FINDINGS OF FACT - USE VARIANCE
l. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because the proposed tenant wall signs that are the subject of the
variance request would not be illuminated and the granting of this variance will not be injurious to
the public health, safety, morals and general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance wi II not be affected
in a substantially adverse manner because the variance applies to the placement of two (2) tenant
wall signs on a building favade that does not face a public right-of-way and the underlying zoning
is B-1 Business, which permits the proposed use of an office building. The proposed building is
part of an overall office park development, and, as a result, the granting of the variance would not
have an adverse impact on the area adjacent to the property.
3. The strict application ofthe terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property due to the fact that Petitioner will be prevented from utilizing
tenant wall signs on the most appropriate building fa9ade, which location is designed to provide
notice of the tenant's business location to its customers.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that
Variance Docket No. 07090004V is granted, granted subject to any conditions stated in the
minutes ofthis Board which are incorporated herein by reference and made a part hereof.
