" Street will need to be widened to a total
width of 24', The widening should extend to the east property line. A taper will need to be
striped to transition the traffic back to one lane. east 01 the prOject.
3. Adequate roadside drainage wilJ need to be provided along the widened section of 10Sth
Street.
4. Please correct Note 2 In Section 02510 of the Specifications to read Hamilton Coonty
Highway Department.
5. The curb retum radius at the north entrance should be increased to 30' and 45' at the south
entrance.
6. Road cuts will not be issued for any installation of utilities. All installation/extension must be
done through pu&h1bore_ Permits will be required of aU work to be perl'ormed within the right
of way.
7_ Commercial Drive Permits will be required for this. pl'oject, please contact Mr. Rob Chadwell,
Permit Inspector, for the necessary forms and information.
a. . The pavement section for aU work done within the right of way shall consist of a 12" stone
baSil, 5" of binder and 1" of surface.
