Forwarded with favorable recommendation: Ordinance z"S12-07 (Docket No. 07090002 OA): US 31 Overlay Cultur.al& Entertainment Use Amendment Petition to Amend the Zoning Ordinance, Chapter 23B: US IJighway 31 Corridor Overlay Zone, in order to place limits on cultural/entertainment land uses. . Filed by the Carmel Department of Community Services. Please find enclosed the Plan Commission-certified ordinance to amend the US 31 Overlay Zone. The proposed amendments extend the size and placement lirriits, which are already in place for Retail Uses, to Cultural & Entertainment Uses listed in Zoning Ordinance Appendix A. Further limiting uses will help preserve the character and intent of the Meridian Corridor as a regional economic and employment center. As proposed, Cultural & Entertainment Uses would be limited to 15% of the Gross Floor Area of a building, OR up to 30% in a building if the total square footage does not exceed 15% of the entire development plan, and are located either on the ground floor or below grade. Several Cultural & Entertainment Uses are already excluded completely from the Overlay, and are denoted with an "E" in Appendix A. This would limit the square footage of uses, which are allowed in the Corridor today. More 'specifically, they are: - Art Gallery - Art & Music Center - Hotel (full service) Catering Establishment ~ Restaurant, without drive-thru food sales - Meeting or Party Hall - Museum Stadium or Coliseum The information on this item has been arranged in the following format: 1. The Carmel Advisory Plan Commission's recommendation on the petition is FAVORABLE. At its regular meeting on October 16, 2007 the Commission voted eight (8) in Favor, one (l) Opposed (Eric Seidensbcker), zero (0) Abstaining, to forward to the Conunon Council the proposed Ordinance Z- 512-07 with a Favorable Recommendation.
