NE, Ste A Atlanta, GA 30329 RE: Zoning Verification for 3774 Bauer Dr. W., Indianapolis, IN 46280 To Whom It May Concern: The City of Carmel is responsible for enforcement of building codes, zoning ordinances, and similar codes or ordinances related to the residential and commercial development in the City of Carmel, Hamilton County, Indiana. Presented below is information about the property, as requested: The site is currently zoned B-3/Business and is not within any Overlay Zone. The use and operation of the property as automobile sales, auto services, and auto indoor repair are a Permitted Uses of the B-3 district. All other permitted uses of the B-3 district can be found in the Carmel Unified Development Ordinance, UDO Section 2.23 In 2000, Primary Plat Amendment approval (Docket No. 169-00 PPA) was granted by the Plan Commission, attached are the approved Primary Plat and Replat. Also in 2000, Special Use approval (Docket No. 186-00 SU) was granted by the Board of Zoning Appeals permitting automobile sales and services in the B-3 district. The Carmel Zoning Ordinance at the time of approval required Special Use approval for auto sales and services in the B-3 District. All governmental permits and approvals necessary for the construction, use operation and occupancy of the property have been issued and are in full force and effect. The current uses, operations, and improvements of the property are in full compliance with all applicable zoning codes, rules, and regulations of said zoning district. The most recent approved site plan for this property from a 2013 building permit is attached. There are no open zoning code or building code violations or complaints. No aspect of the Property represents a legal non- conforming use, and the Property may be rebuilt to its current state in the event of any damage or destruction, pursuant to UDO Section 8.07(D). This information was researched on March 11, 2025, by the undersigned, per request and as a public service.
