The petitioner seeks to rezone one lot from the R - 31 Residence and B-lIBusiness
Districts within the Old Town District Overlay Zone to R-3lResidence District within
the Old Town District Overlay Zone.
The site is located at 130 First Street Northeast. The site is zoned R-3/Residence and
B-I/Business within the Old TO\Vl1;District Overlay Zone.
Filed by the Department of Community Senrices.
The Department of Community Services has initiated the petition referenced above in order to
remedy a split-zoning situation in Old Town. The matter came to the attention of the
Department when the owner, Jim Davis, made application for an Improvement Location
Permit for new construction on the site. The Department apprised Mr. Davis of the zoning
situation and secured his consent to file this petition.
The Carmel/Clay Plan Commission forwards-this ordinance to the Conunon Council with a
tmanimous (13-0) Favorable Recommendation (see attached certification).
The Department recommends that this item be forwarded to the Annexation and Land
Use Committee for review and that the Council adopt the Ordinance upon receiving a
recommendation from the committee.

REZONING DISTRICT CLASSIFICATION
Rezoning Lot 8 within the Carey '8 Addition to Carmel from the R-3/Residence and B-1/Business
District Classifications within the Old Town District Overlay Zone to the R-3/Residence District

\VHEREAS, the Carme .. lay Plan Commission has favorably recommended the rezoning of
the real property, the legal descrip ion of which is attached hereto as Exhibit A.
NOW, THEREFORE, BEI~ORDAINED by the Common Council ofthe City ofCanne!,
