NOTE:
LEGAL NOTICE shall be published in the Indianapolis Star a MANDATORY twenty~five (25)
days prior to the public hearing date. The certified "Proof of Publication" affidavit for the newspaper
must be available for inspection the night of the hearing.

EXPLANATION OF REQUESTED SIGN VARIANCES
The Applicant, 4000 East LLC, is the owner of the building located at 4000 East
96d1 Street. The building that is located upon this site will actually contain two (2)
tenants. The first tenant will be "C Smart/Smart Center Indianapolis" a new car
dealership. The second tenant will be "World Wide Motors Pre-owned Cars" a pre-
owned car dealersltip. Because tv"o (2) tenants occupy the real estate, the building would
be defined as a "multi-tenant ground floor building" per Section 25.07.02-09 of the
Carmel Sign Ordinance. The site is also west of and adjacent to Lake ShorWrive and
north of and adjacent to 96d1 Street. Thus, the building has frontages on two (2)
roadways. Therefore, pursuant to Section 25.07.02-09 of the Sign Ordnance, our
understanding is that each tenant would be entitled to a wall sign for a total of two (2)
wall signs and each tenant would be entitled to a ground sign adjacent to each roadway
frontage for a total of two (2) ground signs - this would result in a maximum of four (4)
permitted signs for the site.
Because each tenant of the building will be operating a car dealership, additional
signage is being requested in order to notify customers and vendors of the relevant areas
for each tenant (such as "service" areas, etc.). Ibe following is a listing of the requested

Based on the foregoing, although four (4) signs arc permitted on the site, the
Applicant is seeking a total of six (6) signs (1 ground sign, 1 identification sign, and 4
wall signs). Our understanding is that a variance would be required for the two (2)
additional signs, but that all sizes of signs are in compliance with the ordinance
requirements. It should also be noted that previously more than two (2) tenants occupied
this building and the building previously had, to the best of our recollection, between
three (3) to five (5) wall signs.
The Applicant would respectfully ask that the Staff to review the proposed
application and advise the Applicant and their attorney of any additional variances that
may be required and are not set forth above.

FINDINGS OF FACT - USE VARIANCE
1. The approval of this variance will not be injurious to the public health, safety, morals and general
welfare of the community because .the proposed signs that are the subject of the variance requests
are designed to provide adequate notice of the Petitioner's business and location and as a result, the
granting of this variance will not be injurious to the public health, safety, morals and general
welfare of the community.
2. The use and value of the area adjacent to the property included in the variance will not be affected
in a substantially adverse manner because the variance applies to additional signage on the site and
building and the surrounding properties arc all used and/or zoned for commerciallbusiness uses.
3. The strict application of the terms of the Zoning Ordinance to the property will result in practical
difficulties in the use of the property due to the fact that the Petitioner will be prevented from
utilizing signs that are an appropriate size and designed to provide notice of the business location to
its customers.
DECISION
IT IS THEREFORE the decision of the Carmel/Clay Board of Zoning Appeals that Variance Docket
No. is granted, subject to any conditions stated in the minutes of this Board, which are
incorporated herein by reference and made a part hereof.

Sign Variance Requests
Application Submittal
Dear Christine:
Enclosed please find the following in regard to the above matter:
1. An original and one copy of the Sign Variance Application;
2. A copy of all relevant sign renderings and a site plan showing the location of
the proposed signs; and,
3. A copy of the tax card and legal description.
My understanding is that the schedule will be as follows:
9/7 - Application due
9/25 - Noon Shinaver email notice to paper for publication
9/27 - Shinaver publish, post sign, and mail certitied mail notice
10/12 - Noon brochures due
10/22- 6:00 pm BZA l-Tearing
Finally, included within the application is an explanation of the requestcd sign
variances. However, please rcvicw the application and drawings and advise me
immediately if I have omitted any required sign variances prior to the issuance of docket
numbers and calculation of the filing fees. Thanks for your assistance in this matter and
please contact me with any questions.
