Gary Duncan is in agreement with you regarding the "non-enforcement" document you submitted along with
your permit application. You do not need to go through our "consent to encroach" process and we will review
your application as submitted and contact you when we are ready to issue it.

This home application should have had the approved encroachment agreement accompanying it... This
was one of the homes in Claybourne that were approved to have the drive encroach into the side-yard
easement area... Was that what the below-referenced issue was pertaining to?... If you do not have that
information with the application I can send it to you. Please let me know. Thanks

parcel number /7-0-30-00-05 - 037. 000
The legal description for this parcel is found in Deed Record Page or instrument
number 2gp¢pgfVZ47 in the Hamilton County Recorders Office. The undersigned owners of
record hereby agree and covenant with this Board that:
Neither the Hamilton County Drainage Board nor any contractor or workman operating under
the authority ofsaid Board will be liable for damages resulting from construction, reconstruction or
maintenance of the above named drain at said location, whether to the real estate or improvements
thereon, and said owners, their grantees and assigns do release and agree to hold the Board
harmless from any such damage. "Damages to paid by the landowner"
The Board will not enforce the easement beyond a distance of _ 5 feet from the Wd-s,4 side
of4he-t&p-of-bank / center line of the file of the saiu-ditcn / drain at that location.
The Board will not object to the improvement of the said real estate at a distance beyond the
enforced portion of the easement.
