The petitioner seeks to rezone one lot from the R-3/ Residence and B-1/Business Districts
within the Old Town District Overlay Zone to R-3/Residence District within the Old
Town District Overlay Zone.
The site is located at 130 First Street Northeast. The site is zoned R-3/Residence and B-
lIBusiness within the Old Town District Overlay Zone.
Filed by the Department of Community Services.
The Department of Community Services has initiated the petition referenced above in order to
remedy a split-zoning situation in Old Town. The matter came to the attention of the Department
when the owner, Jim Davis, made application for an Improvement Location Pennit for new
constmction on the site. The Department apPlised Mr. Davis of the zoning situation and secured
his consent to file this petition (see letter attached to information packet distributed last week).
The Department is requesting that the Plan Commission forward this petition for a rezone from
the R-3/Residence and B-1/Busmess Districts within the Old Town Overlay Zone to the R-
3/Residence District within the Old Town Overlay Zone to the Common Council with a
favorable recommendation.
If tbere are no concerns raised by the public or comments from Plan Commission members
that remain unresolved at the end of the discussion on the item, the Department would
recommend that the Plan Commission suspend its rules and move to forward this request
on to the City Council with a favorable recommendation at this meeting.
