FINDINGS OF FACT - USE VARIANCE
I. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because the proposed wall signs that are the subject of the variance
requests are designed to provide adequate notice of the Petitioner's business and location and as a
result, the granting of this variance will not be injurious to the public health, safety, morals and
general welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because the variance applies to additional wall signage on the site
and building and the surrounding properties are all used andlor zoned for commercial/business
uses.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property due to the fact that the Petitioner will be prevented from
utilizing wall signs that arc an appropriate size and designed to provide notice of the business
location to its customers.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals tbat Variance Docket
No. 07090007V is granted, subject to any conditions stated in tbe minutes of this Board, which are
incorporated herein by reference and made a part hereof.
